AN ORDINANCE VACATING A PORTION OF SW 93RD AVENUE, AND A PORTION OF SW
MAPT SFT FAF STREET, BOTH MCA IN A RECORDED PLAT CALL-ED "TOWN OF METZGER", IN
THE CITY OF TIGARD, YM.SHINGTON COUNTY, OREGON.
WHEREAS, the Tigard City Council initiated this vacation after accepting a
completed vacation petition from by the Trammell Crow Company; and
WHEREAS, the reason and purpose for this vacation is to eliminate portions of
the SW 93rd Avenue and SW Mapleleaf Street rights of�,ay and return control of
the property to adjoining owners; and
WHEREAS, returning said control to adjoining owners will facilitate the
development of the Lincoln V office building and parking garage project; and
MMREAS, SW 93rd Avenue will be realigned easterly of it's present location as
part of the Lincoln V project; and
WHEREAS, the original area to be vacated has, been slightly reduced to provide
for said realignment, said reduced area is reflected in the attached Exhibit
"A". and
Wf-ERFAS, the vacation is. re=miended by the Planning ==-ssion and the
Department of Camtnuni_ty Development subject to certain conditions as stated
below; and
WHEREAS, all affected service providers including utility companies and
emergency services have reviewed the vacation proposal and have no objections;
and
WHEREAS, the Trammell Crow Ccnpany has made satisfactory arrangements with each
provider for the relocation of existing utilities or the retaining of easements
for existing utilities; and
WHEREAS, the Council having held a hearing on July 10, 1989, finds the public
interest will not be prejudiced by the vacation as provided by ORS 271.120 and
TMC Section 15.08.130; and
WHRW the Council finds that it is in the public interest to approve the

WHEREAS, the Council finds that the following conditions are necessary to
vacate said land:
1. That the Trammell Crow Company shall dedicate a 60 foot wide right-of-
way from the existing southern terminus of SW 93rd Avenue to where it
aligns with the existing SW 92nd Avenue right-of-way with a minimum 350
foot centerline radius curve.
2. That a 15 foot wide public utility easement remain over a portion of the
area to be vacated to accommodate existing utilities including sanitary
sewer. Said easement is described in Exhibit "B".
3. The vacation shall not be effective until the effective date of this
ordinance, and a certified copy of this ordinance has been recorded with
the Washington County Clerk, Assessor, and Surveyor.
4. The vacation shall not be recorded with the Washington County Clerk,
Assessor and Surveyor until the Land Use Board of Appeals (LUBA) issue
has been resolved. (Reference: LUBA, Notice of Intent to Appeal, Gene

THE CITY OF TIGARD ORDAINS AS FOLUMS:
Section 1: The Tigard City Council hereby orders the vacation of those
certain portions of SW 93rd Avenue and SW Mapleleaf Street, and shown on the
attached Exhibit "A:, and by this reference made part hereof.
Section 2: The Tigard City Council further orders that the vacation be subject
to the following conditions:
1. That the Trammell Crow Company shall dedicate a 60 foot wide right-of-
way from the existing southern terminus of SW 93rd Avenue to where it
aligns with the existing SW 92nd Avenue right-of-way with a minimum 350
foot centerline radius curve.
2. That a 15 foot wide public utility easement remain over a portion of the
area to be vacated to acomnodate existing utilities including sanitary
sewer. Said easement is described in Exhibit "B":, and by this
reference made part hereof.
3. The vacation shall not be effective until the effective date of this
ordinance, and a certified copy of this ordinance has been recorded with
the Washington County Clerk, Assessor, and Surveyor.
4. The vacation shall not be recorded with the Washington County Clerk,
Assessor and Surveyor until the Land Use Board of Appeals (LUBA) issue

applicant be constructed with the least possible delay in order to complete the
improvements during the current construction season, an emergency is hereby
declared to exist, and this ordinance shall become effective inTiediately upon

