O 41' — o�+�, ► Vacation No. 252. } The above-entitled matter having come on regularly before the Board at its meeting of November 27, 1984; and It appearing to the Board that a petition has been filed for a vacation of a portion of County Road No. 1601 (S.W. 67th Avenue), situated in Section 1 , Town- ship 2 South, Range 1 West of the Willamette Meridian, Washington County, Oregon, and that said petition was signed by owners of 100 percent of the land abutting the property proposed to be vacated, pursuant to ORS 368.351 (2); and It appearing to the Board that said petition did describe that portion of S.W. 67th Avenue to be vacated, the names of the parties to be particularly affected thereby, and set forth the particular circumstances of the case; and It appearing to the Board that the portion of S.W. 67th Avenue to be vacated is within the corporate limits of the City of Tigard; and It appearing to the Board that the City of Tigard, in accordance with � ORS 271 .100, held `a public hearing, had no remonstrances, and by Ordinance No. 83-53 approved said vacation, and It appearing to the Board that the Roadway proposed to be vacated is an �I established County Road, under County Jurisdiction, requires the County to act on the vacation as it would any other vacation proceedings as required by ORS 368.361 , and It appearing to the Board that the only parties that would be particularly affected by the said vacation are the petitioners who own all the land adjacent to and affected by the said proposed vacation; and It appearing to the Board that the County road official did examine that portion of S.W. 67th Avenue to be vacated as described below, and filed a report with this Board upon completion thereof, in accordance with ORS 368.351 (1); and It appearing to the Board that a letter was sent to the petitioners stating the date of October 23, 1984, at 6:30 PM as the time and Room 402 of the , Washington County Adi-Ainistration Building, Hillsboro, Oregon; as the place the business meeting would be, to complete the proceedings for the vacation of the below stated S.W. 67th Avenue; and It appearing to the Board that the matter should be continued in order to allow the adoption of criteria to be used as guidelines for determining if a road vacation is in the publ{c interest; and i It appearing to the Board that there are utility facilities �!ithin that portion of S.W. 67th Avenue to be vacated; and that easements for said facilities should be reserved; and It appearing to the Board that there have been no remonstrances to the vacation of a portion of County Road No. 1601 (S.W. 67th Avenue); it is therefore RESOLVED AND ORDERED that: All of that portion of County Road No. 1601 (S.W. 67th Avenue) lying between the South line of S.W. FranRlin Street and the South line of S.W. Gonzaga Street as these streets are laid out in the plat of "West Portland Heights", a recv.-ded plat in Washington County, Oregon. be and hereby is vacated as it is in the public interest, reserving therefrom a a utility easement for existing utility lines as provided for in City of Tigard's Ordinance No. 83-53, Section 2 Ma]); and it is further RESOLVED AND ORDERED that the County Surveyor of Washington County, Oregon, be and hereby is authorized and directed to mark that portion of said County Road No. 1601 (S.W. 67th Avenue) as vacated on the plats and records of Washington County, Oregon, all in accordance with ORS 368.356(2); and it is further s, RESOLVED AND ORDERED that the County Surveyor of Washington County, Oregon, is hereby authorized and directed to have this order of vacation recorded in the records of Washington County, Oregon, and cause copies of this order to be filed with the Director of Assessment and Taxation and the County Surveyor's office in accordance with ORS 368.356(3). Resolution Mn, 83-98, adopted by the Council on October I8^ 1983^ initiated proceedings for the vacation of a portion of SW 67th Avenue & SA G000aga Street located within the City of Tigard and ebuwo on the attached may. 2. The purpose of the vacation is to comply with Comprehensive NPO #4 Plan calling for super blocks. 67th Street immediately to the north and south has been vacated. Couzaga Street is unimproved and the area could be used for parking and landscaping. 3. The vacation is recommended by the City's Development Committee under the conditions set forth below. o Reservation of utility easements. n Mutual access agreement or waiver of access for all properties abutting said vacation he signed. / \ 4. In accordance with ORS 271.100, the Council fixed a time and place for the public hearing before the Council; the Recorder published notice and posted notice in the area proposed to be vacated. 5' The Council having held a public hearing finds no objections were made or tiled hereto as provided by ORS 271.120. 