AN ORDINANCE CONCERNING VACATION OF A PORTION OF PUBLIC UTILITY EASEMENTS
WITHIN KNEELAND ESTATES NO. 2, A RECORDED PLAT, IN THE CITY OF TIGARD,
WASHINGTON COUNTY, OREGON.
WHEREAS, the Tigard City Council initiated this vacation request pursuant to
Section 15.08.040 of the Tigard Municipal Code and ORS 271 . 130, and
WHEREAS, the reason and purpose for this vacation is to eliminate existing
public utility easements as they are no longer needed for public purposes, and
WHEREAS, the vacation is recommended by the Planning Commission and the
Department of Community Development; and
WHEREAS, in accordance with ORS 271 . 100, the TMC Section 15.08. 110, the
Council fixed a time and place for the public hearing and Recorder published
notice and posted notice in the area to be vacated; and
WHEREAS, notice has been mailed to all property owners abutting said vacation
area and all owners in the affected area, as described in ORS 271 .080; and
WHEREAS, the Council, having held a hearing on December 7, 1987, finds the
public interest will not be prejudiced by the vacation as provided by ORS
271 . 1.20 and TMC Section 15.08. 130; and
WHEREAS, the Council finds that it is in the public interest to approve the
request to vacate a portion of public utility easements within the subdivision
plat of Kneeland Estates No. 2; the Council finds that the owners of a
majority of the area affected, computed under ORS 271 .080, have not objected
in writing to the vacation; the Council finds that the vacation will riot
substantially affect the market value of any abutting properties; and
WHEREAS, the Council finds that the following conditions is necessary to
vacate said land:
1 . The vacation shall riot be effective until the effective date of
this ordinance, and a certified copy of this ordinance has been
recorded with the Washington County Clerk, Assessor and Surveyor.
THE CITY OF 'TIGARD ORDAINS AS FOLLOWS:
Section 1 : The Tigard City Council hereby orders the vacation of a por•L-i.on of
public utility easements within the subdivision plat of Kneeland Estates No. 2
as described and shown on the attached Exhibit "A" and by this reference made

Washington County, Oregon, the centerline of which is described as follows:
Beginning at the northwest corner of Lot 132, Kneeland Estates II, a recorded
plat, Washington County Plat Records, thence South 360 45' 46" East, 119.88
feet to the point of terminus on the northerly right—of—way line of SW 93rd
Avenue. The sidelines of said ten foot wide strip are parallel with and five
feet from said centerline and extend to the boundaries of Lots 131 and 132,

Dear Property Owner:
The Tigard City Council will hold a public hearing on Monday, December 7, 1987
at 7:30 p.m. at the Tigard Civic Center Town- Hall Room, 1312.5 S.W. Hall
Boulevard, Tigard, Oregon, to consider the proposed vacation of the
above—mentioned areas. (See enclosed location maps.) Any interested person
may appear and be heard for or against the proposed vacation of said lands.
Any written objection or remonstrance shall be filed with the City Recorder by
7:30 p.m. December 7, 1987 at Tigard City Hall at the address listed below.
The vacation requested was initiated on October 26, 1987 by the City Council
at the request of Rainier Bank of Oregon. The purpose is to return to private
ownership an easement which is no longer needed for utilities as currently
aligned. The legal descriptions of the parcels to be vacated is also attached
for your information.

A RESOLUTION CONCERNING THE VACATION OF PUBLIC UTILITY EASEMENTS WITHIN LOTS
131 AND 182^ K0EELAND ESTATES NO. 2^ A RECORDED PLAT, IN THE CITY OF TIGARD'
WASHINGTON COUNTY, OREGON.
WHEREAS' a vacation request has been received and filed with the City Recorder
for vacation of public utility easements; and
WHEREAS' This portion of land was previously granted for public utility
purposes, it has been determined to not be needed by the City for this purpose
in its cur-rent alignment; and
WHEREAS' the Tigard City Council finds it necessary and desirable to initiate
vacation proceedings for said parcel .
NOW, THEREFORE, -BE IT RESOLVED by the Tigard City Council that:
1 . That the Tigard City council initiates the vacation request with the
understanding that those property owners who would normally sign a
petition shall be notified by mail of the proceedings.
2. That a public hearing is hereby called to be held by the City Council on
Monday, December 7, 1987^ at 7:30 PM at the Tigard Civic Center Town Hall
Room, 13125 SW Hall Boulevard, within the City of Tigard, at which time
and place the Council shall hear any objections thereto, and any
interested person may appear and be heard for or against the proposed
vacating of said lands.
3 . That the City Recorder be, and she is hereby, authorized and directed to
cause to have published in the Tigard Times, a newspaper of general
circulation in the City of Tigard hereby designated for such purpose, a
notice of said hearing in the form hereto attached and by this reference
made a part hereof' the first publication to be November 5' 1987 and once
each week thereafter for five pu6linhings in all.
The Recorder be, and she is hereby, further directed to cause to have
posted within five (6) days after the date of first publication, a copy
of said notice in the form attached, at or near each end of the area
proposed to be vacated.
4. That the particular portion of granted public street utility easements
proposed to he vacated is described on the attached sheet headed Exhibit
"A" and by reference made a part thereof.

