ORDINANCE N0, 85-
AN ORDINANCE VACATING A PORTION OF SW WALNUT PLACE NEAR PACIFIC HIGHWAY AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the Tigard City Council initiated this vacation request pursuant to
Section 15.08.040 of the Tigard Municipal Code; and
WHEREAS, the reason and purpose for this vacation is to return this parcel
algng SW Walnut Place near Pacific Highway to the property owners to

t�IHhf7AS/, in accordance with ORS 271. 100, and TMC Section 15.08. 110, the

,pi5�li.shed notice and posted notice in the area to be vacated; and
WHEREAS, notice has been mailed to all property owners abutting said vacation
area and all owners in the affected area, as described in ORS 271.080; and
WHEREAS, the Council, having held a hearing on September 23, 1985, finds the
public interest will not be prejudiced by the vacation as provided by ORS
271 .120 and TMC Section 15.08. 130; and
WHEREAS, the Council finds that it is in the public interest to approve the
request to vacate a parcel of land on SW Walnut Place near Pacific Highway
because the public interest will. not be prejudiced for vacation of
transportation right-of--+gay; and
WHEREAS, the Council. finds that the following conditions are necessary to
vacate said land:
o Access be prohibited on the west side of SW Walnut Place the entire
length of the vacated area.
o Sidewalk be completed to City standards along the southeasterly side
of Pacific Highway along the Pull length of Tax Lot 1900 on Tax Map
2S1 2BD and the vacated portion of SW Walnut Place right-of-way with
the cost being shared between the City of Tigard and the owners of
Tax lot 1.900. Under no circumstances shall the cost to the City of
Tigard exceed $1000.00. This improvement shall be completed prior
to this vacation being effective.
o The Street Vacation should be granted for transportation
right-of-way purposes, however, a public easement for utility
purposes shall be retained over the entire area.
o This vacation for transportation right-of--way purposes shall not be
effective until the effective date of this ordinance and it shall be
not effective until a certified copy of this ordinance has been
recorded with the Washington County clerk: assessor and surveyor.

THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Tigard City Council hereby orders the vacation for
transportation right-of-way purposes of that portion of SW Walnut Place near
Pacific Highway as described on the attached Exhibit "A" and shown on the
attached Exhibit "B", and by this reference made parts hereof.
Section 2: The Tigard City Council further orders that the transportation
right-of-way vacation be subject to the following conditions:
o Access be prohibited on the west side of SW Walnut Place the entire
length of the vacated area.
o Sidewalk be completed to City standards along the southeasterly side
of Pacific Highway along the full length of Tax Lot 1900 on Tax Map
2S1 2B0 and the vacated portion of SW Walnut Place right-of-way with
the cost being shared between the City of Tigard and the owners of
Tax lot 1900. Under no circumstances shall the cost to the City of
Tigard exceed $1000.00. This improvement shall be completed prior
to this vacation being effective.

a. Councilor Scott moved to elect Councilor Edin to serve as the
Council Chairman until President Brian arrived. Motion seconded

SW TIGARD STREET NEAR GRANT AVENUE AND DECLARING

a. Motion by Councilor Edin, seconded by Councilor Edwards to approve.
Approved by unanimous vote of Council. present.
5. ORDINANCE NO. 85-34 AN ORDINANCE VACATING A PORTION OF SW WALNUT
PLACE NEAR PACIFIC HIGHWAY AND DECLARING AN
EFFECTIVE DATE.
a. President. Brian rioted a potential conflict of interest and stated
he would not be voting in this matter.
b. Lengthy discussion followed regarding the issue of sidewalk
improvements needed along Pacific Highway in front of Tax Lot 1900
and the vacation area. President Brian noted the property owners
willingness to participate in funding the improvement now as a
condition of the vacation if the City paid for the area in front
of the vacation portion of land . Council consensus was to pay no
more than x;1.000 for the improvement from SDC funds .
C. Motion by Councilor Edin, seconded by Councilor Scott to adopt
Ordinance No. 85--34 .

d. Motion by Councilor Edin, seconded by Councilor Edwards to amend
Ordinance No. 85-34 by adding the following language as one of the
conditions of the vacation.

INFORMATION SUMMARY
On 8-19--85 Council. passed Resolution No. 85-62 to call for public hearing on
Council initiated request to be held at 7:30 PM on 9/23/85. Staff requested a
Council initiated vacation to vacate right-of--way located on the corner of
Walnut Place and 99W. Right-of-way division will be determined by Washington
County : Planning Commission recommended approval . Engineering Division has
also, recommended approval with two conditions as set out below. The hearing
was published in the Tigard Times according to City and State requirements and
all abutting and affected property owners have been notified by mail. All
fees have been paid in full :
Condition 1 : Access be prohibited on the west side of SW Walnut Place the
entire length of the vacated area.
Condition 2: A public utility easement be retained over the complete area
proposed for vacation,

On September 10, 1985, the Planning Commission reviewed the proposed street
vacations on Tigard street, Walnut Place, 74th Avenue, 122nd Avenue, Clinton
Street, and 67th Avenue. The Commission recommends approval of the vacation
requests provided that legal access is retained for all properties involved.

