ORDINANCE NO, 85--
AN ORDINANCE VACATING A 20 FOOT PORI-ION OF SW 70TH AVENUE AT HAMPTON STREET
AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the Tigard City Council initiated this vacation request pursuant to
Section 15.08.040 of the Tigard Municipal Code; and
WHEREAS, the reason and purpose for this vacation is to return a 20 foot
parcel along SW 70th Avenue at the intersection of SW Hampton Street, to Lot
17 of Beveland No. 2 Subdivision, for use as parking and landscaping to
accomodate a new building on said lot,
WHEREAS, the vacation is recommended by the Planning Commission; and
WHEREAS, in accordance with ORS 271 . 100, and TMC Section 15.08. 110, the
Council fixed a time and place for the public hearing and the Recorder
published notice and posted notice in the area to be vacated; and
WHEREAS, notice has been mailed to all. property owners abutting said vacation
area and all owners in the affected area, as described in ORS 271.080; and
WHEREAS, the Council, having held a hearing on June 17, 1.985, finds no
objections were made or filed hereto as provided by ORS 271 . 120 and TMC
Section 15.08 , 130; and
WHEREAS, the Council finds that it is in the public interest to approve the
petition to vacate a 20 foot strip on SW 70th Avenue at SW Hampton Street
because no objections or remonstrances were filed by abutting or affected
property owners or by utility providers and other interested parties; and
WHEREAS, the Council. finds that the following condition is necessary to vacate
said land: this vacation shall not be effective until the effective date of
this ordinance and it shall not be effective until a certified copy of this
ordinance has been recorded with the Washington County clerk, assessor and
surveyor.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Tigard City Council hereby orders the vacation of that portion
of SW 70th Avenue as described as follows: "That portion of SW 70th Avenue,
being 20 feet wide_ and 154.42 feet long, and abutting lot 17 of Beveland No. 2
Subdivision. Said lot is on the corner of SW 70th Avenue and SW Hampton
Street in Tigard, Oregon. "
Section 2: The Tigard City Council further orders that the vacation be
subject to the following condition: "This vacation shall not be effective
until the effective date of this ordinance and it shall. not be effective until

a. Tom Cornilles, 10905 SW Tigard Street, presented a petition and
letter requesting waiver of appeal fee opposing the extension of
108th Avenue as approved in the Director' s Decision MLP 8-85.
b. After lengthy discussion, Councilor Brian moved to conditionally
waive the appeal fee until staff can furnish Council wish further
facts in the matter at the 6-24-85 meeting. Motion seconded by
Councilor Edin.
Approved by unanimous vote of Council present.
4. PUBLIC HEARING - 70TH & HAMPTON STREET VACATION
a. Public Hearing Opened
b. Deputy Recorder synopsized request noting utility companies were
notified of the request.
C. Public Testimony:
o Fred Schriever, petitioner, requested approval and noted area
would be used for parking and landscaping for development on his
lot.
o Geraldine Ball, NPO #4 Chairman, stated the NPO recommended
approval of the request.
d . Deputy Recorder stated Planning Commission, the City Engineer, and
staff recommended approval.

g. Motion by Councilor Edin, seconded by Councilor Brian to approve.
Approved by unanimous vote of Council present.
5. 1984-85 AUDIT AGREEMENT
a, Finance Director presented the Certificate of Conformance which
the City was awarded. She introduced Mr. John Dethman from
Coopers and Lybrand.
b. Mr. Dethman noted the agreement terms for the 84--85 audit by his
firm. Fie discussed ways in which more information could be given
to Council. during the audit process.
C. Councilor Edin, Finance and Audit Representative for Council,
stated that the Council hasn't given a forum to Coopers and
Lybrand in the past for informal information sharing. This year
he will be discussing issues relating to the audit with Mr.
Dethman and then reporting back to the Council those items which '
are of most concern,
d. City Administrator noted staff' s support of this process and
recommended approval of the audit agreement.
e. Motion by Councilor Brian, seconded by Councilor Edin to approve
an agreement with Coopers & Lybrand for the 1984-85 audit with a
cost not to exceed $15,700.
Approved by unanimous vote of Council present.
6. PERFORMANCE AUDITING DISCUSSION
a. Finance Director presented information received from Price
Waterhouse and Pacific F_conomica, Inc, regarding rate studies for
waste water for the City . She stated the end product of the study
should be an ordinance or resolution which sets out the criteria
for rate making.
b. City Administrator stated there is $10,000 in the 85-86 budget for
a performance audit. He discussed time frames, citizens
committee, and the development of the scope of the project for the
committee and the consultant' s responsibilities.
C. After lengthy discussion, Councilor Brian noted concerns regarding
the study and wished to discuss this issue at a later date.
d. Consensus of Council was to bring item back at 6/24/85 meeting for
further consideration and directed staff to prepare information
outlining the committee and consultant' s scope of the
project/study and a problem statement.