A RESOLUTION CONCERNING THE VACATION OF PUBLIC UTILITY EASEMENTS WITHIN LOTS
131 AND 132, KNEELAND ESTATES NO. 2, .A RECORDED PLAT, IN THE CITY OF TIGARD,
WASHINGTON COUNTY, OREGON.
WHEREAS, a vacation request has been received and filed with the City Recorder
for vacation of public utility easements; and
WHEREAS, This portion of .land was previously granted for public utility
purposes, it has been determined to not be needed by the City for this purpose
in its current alignment; and
WHEREAS, the Tigard City Council finds it necessary and desirable to initiate
vacation proceedings for said parcel.
NOW, THEREFORE, --BE-IT RESOLVED by the Tigard City Council that:
1. That the Tigard City council initiates the vacation request with the
understanding that those property owners who would normally sign a
petition shall be notified by mail of the proceedings.
2. That a public hearing is hereby called to be held by the City Council on
Monday, December 7; 1987, at 7:30 PM at the Tigard Civic Center Town Hall
Room, 13125 SW Hall Boulevard, within the City of Tigard, at which time
and place the Council shall hear any objections thereto, and any

INFORMATION SUMMARY
On October 26, 1987 Council passed a resolution to call for a public hearing
on a Council—initiated vacation request to be held at 7:30 PM on December 7,
1987. The vacation is being processed by the City at the request of Rainier
Bank of Oregon. The purpose of the vacation is to eliminate a public utility
easement that is no longer needed for public purposes. The Department of
Community Development and Planning Commission are recommending approval. The
hearing was published in the Tigard Times according to City and State
requirements and all abutting and affected property owners have been notified
by mail.
ALTERNATIVES CONSIDERED
1 . Approve vacation request as shown.
2. Approve vacation request with amendments.
3 . Request staff to prepare resolution denying proposed vacation based or)
objections and remonstrances received during the public hearing.
FISCAL IMPACT

SUBJECT: Community Development Department Report for Proposed Vacation of
Certain Public Utility Easements within Kneeland Estates No. 2
BACKGROUND
All public utility easements within the subdivision plat of Kneeland Estates
No. 2 were dedicated for public use with the recording of the plat in July
1981 . Typically, utility easements are dedicated along certain lot lines
within subdivision plats to facilitate power, water, gas, phone and other
utilities. Such was the case with the plat of Kneeland Estates No. 2.
Last- year, Ranier Bank of Oregon received approval to adjust lot lines within
the plat and requested that certain existing public utility easements be
vacated. On October 31, 1986 this vacation request was approved by City
Council . Subsequently Ranier Bank of Oregon is requesting that an additional
easement be vacated that was overlooked with the original request. On October
26, 1987, Council called for a public hearing to hear this additional request.
FINDINGS
Planning Commission
The Planning Commission considered this vacation request at their• November 10,
1987 regular meeting and unanimously recommended approval (see attached memo
from the Planning Division) .
Traffic, Pedestrian and Bicycle Circulation
Given the nature of the easement (public utilities), traffic, pedestrian and
bicycle circulation are riot impacted. Facilities related to the above items
have either been provided by the Kneeland Estates development or will be
provided by future developments.
Fire and Police Services
A response was received from the Police Department and they recommended
approval . No response was received from the Fire District.

Drainage and Sanitary Sewer
Both drainage and sanitary sewer• services in the area are provided either by
the Kneeland Estates developments or will be provided by future developments.
This particular utility easement is not required to facilitate both current
and future development.
Other Utilities
Northwest Natural Gas and the Tigard Water District responde3 and had no
objection to the vacation. The following other utility prov .ders did not
respond:
Willamette Cable
General Telephone
Portland General Electric
Transportation and Capital Improvements Plans
Given the nature and location of the easement, the Transportation and Capital
Improvements Plans are not impacted. It is anticipated that future
development will provide those public improvements not already in place.
I have noted above that certain agencies did not respond to our request for
comments. I will -attempt to contact each of these and report on their
response at the Hearing.
RECOMMENDATION
Staff recommends that the proposed vacation of certain public utility
easements within the subdivision of Kneeland Estates No. 2 be approved subject
only to the necessary certification and recordation with Washington County.