PUBLIC WORKS DI:RECTOR'S REPORT ON PROPOSED VACATION OF A PORTION OF SW WALNUT
PLACE JUST SOUTH OF SW PACIFIC HIGHWAY.
The Engineering Division recommends the vacation known as SW Walnut Place just
south of Pacific Highway be approved with certain conditions .
This recommendation is based on findings that (a) there is no effect on
pedestrian or bicycle circulation, however the State Highway Department has
requested that access be prohibited on the west side of SW Walnut Place the
entire length of this vacation. The Engineering Division agrees with this
condition as it will have a positive inpact on traffic circulation when the
property to the west if fully developed . No response was received from fire
or police relative to response time and drainage in the area can be adequately
provided for without use of the subject right—ofiAjay . Responses were received
from three utility companies relative to existing facilities within the
proposed vacation. The location of these facilities is such that the
Engineering Division recommends a public utility easement be retained over the
complete area proposed for vacation; (b) the proposed vacation is not contrary
to the transportation element of the Comprehensive Plan; and (c) is not
contrary -to the Capital Improvements Plan.

DEDICATED PUBI..IC RIGHT---OF-WAY IN THE CITY OF TIGARD, WASHINGTON COUNTY,
OREGON. (HUDSON)
WHEREAS, a vacation request has been received and filed with the City Recorder
for SW Walnut Place/99W; and
WHEREAS, the Tigard City Council finds it necessary and desirable to initiate
vacation proceedings for said parcel.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
(1) That the Tigard City Council initiates the vacation request with the
understanding that those property owners who would normally sign a
petition shall be notified by mail of the proceedings and that the
City of Tigard pay all fees and charges as set out in TMC Chapter
15.08.
(2) That a public hearing is hereby called to be held by the City
Council on Monday, September 23, 1985, at 7:30 P.M. at Fowler Junior
High School Lecture Room, 10865 SW Walnut Street, within the City of
Tigard, at which time and place the Council shall hear any
objections thereto, and any interested person may appear and be
heard for or against the proposed vacating of said lands.
(3) That the City Recorder be, and she is hereby, authorized and
directed to cause to have published in the Tigard Times, a newspaper
of general circulation in the City of Tigard hereby designated for
such purpose, a notice of said hearing in the form hereto attached
and by this reference made a part hereof, the first publication to
be August 22, 1985 and once each week thereafter for five
publishings in all.
The Recorder be, and she is hereby, further directed to cause to
have posted within five (5) days after the date of first

NOTICE. OF SW WALNUT PLACE VACATION
The Tigard City Council will hold a public hearing on Monday, September 23 ,
1.985, at 7:30 P.M. at Fowler Junior High School Lecture Room, 1.0865 SW Walnut
Street, Tigard, Oregon to consider the proposed vacation of a strip of SW
Walnut Place right—of--way located on the corner of Pacific Highway in the City
of Tigard. The request was initiated by the City Council on August 19, 1985
at the request of Bob Hudson. Any interested person may appear and be. heard
for or against the proposed vacation of said lands. Any written objections or
remonstrance shall be filed with the City Recorder by September 18, 1985 at
3 :00 PM.

Dear Mr. Peterson:
As we discussed over the phone on June 10, 1985, I need for your firm to
prepare three certified legal descriptions for various City projects. As also
discussed the cost for these legals will range from $50.00 to $200.00 each,
with you notifying us before exceeding this limit. I have enclosed copys of
Tax Assessors Maps showing the area in which the descriptions are needed. The
three projects are as follows:
1. SW 122nd Avenue Street Vacation.
Here we need a certified legal description and your opinion as to
where the new title lines will be once the vacation is complete.
2. SW Walnut Place/99W Street Vacation.
The same information as stated with the SW 122nd Avenue vacation is
also required.
3. Civic Center/G.T.E. Access Easement.
Legal description only.
Please bill these projects separately as funds are coming from different
sources. Our deadline for receipt of this work is June 28, 1985. Please give
me a call if this timeline is unsatisfactory or if you have any questions
regarding the work.

