WHEREAS, the Tigard City Council initiated this vacation request pursuant to Section 15.08 .840 of the Tigard Municipal Code; and WHEREAS, the reason and purpose for this vacation is to return a portion of SW 130th Avenue to private ownership for development purposes; and WHEREAS, the vacation in recommended by the Planning Commission and the Department of Community Development; and WHEREAS, in accordance with ORS 271 , 100, the TMC Section 15.08.110, the Council fixed a time and place for the public hearing and the Recorder published notice and posted notice in the area to be vacated; and WHEREAS' notice has been mailed to all property owners abutting said vacation area and all owners in the affected area, as described in ORS 271 .080; and WHEREAS, the Council, having held a hearing on May 4, 1987, finds the public interest will not be prejudiced by the vacation as provided by ORS 271 . 120 and TMC Suction 15.08. 130; and WHEREAS, the Council finds that it is in the public interest to approve the request to vacate a portion of S.W. 130th Avenue right—of—way because the public interest will not be prejudiced; and WHEREAS, the Council finds that the following condition in necessary to vacate said land: 1. The vacation shall not be effective until the effective date of this ordinance, and a certified copy of this ordinance has been recorded with the Washington County Clerk, Assessor, and Surveyor. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1 : The Tigard City Council hereby orders the vacation of a portion of S.W. 130th Avenue as described and shown on the attached Exhibit "A'', and by this reference made part horenf. Section 2: The Tigard City Council further orders that the vacation be subject to the following condition: 1 . After the hearing, the Council voted unanimously to adopt Ordinance No. 87-19 which orders the vacation. This vacation will become effective after it has been filed with the County Cleric, Assessor and Surveyor (but in no event effective until the 31st day after its enactment). A copy of Ordinance No. 87-19 is enclosed. We are prepared to forward this ordinance to the County for recording on June 5, 1987 once we have recovered the costs for processing this vacation request. The expenses incurred by the City for this vacation request amount to $321-71. This includes fees for legal advertising, staff time, posting requirements and filing fees. A detailed itemization of the costs are in the Recorder's file at City Hall should you want to review them. We would appreciate receiving reimbursement for $321.71 as soon as possible. Consideration by Council . o Councilor Schwartz commented he had not heard anything which changed his opinion since the last meeting. He said the one bike path off of Chelsea Loop is adequate. Councilor Schwartz said that an Ash Street access with parking would be more appropriate for the area. He said the Chelsea I access should be formally acknowledged and accepted by the City . o Councilor Johnson agreed the pathway in Chelsea I should be formally accepted and asked this information be relayed to the Park Board. Councilor Johnson said she is in favor of the easement between the two lots for the access. o Mayor Brian said he, too, would support the development of an Ash Street access . He said he had recently visited residents in the Summerlake Park area and at Pick' s Landing; these people have not had problems because the auneon abuts their property. Mayor said this is a planning decision, not a funding decision as the access will be at no cost to the taxpayers; the project developer will be paying for the access. Mayor said he favors the proposal. f. RESOLUTION No. 87-45 A FINAL ORDER TO MODIFY AND AMEND THE FINAL SUBDIVISION PLAT FOR CHELSEA HILLS (S 7-84) TO PROVIDE PEDESTRIAN ACCESS TO FA0K0 CREEK PARK BETWEEN LOTS 53 AND 54. g. Motion by Councilor Johnson, seconded by Councilor Schwartz, to approve Resolution No. 87-45. Approved by a vote of 2-1 of Council present; Councilor Schwartz voted "Nay." h. Consensus of Council was to direct staff to request the Park Board review a possible Ash Street park entrance with parking and to also review the Chelsea I entrance pathway for formal acceptance. 0. PUBLIC HEARING — 130TH AVENUE STREET VACATION a. Public Hearing Opened (continued from April 27, 1087) . b. Community Development Director summarized. Krueger Development Company received preliminary plat approval in July 1086 to develop an 80—lot subdivision (Ari Green) adjoining this portion . of S.W. 130th Avenue. Conditions of approval, include the vacation of this unimproved right—of—way. Any objections or concerns filed by the utility companies have been addressed in the conditions attached to the ordinance, Planning Commission and the Department of Community Development have recommended approval . The hearing was published in the Tigard Times according to City and State requirements . All abutting and affected property owners have been notified by mail— Page 5 — COUNCIL MINUTES — MAY 4' 1087 Community Development Director said this is a strip of land approximately 10 feet wide by 660 feet long. This is adjacent to a 40-foot strip of land which was originally shown an a right..