Council has already yet policy for initiating vacation requests, and the ORS
and TMC yet out requirements to hear and either approve or disapprove requests.
INFORMATION SUMMARY
Mr. Frederick Schriever contacted the City in December, 1984 and requested
vacation of a 20 foot parcel of right-of-way along SW 70th Avenue. Staff
investigated the request and found no reason to strip the request. Utility
companies and other jurisdictions offered no concerns regarding the proposed
vacation within the 20 foot parcel . Mr. Schriever has paid all fees and
charges for this vacation request. City Council adopted Resolution No. 85-20
on May 13' 1085 initiating the request and calling for a public hearing to be
held on June 17' 1085 at 7:30 PM. Staff published this item in the Tigard
Times and notified all abutting and affected property owners by mail The
Planning Commission and City Engineer recommend approval with the following
condition: this vacation should not be effective until the 31st day after the
hearing and it shall not be effective until a certified copy of the vacation
ordinance has been recorded with the Washington County clerk, assessor and
surveyor.
ALTERNATIVES CONSIDERED
1. Adopt the ordinance approving the vacation request.
2. Request staff to prepare resolution denying proposed vacation based on
objections and remonstrances received during the public hearing.
SUGGESTED ACTION
Staff would recommend adoption of the attached ordinance if no objections or
remonstrances are received during the public hearing.

On June 4, 1985, the Planning Commission met and reviewed the above mentioned
Street Vacation.
Commissioner Peterson moved and Commissioner Campbell seconded to forward the
proposal to City Council with a recommendation for approval. Motion passed
unanimously by Commissioners present. Commissioners Fyre and Bergmann were
absent.

Vacation Status Report
June 6, 1985
The following vacation requests are currently active and need further staff
consideration/action at this time.
Tigard Street - Gregory Mull - City Request: On 4/24/85 Randy Clarno
requested a vacation of 10 feet right-of-way for 2S1 2BA lot 600. City
requested 20 feet be dedicated by the Mull's (see Street Dedication recorded
2/14/85 #85005502) . Only 10 feet is needed by the City. On 5/13/85 I sent a
letter to utility companies. Attached is a list of the comments .
Walnut Place/99W - Tom Brian (for Bob Hudson Family) : On 1/14/85 staff
requested Council approve initiation of street vacation. Council indicated
their desire to initiate request. On 1/25/85 prepetition conference was held
with Bob Hudson. Bob passed away 1/27/85. In April, Tom Brian was contacted
and he indicated that the family wished to continue with the vacation
request. Tom furnished a list of surrounding property owners during a Council
meeting, however, I've misplaced that list. A letter was sent to utility
companies and comments are attached, $50.00 was deposited on 1/25/85.
6.7th & Clinton - Jerry Cach: On 1/18/85 prepetition conference held with
Jerry Cach. Cach was requested to get ownership records on right-of-way. On
1/30/85, Randy Clarno and I met again with Jerry and discussed how to get
requested information. On 4/25/85, I contacted Jerry Cach regarding status
and he reported Fred Cooper (Cooper and Associates) is developing map and
legal description for proposed vacation. Randy Clarno has received this
information. 5/13/85 letter sent to utility companies and report is attached.
70th & Hampton - Fred Schriever: On 12/18/84 prepetition conference was
held. 12/20/84 utility letters were mailed. During January followup was
accomplished with utility companies, there were no concerns voiced for the 20
foot strip. On 3/5/85, Fred and I discussed how to proceed. Frank Currie
prepared petition and necessary papers. These were on my desk for mailing
during 6 week illness absence. On 4/25/85 Schriever, Clarno and I decided to
request Council initiation due to time lag on staff' s response with petition.
On 5/13/85 Council called hearing for 6/17/85. On 5/16/85 property owners
notified by mail, public notice first appeared in Tigard Times, and request
sent to Bill Monahan & Frank Currie for staff reports for hearing. On 5/21/85
area posted by Bob Thompson. On 5/30/85 Council packet information and
ordinance were prepared by me with copies to Bill and Frank. To date $347.98
has been received with $181 .56 remaining on account.
74th Avenue Near Cherry - Alan J. Fox: On 3/15/85 prepetition conference was
held with Mr. Fox. Frank Currie prepared papers for Mr. Fox to complete for
vacation. Mr. Fox filed circulated petition on May 1, 1985. I advised Mr.
Fox that process was not completed for petition circulation and discussed with
him and Randy Clarno how to proceed. Utility companies were notified 5/13/85
regarding vacation request. See attached. On 5/1/85 $400.00 was received.
122nd Avenue Near Greenway - Bob Johnson: On 12/1/84 Mr. Johnson attempted to
file a vacation petition with staff. On 2/13/85 Mr. Johnson filed old
petitions with staff and requested assistance in working out issue. Staff has
discussed what portion of street should be vacated and has found errors in
information circulated with petition. On 5/13/85 letter was sent to utility
companies . See attached report. $250.00 was received on 2/14/85.