Vacation Status Report
June 6, 1986
The following vacation requests are currently active and need further staff
consideration/action at this time.
Request:Ti5jard Street - Gregory Mull - City On 4/24/85 Randy CIarno
requested a vacation of 10 feet right-of--way for 2S1 28A lot 600. City
requested 20 feet be dedicated by the Mull' n (see Street Dedication recorded
2/14/85 #85005502) . Only 10 feet in needed by the City . On 5/13/85 I sent a
letter to utility companies. Attached is a list of the comments,
Walnut Place/99W - Tom Brian (for Bob Hudson : On 1/14/85 staff
requested Council approve initiation of street vacation. Council indicated
their desire to initiate request. On 1/25/85 prepetition conference was held
with Bob Hudson, Bob panned away 1/27/85. In April' Tom Brian was contacted
and he indicated that the family wished to continue with the vacation
requeot. Tom furnished a list of surrounding property owners during a Council
meeting, however, I've misplaced that list. A letter was sent to utility
companies and comments are attached. $60.00 was deposited on 1/25/85.
67th & Clinton Jerry Cach: On 1/18/05 prepetition conference held with
Jerry Cach. Cach was requested to get ownership records on right-of-way. On
1/30/85, Randy Clarno and I met again with Jerry and discussed how to get
requested information. On 4/25/85, I contacted Jerry Cach regarding status
and he reported Fred Cooper (Cooper and Associates) is developing map and
legal description for proposed vacation. Randy Clarno has received this
information. 5/13/85 letter sent to utility companies and report is attached.
Schriever,70th & Hampton - Fred On 12/18/84 prepetition conference was
held. 12/20/84 utility letters were mailed. During January foIlowup was
accomplished with utility companies, there were no concerns voiced for the 20
foot strip. On 3/5/85' Fred and I discussed how to proceed. Frank Currie
prepared petition and necessary papers. These were on my desk for mailing
during 6 week illness absence. On 4/25/85 Schriever, CIarnn and Z decided to
request Council initiation due to time lag on staff' s response with petition.
On 5/13/86 Council called hearing for 6/17/85. On 5/16/85 property owners
notified by mail, public notice first appeared in Tigard Times, and request
sent to Bill Monahan & Frank Currie for staff reports for hearing. On 5/21/85
area posted by Bob Thompson, On 5/30/85 Council packet information and
ordinance were prepared by me with copies to Bill and Frank. To date $347.98
has been received with $181 .56 remaining on account.
74th Avenue Near Cherry -- Alan J. : On 3/15/85 prepetition conference was
held with Mr. Fox. Frank Currie prepared papers for Mr. Fox to complete for
vacation. Mr. Fox filed circulated petition on May 1' 1985. I advised Mr.
Fox that process was not completed for petition circulation and discussed with
him and Randy Clarno how to prooeed. Utility companies were notified 5/13/85
regarding vacation requeut. See attached . On 6/1/85 $400.00 was received.
Johnson:122nd Avenue Near Greenway - Bob On 12/1/84 Mr. Johnson attempted to
file a vacation petition with staff. On 2/13/85 Mr. Johnson filed old
petitions with staff and requested assistance in working out issue. Staff has
discussed what portion of street should be vacated and has found errors in
information circulated with petition. On 5/13/85 letter was sent to utility
companies . See attached report. $250.00 was received on 2/14/85.

Dear Loreen:
On my previous letter this date I failed to mention one
area proposed to be vacated where the water district has an
existing water main. It is the "Hudson" Street Vacation on
S. W. Walnut Place. (See enclosed maps) .
The district has an existing 6-inch cast iron main located
5 feet off the property line where the street used to intersect
with Pacific Highway. The district will require some sort of
easement if the property is to be vacated.

Dear Loreen:
I have reviewed the five proposed street vacation requests
as submitted in your letter of May 13, 1985 .
Please be advised that there is only one conflict with
facilities owned by the water district, that being on S . W.
67th Avenue as shown on the attached map. The district has an
existing 12-inch cast iron main running north and south, located
10 feet from the westerly right-of-way line of S . W. 67th Avenue .
The district will need an easement 10 feet in width so that this
pipeline can be properly maintained . Also, restrictions must be
imposed that no building or structures can be constructed on top
of the water main.

7. COUNCIL INITIATED STREET VACATION DISCUSSION
a. City Engineer discussed the problems with a proposed vacation
process on the corner of Walnut Place and 99W. He stated that
since the signatures required on the petition would include some
companies back east that it would make the vacation more feasible
if Council initiated the process.
b. President Brian noted he has had recent business dealings with Mr.
Hudson and though he does not feel there is a conflict of
interest, he will still abstain from voting.
C. Motion by Councilor Edin, seconded by Councilor Scott to initiate
the street vacation process contingent upon Bob Hudson paying all
fees and that all abutting and affected property owners be
notified by mail.
Approved by 3-0 majority vote of Council present, President Brian
abstaining.
8. HALL BLVD./8URNHAM LID DISCUSSION
a. City Engineer distributed map showing area of Hall Blvd. between
Burnham Street and O'Mara. With the Civic Center project, the
Water District offices and the Christian Church all needing to
construct half street improvements within the next couple of
years, he suggested an LID might be the best tool by which to
accomplish this tank. He stated the Water District may not wish
to 6anoroft the assessment. The City Engineer also noted that the
intersection of Hall and Burnham could either be signalized or
have the corner redesigned to eliminate some of the sight
obstruction. He also felt with the Water District and City
offices being located in the same area, the increased traffic
would be another reason the LID concept would be beneficial.
b. Don Geary, 17832 Cardinal Place, Lake Oswego, represented the
Church of- Christ and stated they would like to participate in the
LID plan process. He explained the church would be building in
the next couple of years and realized the LIQ process could be
cost effective for them. He did mention that the Church would not
be interested in participating in any root for the bridge
reconstruction on Hall Blvd.
C. Consensus of Council was to direct the City Engineer to check with
other surrounding property owners for an indication of interest on
their part in the LID process and to also check with taw Int 600
ecrnom Hall Blvd. from the Christian Church. City Engineer will
report back to Council in the near future.