POLICY ISSUE
The City has supported right-of-way vacations that provide for orderly
development, reduces the City's liability without sacrificing public need and
when it enhances an area's value and livability. All of these criteria appear
to be supported in this proposal.
INFORMATION SUMMARY
On May 22,1989 Council accepted a completed vacation petition from the Trammell
Crow Company which proposed the vacation of portions of S.W. 93rd Avenue and
S.W. Mapleleaf Street. Vacation proceedings were initiated and a public hearing
was set for July 10,1989. The purpose of the vacation is to accommodate the
development of the Lincoln V office building and parking structure which
includes the realignment and improvement of S.W. 93rd Avenue. See attached memo
for for more specific information concerning the proposed vacation.
ALTERNATIVES CONSIDERED
1. Approve the vacation and adopt the attached ordinance as presented.
2. Direct staff to prepare a resolution denying the vacation.
FISCAL IMPACT
Vacating these rights-of-way will return control of the property to adjoining
property owners and add to the assessed value of the City. This impact is
significant as the property is among some of the highest valued property in the
City. In addition the vacation will allow a multi-million dollar development to
go ahead, further adding to the City's assessed value.
SUGGESTED ACTION
The City should vacate these rights-of-way subject to certain conditions as
outlined in the ordinance presented for adoption. Vacating these rights-of-way
will provide for a number of positive results including the development of the
Lincoln V project and the improvement of the realigned S.W. 93rd Avenue to City
standards.

Re: Proposed vacation of portions of S.W. 93rd Avenue
and S.W. Mapleleaf Street
Date: June 30, 1989
I. Background
The Trammell Crow Company has recently received approvals that enable them to
move ahead with the development of a 7-story office building and separate
parking structure, otherwise known as Lincoln V. These include a Comp Plan
Amendment-Zone Change and Site Development Review. A number of other permits
and approvals will be required before the project is completed.
The next key action in this line of reviews and approvals is the vacation of
portions of S.W. Mapleleaf Street and S.W. 93rd Avenue. On May 22,1989 Council
accepted a completed vacation petition, submitted by the Trammell Crow Company,
proposing to vacate portions of the above stated streets. All abutting property
owners and 67% of all affected property owners had signed the petition as
required by state law. Council subsequently initiated vacation proceedings,
starting a formal review process, and set July 10,1989 for the public hearing.
II. Findings
Planning Commission
The Planning Commission reviewed the proposal at their regular meeting on June
20,1989 and recommended that it be approved. The Commission found that the
proposal did not conflict with the Comprehensive Plan.
Transportation and Utilities
The Engineering Division has reviewed the proposal and made the following
comments:
The existing 93rd Avenue is a minor collector street intending to connect
S.W. Oak Street to S.W. Locust street. It is mostly unimproved and a portion of
the right-of-way does not exist for approximately 280 feet north of S.W. Oak
Street. A 50 foot wide right-of-way exists for the remainder to S.W. Locust
Street.
A previous zone change application by the same applicant included the
realignment of S.W. 93rd Avenue as an amendment to the Metzger-Progress
Community Plan. This amendment became final on June 12,1989.
* Prior to the vacation of the existing right-of-way the right-of-way for the
realigned S.W. 93rd Avenue should be provided as described in the Site
Development Review approval. The realignment should begin at the existing south
terminus of S.W. 93rd Avenue and follow the alignment shown on the site
development plans up to the existing S.W. 92nd Avenue. Curves for collector
streets are required to have a minimum 350 foot centerline radius and a 60 foot
wide right-of-way.
To date , most of the new realigned S.W. 93rd Avenue right-of-way has been
dedicated as required by the Site Development Review approval.
All utility company providers responded and most indicated they had facilities
in the proposed vacation area. In addition, the City has sanitary sewer
facilities within a portion of S.W. Mapleleaf Street. Trammell Crow has
arranged with each provider to either relocate facilities or to grant easements
for facilities that are to remain.
Public Saftev
Both the Tualatin Valley Fire Department and the City of Tigard Police
Department responded and had no objection to the proposal.
Title to Vacated Lands
The rights-of-way to be vacated were created by the recording of plat of "Town
of Metzger". This requires that the 50 foot wide right-of-way split evenly to
adjoining owners once vacated. In this case, the Trammell Crow Company will
receive title to all vacated lands.
III. Recommendation
The City should vacate the proposed portions of S.W. 93rd Avenue and S.W
Mapleleaf Street subject to the following conditions:
1. That the remaining new right-of-way necessary to provide for the realignment
of S.W. 93rd Avenue be dedicated prior to the recording of the vacation
ordinance.
2. That a 15 foot wide public utility easement remain and be centered over the
public sanitary sewer within S.W. Mapleleaf Street. Said easement is described
in Exhibit "B" which is made part of the ordinance presented for adoption.
3. That the area originally requested for vacation be reduced to exclude that
area needed to complete the realignment of S.W. 93rd Avenue. This amended area
is described in Exhibit "A" which is made part of the ordinance presented for
adoption.

