A RECORDED PLAT, IN T14E CITY OF TIGARD, WASHINGTON COUNTY, OREGON WHEREAS, the Tigard City Council initiated this vacation request pursuant to Section 15.08 .040 of the Tigard Municipal Code; and WHEREAS, the reason and purpose for this vacation is to eliminate certain public utility easements for development purposes; and WHEREAS, the vacation is recommended by the Planning Commission and the Department of Community Development; and WHEREAS, in accordance with ORS 271. 100, the TMC Section 15.08.110, the Council fixed a time and place for the public hearing and the Recorder published notice and posted notice in the area to be vacated; and WHEREAS, notice has been mailed to all property owners abutting said vacation area and all owners in the affected area, as described in ORS 271 .080; and WHEREAS, the Council, having held a hearing on September 14, 1987, finds the public interest will not be prejudiced by the vacation as provided by ORS 271 . 12.0 and TMC Section 15.080. 130; and WHEREAS, the Council finds that it is in the public interest to approve the request to vacate certain public utility easement within Bond Park No. 3 subdivision because the public interest will not be prejudiced; and WHEREAS, the council finds that the following conditions are necessary to vacate said land: 1 . The vacation shall not be effective until the effective date of this ordinance, and a certified copy of this ordinance has been recorded with "the Washington County Clerk, Assessor, and Surveyor. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The Tigard City Council hereby orders the vacation of a portion of public utility easements within Bond Park No. 3 subdivision as described and shown on the attached Exhibit "A", and by this reference made part hereof. Section 2: The Tigard City Council further orders that the vacation be subject to the following conditions: ORDINANCE NO. 87—_T Page 1 1 - `� 1 . The vacation shall not be effective until the effective date of this ordinance, and a certified copy of this ordinance has been recorded with the Washington County Clerk, Assessor, and Surveyor. Section 3 : In no situation shall this Ordinance be effective until the 31st day after its enactment by the City Council and approval by the Mayor. Engineer Jim Harris, Harris-McMonagle Associates, has advised that an easement was granted along the lot line of Lot 58 of the subject subdivision for the installation of a 6-inch water line, to be owned and maintained by the water district. However, that easement is not exactly as I described in my letter to you. To protect the interests of the water district for the subject vacation it is requested that 20 feet be reserved for this water line, 10 feet laterally on each side of the boundary line between Lot 58 and Lot 59. Box 23397 Tigard, Oregon 97223 Re: Vacation of portions of Bond Park No. 3 Dear Catherine: The water district has no problems, in general, with the proposed vacation in the subject development with the one ex- ception noted below. The attached map shows the existence of a 6-inch ductile iron water main along the southwesterly lot line of Lot 58 . A 10-foot wide easement for this water line was requested from the engineers for the developer, Harris-McMonagle Associates. However, it appears that this request never materialized on either the official plat or in any other subsequent documents. This is a very important pipeline to the water district in that it will allow the district to eventually make a con- nection to a proposed main on SW Dorburn Place in the future. By copy hereof, the engineers are requested to advise if this easement was ever attained and the measures to be taken so that the water district can obtain same. As to the vacation of the portions noted in your letter it is requested that a 10-foot wide utility easement be reserved along the northwest extension of the property line of Lot 58 as shown on the attached map. The vacation is being processed by the City at the request of Waverly Construction and area residents. Waverly Construction received a lot line adjustment approval from Council in May 1987. A condition of that approval was that the applicant complete vacation of certain public utility easements. Any objections or concerns filed by utility companies have been addressed in any conditions attached to the Ordinance. The Planning Commission is scheduled to consider this request on September O, 1087 and staff will report on the ir recommendations at the hearing. Typically, 6 foot wide utility easements are dedicated along all front and rear lot lines within subdivision platy to facilitate power, water, gas, phone and other utilities. Such was the case with the plat of Bond Park No. 3 . On November 18, 1980 Waverly Construction submitted application to adjust lot lines on Lots 58 — 60 of Bond Park No. 8 and a larger tract of land to the west. Other Utilities Responses were received from the following other utility providers and none had objection to the proposal. Willamette Cable General Telephone Company Northwest Natural Gas Portland General Electric Tigard Water District Transportation Plan and Capital Improvements Plan Given the mature of the easement, the Transportation Plan is not impacted. Future capital improvements have not been identified for this area at this time. It is anticipated that future development will provide necessary improvements in the area. Box 23397 Tigard, Oregon 97223 Re: Vacation of portions of Bond Park No. 3 Dear Catherine: The water district has no problems, in general, with the proposed vacation in the subject development with the one ex- ception noted below. The attached map shows the existence of a 6-inch ductile iron water main along the southwesterly lot line of Lot 58 . A 10-foot wide easement for this water line was requested from the engineers for the developer, Harris-McMonagle Associates. However, it appears that this request never materialized on either the official plat or in any other subsequent documents. This is a very important pipeline to the water district in that it will allow the district to eventually make a con- nection to a proposed main on SW Dorburn Place in the future. By copy hereof, the engineers are requested to advise if this easement was ever attained and the measures to be taken so that the water district can obtain same. As to the vacation of the portions noted in your letter it is requested that a 10-foot wide utility easement be reserved along the northwest extension of the property line of Lot 58 as shown on the attached map. Services K DEPT HEAD OK1_.1,JJq--C1TY ADMIN REQUESTED BY: Affected residents of Bond Park No. 3 POLICY ISSUE Council initiated Easement Vacation request - consistent with Council policy an adopted by Resolution No. 86-80 INFORMATION SUMMARY Waverly Construction and the property owners of lots 58-69 of Bond Park are requesting the vacation of a 6 font public utility easement which lies along the rear property-lines of lots 58-69. Council initiation of the vacation request is recommended since the vacation was m condition of approval for a lot-line adjustment within the Bond Park No. 3 subdivision. Said conditional approval being by Council and outlined in Res. 87-63 (5-18-87) . If the attached resolution in approved, the public hearing would he scheduled for 9/14/87. The City Recorder will mail notice to each property owner who would normally be required to sign a vacation petition. ALTERNATIVES CONSIDERED 1 . Approve attached Resolution calling for a public hearing on 0/14/87. 2. Take no action at this time and require property owners to circulate petition. FISCAL IMPACT 1. Fees paid by applicant.