-of-way for the possible continuation for S.W. 130th (this is not included in this right-of-way vacation request) . There is a problem, however, in the identifying ownership in that portion of 128th. The Washington County Taxation office shows this 40 foot strip as "unknown ownership." Community Development Director advised the County will probably put this property up for sale after foreclosure- proceedings. Staff evaluated the application to determine if the City needed the right-of-way for any public purpose. On the Transportation Plan, adopted in 1983, S.W. 180th will come 6mun from Schollw Ferry Road and connect to 128th at Katherine Street. If S.W. 130th were to continue on its present straight direction, it would not be able to acoaun Katherine Street. A name change for S.W. 130th would be necessary; it in not developed at this time. C. Public Testimony - there was no one signed up to testify. d. There was considerable discussion on future Transportation Plan recommendations for this area. Councilor Schwartz questioned the Subdivision Plan for Phase 2 of the Ari Green Subdivision. Community Development Director left the meeting to get a copy of the Subdivision Plan. (Public Hearing was recessed at 0:46 p.m. ; Items 7 through 8. 1 were considered .and then the Public Hearing was reconvened at 9:61 p.m.) Councilor Johnson said the City should not allow vacation of the entire S.W. 130th Avenue right-of-way without looking more closely at the transportation issue in this area. Councilor Schwartz asked when the County forecloses on the remainder of the land (the 40` referred to earlier) will the Council have an opportunity to review this? Community Development Director advised the County will ask if there is any public use for this land by the City. City Attorney advised if the City determines there is a public use, the County may have the jurisdictional right to transfer this land without substantial contribution. Council consensus was they would like to review the disposition of the 40 feet mentioned above. e. Unless otherwise noted' the vacation requests are for street right-of-ways only at this time. Bishop:Ash Avenue - JB On 4/11/85 a prepetition conference was held. J8 was instructed to have McKenzie Engineering file a good map with the City along with JB'a "Intent To Vacate" request. This is on hold for action by J8 Bishop. Jolly :Cherry Street (7410) - Wayne & Joyce 3/15/85 prepetition conference was held. on 4/25/85 1 contacted Mo. Jolly and was advised they would contact the City when they were ready to begin the process. On 5/20/85 Ms. Jolly requested a letter from the City noting the responsibility of maintenance for public improvements within m vacated area. On 6/4/85 Randy Clarnn responded to her request in writing. Dartmouth Area Vacation - Mozinski - Robert Randall : On 1/18/85 a prepetition conference was held. On 2/15/85 Mr. Mozinski advised me that during, or after' the Dartmouth Street LID process, he would again contact staff to proceed with request. - Cach:66th and Atlanta - Jerry No prepetition conference has been held, Jerry Cach is interested in vacation of a portion of right-of-way in this area. Prepetition conference will be scheduled in the near future. : No formal prepetition conference has been held. Jerry Cach advised staff in January (1/14/85) of Don Pmllock's interest in this area. Cach was advised that staff would discuss with Planning Commission and NPO #4 and contact him with staff's recommendation for possible vacations in the area. Prepetition conference would then be scheduled with Pollock & Cach. Issue presented to NPO #4 on 6/5/85 by Keith. 116th & Katherine - Dale : On 2/15/85 prepetition conference was held. On 4/25/85 Mr. Ott was contacted and advised that he is still interested but would not have time to persue this issue until fall. This vacation would include right-of-way and easements. Ward:130th Avenue - Russ Krueger/Susan On 1/18/85 prepetition conference was held. Russ Krueger will work with Washington County to determine how to proceed. This request will allow the area to 6e used for development of Ari Green No, 2 Subdivision. Council initiation of the vacation request is recommended since the vacation was a condition of approval for the preliminary plat of Ari Green No. 2. Mr. Russ Kreuger would be responsible for all foes associated with the coat of the vacation process . If the attached resolution is approved' the public hearing would be scheduled for 4/27/87.