This letter confirma our conversation of June 23 , 1989,
relative to the subject street vacation. You have
indicated that the main on S.W. 93rd Avenue provides
service only to two buildings owned by Trammell Crow
Company west of S.W. 93rd Avenue and that, service is
currently inactive tv these vitas. Northwest Natural
Cas Company is in agreement to abandon the main on
S.W. Aird Avenue subject to the toiiowing condition.
In the event that Trammell Crow Company desires
to maintain or re-establish gas service to the
buildings west of S.W. 93rd Avenue, Trammell. Craw
agrees to reimburse Northwest Natural Gas Cvmpally
for the actual coat of main replacement in an
alignment extending southerly on S.W. 92nd Avenme
from S.W. Loautat Street to S.W. Maple Leaf Street
and westerly on $.N o maple Leaf .Street from
S.W. 92nd Avenue to S.W. 93rd Avernus. This
construction will proceed only when required to

Enclosed you will find the responses I received from staff and other agencies
typically involved in the review of proposed vacations. The only one I have
not received is the one from GTE which should be here any day. I must
incorporate these comments/concerns into my report, which is due next Thursday,
June 29,1989,for the July 10,1989 hearing. The report will likely also contain
a proposed ordinance approving the vacation subject to certain conditions. Any
conditions will relate directly to the comments/concerns raised in these
responses.
Most of these comments/concerns deal with retaining easements for existing
facilities. They also recommend that certain parcels be consolidated and that
right-of-way be dedicated in place of the right-of-way lost. Given this, it is
likely that our proposed ordinance will contain a number of conditions and if
your not prepared, it could take considerable time to satisfy those conditions,
thus delaying the recording of the ordinance.
I strongly recommend you carefully review all of the enclosed comments/concerns
and prepare to address them before the hearing and maybe before I complete the
report. If you have made plans to relocate certain facilities and have
agreements with that utility provider to do so, please let me know. If you plan
to keep certain facilities in their present location and retain easements, then
i•11 need to know which ones and have a legal description describing the
easement area per the utility's requirements. Regarding the new right-of-way,
here again I will need a legal description describing the area to be dedicated.
Addressing these items prior to the hearing and the staff report should enhance
the chances of approval and allow you to stay on schedule. If you have any
questions please give me a call.

Findings:
1 . The existing 93rd Avenue (Lincoln Avenue) is a minor collector street
connecting Oak Street to Locust Street . It is rnostly unimproved and a
portion of the right-of-way does not exist for approximately 280 feet north
of Oak Street . A 50 foot wide right--of-wav exists for the remainder to
Locust Street .
A previous: zone change application by the same applicant included the
realignment of 93rd Avenue as an amendment to the Metzger-Progress
Community Plan. This amendment to the Plan was approved and will become
filial Jude 1-1, 1989.
3. Prior to the vacation of the existing right-of-way_ the right-of-way for the
realigned 93rd Avenue should be provided as described in the Site
Development Review SDR 89--l" application. The realignment should begin at
the existing south terminus of 93rd Avenue and follow the alignment shown
on the site development plans up to the existing 91.nd Avenue. Curves for
collector streets are required to have a rninirrmur, 350 foot radius and a 60
foot wide right-of-way.
Conditions
The Enc{ineering department has no objections to the proposed vacation
provided the following conditions are met :
1 . The applicant shall dedicate a 60 foot wide right -of--way front the existing
southern terminus of 93rd Avenue to where it aligns with the existing 9"nd
Avenue right-of -wad,- with a minirnurn 350' centerline radius e� curve.
The applicant shall coordinate any necessary utility easements or
relocations necessary within the existing 93rd Avenue right-of -way.

