WHEREAS, the City recently completed a capital improvement, in conjunction with the Mara Woods subdivision development, known as the SW 79th Avenue/SW Bonita Road intersection realignment project; and WHEREAS, it appears that a portion of the SW 79th Avenue right-of-way is no lunger needed for public purposes as a result of said realignment project; and WHEREAS, a vacation request was received and filed with the City Recorder; and WHEREAS, the reason and purpose for this, vacation is to return a portion of the SW 79th Avenue right--of-way to private ownership; and WHEREAS, the vacation is - recommended by the Planning Commission and the Department of Community Development; and WHEREAS, in accordance with ORS 271 . 180, the TMC Section 15.08. 110, the Council fixed a time and place for the public hearing and the Recorder published notice and posted notice in the area to be vacated; and WHEREAS, notice has been mailed to all property owners abutting said vacation area and all owners in the affected area, as described in ORS 271 .080; and WHEREAS, the Council, having held a hearing on July 25^ 1988^ finds the public interest will not 6e prejudiced by the vacation as provided by ORS 271 .120 and TMC Section 15.08.130; and WHEREAS, the Council finds that the following conditions are necessary to vacate said land: 1. That a general public utility easement be retained over a portion of the area to be vacated to accommodate existing and future public utilities. Said easement area being described in the attached Exhibit "B." 2. The vacation shall not he effective until the effective date of this Ordinance, and a certified copy of this Ordinance has been recorded with the Washington County Clerk, Assessor, and Surveyor. It appears that a portion of the original street right—of—way is no longer needed for public purposes as a result of this recent realignment. Vacation of this public right—of—way would return the ownership to adjoining properties . Attached in a report prepared by staff which includes more information on the background, findings and recommendations. ALTERNATIVES CONSIDERED 1. Approve the attached ordinance which vacates a portion of SW 79th Avenue and reserves a public utility easement over m `pwrtion of the vacation area. 2. Request staff to prepare a resolution denying the proposed vacation which may be based on objections and remonstrances received during the public hearing. FISCAL IMPACT All fees and staff time will he paid by the City as cost associated with the realignment project. BACKGROUND In June of 1087 the City completed a capital improvement known as the SW 79th Avenue/Bonita Road intersection realignment. This project was done in conjunction with the Mara Woods subdivision development. A portion of the original SW 70th Avenue right-of-way appears to be no longer needed for public purposes as a result of this realignment project. FINDINGS Plannina_qornmis�Lion Recommendation The Planning Commission is required to make a recommendation an provided by TMC 15.00,090. On July 5, 1080 the Commission reviewed this request and recommended that it bu^ approved. ansportation and Capital Improvement Plans This vacation proposal does not conflict with either the 'Transportation Plan or Capital Improvement Plan. SW 79th Avenue is classified as a minor collector street and has been preserved as such in its new alignment. The realignment and improvement of this portion of SW 70th Avenue was completed as part of the Capital Improvement Program for FY 87-88. gity Utilities (drainage and sewer) Currently there are no City utilities located within the area proposed for vacation. The Engineering Division has reviewed the proposal and sees no need to retain any easements for future drainage and sewer improvements. Other Utilities Responses to the proposed vacation were received from the following other utility providers : Portland General Electric Northwest Natural Gas General Telephone Co. Tigard Water District Willamette Cable Co. Memo to Mayor and Council Page 2 July 14, 1988 Portland General Electric, General Telephone Co. , Tigard Water District and Willamette Cable have all indicated that they have facilities along the easterly portion of the area to be vacated. Staff is recommending that a general public utility easement be retained over this easterly portion to accommodate these utilities. Thio easement has buen incorporated into the ordinance presented for your approval. Fire and Police Services Both the Fire District and Police Department have reviewed the proposal and have no concerns with the vacation. TITLE TO VACATED LANDS Although determining title to vacated lands is a function of Washington County, it in my opinion, given statutory guidelines, that title to the proposed vacated lmmjo will go evenly to proper-ties on both the east and west sides of SW 79th Avenue. RECOMMENDATION Staff recommends that the proposed vacation be approved with the condition that a public utility easement be retained over a portion of the area to be vacated.
