WHEREAS, the Tigard City Council initiated this vacation (Resolution No. 98-06) request pursuant to Section 15.08.040 of the Tigard Municipal Code at a public hearing held on February 10, 1998; and WHEREAS, in 1979, a building permit was issued for the construction of the building; and WHEREAS, in 1978, a Site Development Review (SDR 33-78) approval was granted to allow the construction of the building; and WHEREAS, in 1977, a Subdivision (S 9-77) approval was granted to allow the recordation of the "72nd Business Center"subdivision plat; and WHEREAS, a utility easement had been granted with the platting of "72nd Business Center" in 1977; and WHEREAS, a Zone Change (ZC 5-76) was granted for a general plan and program of a commercial - office park planned development; and WHEREAS, the zone change had a condition that stated the setback from SW 72nd Avenue be 40 feet with a 10 foot intrusion allowable for no more than 1/3 of the lot width, if no other feasible option is available; and WHEREAS,the 1976 zone change amended a 1974 zone change; and WHEREAS, in 1974, a Zone Change (ZC 2-74) approval was granted to change an R-7 Residential zone to an M-4 Industrial Park zone; and WHEREAS, when the building was constructed the footing of the building encroached slightly more than two (2) feet into the utility easement; and WHEREAS,the eave of the building overhangs approximately four(4) feet into the utility easement; and WHEREAS, the petitioner is requesting that the City of Tigard vacate an approximately five (5)-foot by approximately 53-foot portion of the easement which the building and overhang affects; and WHEREAS, the vacation was initiated by the City Council and approval has been recommended by the Community Development Department; and WHEREAS, all affected service providers, including utility companies and emergency service providers, have had the opportunity to review the vacation proposal and have no objections; and ORDINANCE NO.98- D is\curpin\willWacfirl2.ord Page#of 9 Will D. 9-Mar-98 4:17 PM WHEREAS, notice has been mailed to all property owners abutting said vacation area and all owners in the affected area, as required by ORS 271.080; and WHEREAS, in accordance with Tigard Municipal Code 15.08.120, the City Recorder posted notice in the area to be vacated and published notice of the public hearing; and WHEREAS,the property owners of the majority of the area affected have not objected in writing; and WHEREAS,the City Council having considered the request on March 24, 1998, finds that it is in the public interest to approve the request to vacate said public right-of-way as the public interest will not be prejudiced by this vacation, as provided be ORS 271.120 and TMC Section 15.08.130. To reiterate the problem, the building on the property, where it fronts 72nd Ave. encroaches into a, utility, storm and pedestrian easement approximately 2 feet. Coupled with the roof overhang, my eyeball guess is that there is a total encroachment Of 4 feet more or less. There are two avenues of approach. First, the City could acknowledge the encroachment. You will, though run the risk of the city deciding that they want that area covered by the encroachment at SOW.-* future date. At that time, the city could demand that the building be removed or some adjustment made for the easement. The second approach, and the one that the city recommends, is to vacate that portion of the easement encompassing the encroachment. Once. vacated, the city cannot make a claim in the future for the area;. If you take this tack, there are two ways to initiate the vacation. The first way is for the owner of the property to institute the vacation. Because bf all the notice requirements, the engineer told me that this would be a fairly lengthy process. He recommended opting for alternative number two. Alternative number two is that the city will institute the vacation, once a formal request is made, in writing, to the city. Eventhoughthis is the faster of the two, it will take between 2 to 3 months. The formal written :request should be sent to: Agustin P. Duenas, P.E. A legal description of the portion of the easement to be vacated. This should include not only the wall area, but also the roof overhang. Westlake Consultants can provide this. 2 . State that there are no existing facilities within the area to be vacated (e.g. not water, sewer, power, phone or gas lines) 3 . State that the remaining width of the easement (less the encroachment) is sufficient to meet the city's needs. 4 . Contain a formal request to vacate. In my conversations with Mr. Agustin, I got the impression that the city engineering department is favorably disposed to granting the vacation. someone from the engineering dept—has gone out already and looked at the property, and the feeling is that the city has no immediate need for that area. The final approval must be given by thb city council. But like most councils, they will rely upon the tecommendation of the city staff, unless there is some overriding policy consideration. I do not see any overriding policy issue here, but there always is an outside chance that the council might veto it. As to our extended owners title policy, I recommend that the exception for the ehcroachment remain in the policy. Once vacated, the exception can be endorsed out for a nominal fee. Thus, the sale can be consummated and the vacation completed post closing. The buyer and sell should discuss between themselves how they wish to pursue the vacation, whose responsibility it will be and any type of mechanism they wish to utilize to guarantee the follov through. Varns Street, said that the existing plan shows a pedestrian bicycle path on the east side of 72nd when the path is actually- needed on the west for children to get to school. She stated her belief that the applicant should put a path on the west side of the street where current need exists. 2. Brooks asked Mr. Puderbaugh if a path could be built cn the west aide of 72nd without obtaining additional right-3f-way. 3. Mr. Puderbaugh replied that yes according to his study a 5 to 7 foot path could be constructed without additional right-of-way. 4. Mr. Fletcher stated that this was the original proposal made for the project and sta'ed the willingness of the applicant to trove the path from the east side of 72nd and place it on the west side. 5. Tony Maxim of S.W. 72nd, stated his opposition to the project because of the impacts it would have upon the residential area. He stated that traffic would be increased and that tha ,applicant has not proven a need for the project or given any thought to rush hour traffic or the need for fire protection. Mr. Fletcher spoke in response to Mr. Maxim' s comments pointing out that a market analysis had been conducted as well as a traffic survey. 6. Mohn Parsons cne of the applicants, said that he and his partner had been looking for office , space in the Tigard area and being unable to find any had resorted to constructing their own and this project is therefore the result. The utility easement was originally dedicated with the platting of the 72nd Business Center" in 1977. A building was constructed on the lot in 1980. The footing of the building encroaches slightly more than two (2) feet into the easement with the eave overhanding approximately four (4) feet into the easement. It does not appear that utilities have been constructed within the area of the building. Petitioner is also requesting that the City of Tigard initiate vacation proceddings to vacate a five (5)-foot by approximately 53-foot portion of the easement which the building and overhang affects. The C-P (Professional Commercial) zone does not require a rear yard setback. LOCATION: A tract of land situate in the SE 1/4 of Section 1, T.2S., R.1 W.M., located within Lot 12, 72nd Business Center", Plat Book 40, Page 2, City of Tigard, Washington County, Oregon (WCTM 2S101 DB, 01000).