With regards to the vacation of portions of SW 93rd Avenue and SW Maple Leaf
St. , Tigard, PGE presently has overhead lines in the portions of right of way
to be vacated (see attached map).
On the assumption that existing residents of SW 93rd Avenue and SW Maple
Leaf St. are to be removed in conjunction with the development of Lincoln V,
our existing overhead lines can be removed, no easement will be required
and vacation of these streets would present no problem to PGE. If the
residents are to remain, a minimum of a 10-foot easement (5-feet on either
side of the central line of our overhead lines) would be required to maintain
our existing facilities.

POLICY ISSUE
i
A petition for the vacation of the above public rights-of-way was received and
filed with the City on May 18, 1989. The petition was filed by the Trammel
Crow Co. and contained the signatures of all abutting property owners and at
least 67% of all owners in the affected area as defined by the Tigard Municiapl
Code (TMC) .
The petition has been reviewed and meets all requirements defined by TMC
15.08.080. Council must now consider whether to accept the petition and
initiate vacation proceedings or reject the petition. This consideration must
occur within 30 days of the date the petition was filed per TMC 15.08.110(a) .
Should the Council accept this vacation petition, initiate proceedings for a
formal review and call for a public hearing?
------------------- INFORMATION SUMMARY
Trammel Crow's Lincoln Five/Parking Structure project will require a number of
approvals including the vacation of these rights-of-way. Their desired time
frame calls for construction this summer. Council's recent decision to approve
their zone change request has now started the process for subsequent approvals.
Of these, the vacation is probably the longest due to state law requirements.
Realizing this, Trammel Crow has moved very quickly to complete the petition
documents (4 days) and is requesting Council to initiate the process now and
not wait until a later meeting.

ALTERNATIVES CONSIDERED
1. Adopt the attached resolution initiating vacation proceedings and
calling for a public hearing on July 10, 1989-
2. Take no action at this time and consider the petition at a later date,
but within the required time before June 17, 1989.
3. Reject the vacation petition with just cause.
FISCAL IMPACT
Vacation of these rights-of-way would return control of the property back to
private owners and place it back on the tax rolls in a high value commercial
area. This would also increase the assessed value of the City.

SUGGESTED ACTION
Staff recommends that Council initiate vacation proceedings by adopting the
attached resolution.

A RESOLUTION CONCERNING THE VACATION OF A PORTION OF SW 93RD AVENUE, AND A
PORTION OF SW MAPELEAF STREET, BOTH LOCATED IN A RECORDED SUBDIVISION PLAT
CALLED "TOWN OF METZGER", IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON.
WHEREAS, a vacation petition has been received and filed with the City Recorder
for vacation of portion of S.W. 93rd Avenue and S.W. Mapleleaf Street; and
WHEREAS, said petition was filed with the City on May 18, 1989 by the Trammel
Crow Company and contained the signatures of all abutting property owners and
the signatures of over 2/3's of the affected property owners as defined by TMC
15.08.080; and
WHEREAS, these portions of S.W. 93rd Avenue and S.W. Mapleleaf are dedicated
public rights-of-way giving the public rights over the land for street and
utility improvements; and
WHEREAS, the Tigard City Council finds it necessary and desirable, to accept
said petition and initiate vacation proceedings for said public rights-of-way.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
(1) That the Tigard City Council accepts the vacation petition submitted by
the Trammel Crow Co. containing all the required signatures and
acknowledges that the Trammel Crow Co. will pay all fees and charges to
process said vacation request as set out in TMC 15.08.
(2) That a public hearing is hereby called to be held by the City Council on
Monday, July 10, 1989, at 7:30 PM at the Tigard Civic Center Town Hall
Room, 13125 SW Hall Boulevard, within the City of Tigard, at which time
any interested person may appear and be heard for or against the
proposed vacating of said public right-of-way.
(3) That the City Recorder be, and she is hereby, authorized and directed to
cause to have published in the Tigard Times, a newspaper of general
circulation in the City of Tigard hereby designated for such purpose, a
notice of said hearing in the form hereto attached and by this reference
made a part hereof, the first publication to be June 1, 1989 and once
each week thereafter for five publishings in all.
The Recorder be, and she is hereby further directed to cause to have
posted within five (5) days after the date of first publication, a copy
of said notice in the form attached, at or near each end of the area
proposed to be vacated.