WASHINGTON COUNTY, OREGON.
WHEREAS, the Tigard City Council initiated this vacation request pursuant to
Section 15.08.040 of the Tigard Municipal Code and ORS 271 . 130^ and
WHEREAS, the reason and purpose for this vacation in to eliminate existing
public utility easements as they are no longer needed for public purposes, and
WHEREAS, the vacation is recommended by the Planning Commission and the
Department of Community Development; and
WHEREAS, in accordance with ORS 271 . 100^ the TMC Section 15.08.110, the
Council fixed a time and place for the public hearing and Recorder published
notice and posted notice in the area to be vacated; and
WHEREAS' notice has been mailed to all property owners abutting said vacation
area and all owners in the affected area, an described in ORS 271.080; and
WHEREAS, the Council' having held a hearing on December 7' 1987^ finds the
public interest will not be prejudiced by the vacation as provided by ORS
271 . 120 and TMC Section 15.08. 180; and
WHEREAS, the Council finds that it is in the public interest to approve the
request to vacate a portion of public utility easements within the subdivision
plat of Kneeland Estates No. 2; the Council finds that the owners of a
majority of the area affected, computed under ORS 271 .080^ have not objected
in writing to the vacation; the Council finds that the vacation will not
substantially affect the market value of any abutting properties; and
WHEREAS, the Council finds that the following conditions is necessary to
vacate said land:
1 . The vacation shall not be effective until the effective date of
this ordinance, and a certified copy of this ordinance has been
recorded with the Washington County Clerk' Assessor and Surveyor.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Tigard City Council hereby orders the vacation of a portion of
public utility easements within the subdivision plat of Kneeland Estates No. 2
as described and shown on the attached Exhibit "A" and by this reference made
part hereof.

Dear Randy:
As we have discussed, there is a utility easement still existing
along both sides of the now obsolete lot line between old
lots 132 & 131 Kneeland Estates II. Vacation of this easement
was over looked when the lot line adjustments were done.
Further, .new 5' utility easements were granted along both sides
of all new lot lines at the time the lot line adjustments were
done.
We, therefore request a vocation of the old easement along the
old lot line and agree to bear the cost of such a vgcation.
However, we would ask for the City's consideration in assessing
the costs if that is possible. As we have discussed, this is an
unfortunate situation where it is in everyones best interest
to accomplish the vgcation, but we must work through the
bureaucratic system to accomplish our goals since this is public
property.
The easement we request to be vacated can be described as
that certain parcel of land being 10.00 feet in width and 119.88
feet in length running parallel to and extending 5.00 feet on
either side of lots 132 & 131, common lot line in Kneeland
Estates Il, in City of Tigard, County of Washington, State of
Oregon. The easement should be granted on the basis that
no utilities now exist within the easement; new easements have
been granted along the new, adjusted lot lines; with the
easement as it now is, the lot has no practical ingress and
egress or building pad.
As indicated in our conversation, this lot was sold and ready
to close, currently we are still working with our buyers trying
to hold them. Please allow me to do any leg work which could
speed up the process.

In reply to your letter of February 6 , 1986 , Kneeland Estates No . 2 .
I would like to explain our position . General Telephone can not
release interest on utility easements on said subdivision until
it has been contacted in writing by the developer .
Because we are a regulated industry and are not permitted to use
subscriber ' s revenue to subsidize private development , we are re-
quired to have a written assurance from the developer stating that :
1 . ) He will grant recorded easements .
2 . ) That he will bear the cost of trenching .
3 . ) That he will provide the trench .
4 . ) That he will notify the Telephone Company at least three weeks
prior to opening the trench , so that materials can be ordered
and labor can be scheduled .
Upon receipt of his letter meeting the above requirements , I will
issue a letter of Release of Interest on the existing easements .
General Telephone will remove or abandon the existing plant and
place the new cable at no cost to the developer .

Dear Mr. Olsen:
I am writing you in accordance with your letter to my engineer, Russell
A. Lawrence, regarding the above named subdivision.
As the developer/applicant for this project, Lincoln Savings and Loan
will :
1. Grant-necessary easements as needed for telephone utilities, as
long as they are reasonably placed near property lines.
2. Bear the cost of the trenching and provide the trench.
3. Give at least 3 weeks notice as to when the material will be
needed and coordinate the scheduling with your office.
I would also like to meet with you or some of your people on the site
to' determine which of the existing lines are salvageable, because I 'm
sure some will be. Please call at your earliest convenience as we are
anxious to complete this project.