Dear Property Owner:
The Tigard City Council will hold a public hearing on Monday, June 17, 1985 at
7:30 P.M. at Fowler Junior High School Lecture Room, 10865 SW Walnut Street,
Tigard, Oregon to consider the proposed vacation of a 20 foot strip of SW 70th
Avenue right-of-way at SW Hampton Street. (See enclosed location map.) Any
interested person may appear and be heard for or against the proposed vacation
of said lands. Any written objection or remonstrance shall be filed with the
City Recorder by June 12, 1985 at 3:00 P.M. at Tigard City Hall, 12755 SW Ash
Avenue, PO Box 23397, Tigard, Oregon, 97223.
The vacation request was initiated on May 13, 1985 by the Tigard City Council
at the request of Elm Street Investments (Mr. Frederick H. Schriever) to
accommodate new site work planned for tax lot 1100. The legal description of
the parcel to be vacated is described as follows:
That portion of SW 70th Avenue, being 20 feet wide and 154.42 feet long,
and abutting lot 17 of Beveland No. 2 Subdivision. Said lot is on the
corner of SW 70th Avenue and SW Hampton Street in Tigard, Oregon.

Dear Mr. Schriever:
Per our recent conversation, I will be requesting the Tigard City Council to
initiate a vacation for the above referenced area, due to delays caused by
staff illness in your process. The public hearing would be set for June 17th
if Council choses to initiate on May 13, 1985. Before the first ad can be
placed in the newspaper (5/16/85), I am required to have the proper fees paid
and a list of names and addresses of property owners abutting and affected by
the proposed vacation.
Attached is a current list of your bill with the City to date for this
proposal. Also enclosed is a list of tax lot and map numbers which you need
to supply names and addresses of the property owners. Normally, any title
insurance company can supply this information to you at very little cost. The
check and address list must be received by 5/14/85 at 3:00 P.M.

We are presently designing a new office building

The proposed vacation does conflict with an existing 12-inch
cast iron main which is a major transmission line from the Baylor
Street reservoirs, located at I--5 and Haines overpass. The location
of this main is shown in red on the attached drawing.

It is requested that provisions of vacation include the water
district' s right to continue utilizing this area. Better yet, it
is recommended that that portion shown in yellow on the attached
drawing be excluded from the proposed street vacation.

is not located within the boundaries of Washington County Fire District No. 1,
and therefore it does not seem appropriate for us to take a stand either for or
against the proposal .
On the other hand, we are of course interested in any such action which may be
proposed for that portion of Tigard which is located within Washington County
Fire District No. 1. I trust you will continue to keep us informed regarding
any such issue.
