ORDINANCE NO. 81- -4
AN ORDINANCE VACATING A PORTION OF SW 67TH AVENUE, A 60 FOOT WIDE DEDICATED PUBLIC
RIGHT-OF-WAY, IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON, RECORDING AN
EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council finds that a Resolution 81-89 was adopted by the Council on
August 10, 1981, relating to the vacation of the hereinafter described
right-of-way, and that a public hearing was thereby called to be held on September
14, 1981, and that notice of said hearing was given as required by Chapter 271.110
O.R.S. as set forth in said resolution.
Section 2: The Council further finds that a public hearing as thereby called to be
held, was duly and regularly held at the regular Council meeting on
September 14, 1981, at which time and place the Council afforded all interested persons
an opportunity to be heard for or against the proposed vacation of said lands, and
the Council further considered all objections thereto.
Section 3: The Council further finds that a majority of the owners of the area
affected by said proposed vacation, computed on the basis provided in
Chapter 271.080 O.R.S., did not object thereto in writing and that all owners affected
thereby did, in fact, favor the vacation of said area; and the Council finds that
said vacation will not substantially affect the market value of any abutting property.
Section 4: The Council further finds that the public interest will not be prejudiced
by the vacation of the hereinafter described right-of-way and that the
said lands are not useful as part of the public street or road system of the City of
Tigard and that it is in the public interest that said vacation be approved.
Section 5: The following described portion of said S.W. 67th Avenue is hereby vacated
and discontinued as public ways reserving for utility purposes an ease-
ment over the entire vacated portion to wit:
That portion of land in Section 1, Township 2 South, Range 1 West, Willamette Meridian,
Washington County, Oregon, being more particularly described as follows:
Beginning at the intersection of the north line of SW Hampton and the
West line of SW 67th Avenue, thence Northerly along said West line, a
distance of approximately 450 feet to the South line of SW Gonzaga,
thence Easterly along the Easterly extension of said South line, a
distance of approximately 60 feet to the intersection of the East line
of SW 67th Avenue and the South line of SW Gonzaga, thence Southerly
approximately 450 feet to the North line of SW Hampton Street, thence
Westerly along the Westerly extension of said North line approximately 60
feet to the point of beginning.

Section 6: That the City Recorder be, and she is hereby authorized and directed
to have certified copy of this ordinance filed for record with the
following Washington County departments;,

3. Department of Public Works - Attn: County Surveyor
All as required by Chapter 271.150 O.R.S.
Section 7: This ordinance shall be effective on and after the 31st day after its
enactment by the City Council, and approval by the Mayor.

ENTERING INTO AN AGREEMENT WITH THE OREGON DEPARTMENT
OF TRANSPORTATION FOR THE 72ND AVENUE INTERCHANGE.

(a) Motion by Councilman Cook, seconded by Councilman Brian to adopt.
(b) Director of Public Works recommended approval noting the the City has
worked out the questions they had on the agreement and that financing
of the lights would be done by the Transportation Department. The City
would only pay for the energizing of the signals.
Approved by unanimous vote of Council.

19. MORNING HILL SUBDIVISION SIDE LOT EASEMENT VACATION
(a) Public Hearing Opened
(b) Director of Public Works stated the vacation was for two side lot ease-
ments in the Morning Hill Subdivision. The developer plans on taking
three existing lots and creating two lots. One utility company stated
there was a stub-out at one of the utility easements, however, the
developer has stated he would pay the cost for relocating.
(c) Public Testimony
No one appeared to speak.
(d) Director of Public Works recommended approval. City Administrator
recommended one amendment to the ordinance in Section 3 by adding
the following sentence: "The City accepts no responsibility of the
removal of existing utility facilities."
(e) Public Hearing Closed.

(a) Public Hearing Opened
(b) Director of Public Works gave summation of request noting that all utility
companies were notified of the pending vacation. At this time,
most f
them had improvements in the street right-of=way.
(c) Public Testimony

I (d) Director of Public Works recommended approval, noting that the ordinance requires
a 60' easement be granted by the property owners in the location of the street
right-of-way.

(f) Mayor Bishop expressed his concern that the vacation was not appropriate
since the location made the property very expensive and did not like to
see the City give up public property.
Councilman Brian stated that this property would be going back on the tax

rolls.
City Administrator noted the elimination of street maintenance and up keep
would be a savings to the taxpayers, and that other portions of this same
street have already been vacated.
Director of Public Works discussed how this might be impacted by the Haines
Road Interchange proposed by the State Highway Department. He also noted
that 100% of the property owners signed the petition to have the vacation.

21. TIGARDVILLE HEIGHTS L.I.D. NO. 29
(a) Public Hearing Continued from August 24th, 1981 meeting.

(b) Mayor and Council discussed whether to accept any more testimony.
Councilwoman Stimler suggested that only persons who did not testify
at the last public hearing be allowed to testify at this time.
(c) Public Testimony
Mayor Bishop read into the record two letters written by Assa Otto and
Mary Burnam, requesting the improvements be on at least 97th Avenue.
Pete Jansen, 9910 SW McDonald, stated that he did not feel it was fair for
the people on McDonald Street to not be included in the L.I.D. when his
subdivision, adjacent to the L.I.D. area, was required to improve the street.
Mary Burnam, 14235 SW 97th Avenue, requested SolarCrest Subdivision be
improved even if the property along McDonald Street withdrew from the L.I.D.
(d) Recommendation of Director of Public Works was to approve the L.I.D. with
McDonald Street properties being included or without those properties.
(e) Public Hearing Closed.
(f) Council discussed the difference in cost of the project if McDonald Street
were deleted from the plans. Councilman Brian expressed his concern that
McDonald Street is heavily traveled and needs the improvement.
Councilman Scheckla felt McDonald Street should be eliminated from the plan.
Mayor Bishop stated he did not wart McDonald Street improved in a piece-meal
way.

A RESOLUTION CONCERNING VACATION OF A PORTION OF SW 67TH AVENUE A 60 FOOT WIDE
DEDICATED PUBLIC RIGHT-OF-WAY IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON.
WHEREAS, the area described on the attached sheet headed "Exhibit A"
and by this reference made a part hereof, is an undeveloped unused street and/or
alley dedicated to the public for highway purposes; and
WHEREAS, the area described on said Exhibit "A" now lies within the
platted area of West Portland Heights, a duly recorded subdivision of record
in said County; and
WHEREAS, the area described on said Exhibit "A" also lies within the
corporate boundaries of the City of Tigard, Oregon; and
WHEREAS, said described area does not serve a public highway purpose and
is so situated as to be of no usefulness now or in the future as part of the
public street system of the City but, existing public service utilities lie
therein; and
WHEREAS, it appears to be in the public interest that the said area be
vacated and restored to the tax rolls and made available for development and
use, reserving therein a public easement for said existing public service
F utilities; and
WHEREAS, pursuant to Chapter 271.080 ORS, abutting property owners have
petitioned for the initiation of vacation proceedings as authorized in Chapter
271 ORS.
NOW, THEREFORE,
BE IT RESOLVED by the City Council of Tigard as follows:
(1) "That the public hearing is hereby called to be held by the City
Council of Tigard on Monday, September 14 , 1981, at Fowler Junior High
School Lecture Room, 10865 SW Walnut Street, within the City of Tigard,
beginning at 8:00 P.M. , at which time and place the Council shall hear
any objections thereto, and any interested person may appear and be
heard for or against the proposed vacating of said lands.
(2) "That the City Recorder be, and she is hereby, authorized and directed
to cause to have published in the Tigard Times, a newspaper of general
circulation in the City of Tigard hereby designated for such purpose, a
notice of said hearing in the form hereto attached and by this reference
made a part hereof, the first publication to be made on the 13th day of
August, 1981 and once each week thereafter for five publishing$ in all.
"The Recorder be, and she is hereby, further directed to cause to have
posted within five (5) days after the date of first publication, a copy

In response to your letter dated July 31 , 1981 regarding public
hearing for the above street; we have an existing overhead power line
on the East side of S. W. 67th Avenue from S. W. Hampton Street North
to S. W. Gonzaga Street and beyond. We are leased on General Telephone
poles in this area.
We request to reserve a ten foot utility easement beginning at
S. W. Hampton Street extending North to S. W. Gonzaga Street and par-
allel with the East right-of-way line of S. W. 67th Avenue.

Dear Doris:
Thank you for the opportunity to comment on the
proposed vacation of a portion of S. W. 67th Avenue,
between Hampton and Gonzaga Streets.
The Tigard Water District has an existing 12-inch
cast iron main within the proposed area to be vacated.
It is located 10 feet from the westerly boundary of
S. W. 67th Avenue (to be vacated) . This is a very
important transmission main as it is the only line
between the Baylor Street reservoirs and the rest of
the district.
If the street is vacated, it is requested that
Tigard Water District be granted an easement for the
most westerly 20 feet thereof as shown on the attached
map in green (and with no buildings or construction thereon) .

Dear Ms. Hartig:
In response to your letter dated July 31, 1981, the Metzger Water
District is requesting an easement area for a 12" domestic water line
to be allowed on SW 67th Avenue from SW Hampton Street to S17 Gonzaga
Street. The line shall eventually extend to SW Franklin Street.
We are sending a construction map showing the existing and current
planned extension which shall be completed this week.