6. lb ^--Council finds that it is in the public Interest -to'' 1pprove-- ' tbe petition, subject to conditions, because no public purpose or use can be served by the vacated portions of the street and the �\ y~ vacated portions are too small to qualify for u development permit. There will be two easements required by the City which you must supply. One is a 60' public utility easement along the vacated streets and the other is a 30' private access/egress easement along both street centerlines. Once the easements have been filed with the City, I will ask our Legal Counsel to approve as to form and then the vacation can be recorded. The City Administrator has asked me to take the staff lead in this problem. As I understand the situation to date, the City is waiting for copies of the legal descriptions of properties adjacent to the vacated portions of 67th and Gonzaga. Once you have furnished these to me, the City will verify the legals and return them for attachment to the easement forms for your circulation. I understand that there may be problems obtaining a 30' private access/egress easement signed for all, or a portion, of Gonzaga Street. When you have contacted Mr. Wardin and Mr. Dunham, please call to discuss their decision with me. The City will accept a waiver of access form for those properties along SW Gonzaga if all property owners agree. If there remain problems after trying to work out an agreement with the various property owners, the City alternative will be to take this matter back to the Council for review. Ordinance No. 83-53 vacates the land in question. Note Section 1 a - there may be public utilities in the street. The City's Engineering Division is checking this information with all the public utilities and will give me the information as soon as it is available. Note Section 1 b - the requirement is made that you shall provide us with a mutual access agreement or waiver of access. ..this may be a way to eliminate the access, however the petition reads differently. 2. Petition sample - This (as noted in the highlighted area) petitions vacation with the provision that right of access be granted to the owners or contract purchasers. 3. Large map of area - This shows the 30' easement that should be on the property for access and shows potentially land-locked parcels highlighted in yellow if the access easement is not enacted. This too could be a problem since there are separate tax lots. This list is not intended to be all inclusive of the problems we are looking at, but just some food for thought. Director of Public Works referred to information summary report noting the traffic hazards on S.W. 115th. Staff is recommending restricting parking on the west side from S.W. Gaarde to S.W. Fonner. Council expressed concern that the property owners were not notified that parking would be restricted. Council discussed alternatives to staff proposal and how to solve the traffic hazards. b. Motion by Councilor Cook to table item for two weeks. C. First, the petition must contain a number of things. It must contain the description of the ground to be vacated, the purpose for which the ground will be used, and the reason for the vaca- tion. ORS 271. 080 (1) . The petition must indicate that all of )/the abutting property owners agree to the vacation and at least A two-thirds of those affected agree to the vacation. ORS 271. 080 (2) . To decide who is affected, one must look laterally from the street JU to the next parallel street or no more than 200 feet and laterally from the terminus of the portion to be vacated 400 feet. In addi- tion, the consents must be "acknowledged before an officer autho- rized to take acknowledgments of deeds. " ORS 271. 080 (2) . The petitioners must present the petition to the City Recorder. The City Recorder must tell at least one petitioner when the petition will come before the Council. ORS 271. 090 . The notice must indicate that anyone may petition or object or remonstrate against the petition in writing before the Council hearing. ORS 271. 110. The required notices also include posted notice. You should con- sult ORS 271.110 (2) for the details of that posting. The petitioners are required to pay to the City before the publi- shing of the notice the cost of publishing, posting, and other expenses associated with the petition. (The petitioners will also be required to bear the costs of recording if the petition is granted. ) For posting, the petitioners will be refunded any surplus in excess of their deposit. ORS 271.110 (3) . At the Council hearing, the Council must determine, i.e. , make findings, a number of issues. Findings must be made that the requisite consent has been obtained, that notice was properly given, and that the public interest would not be prejudiced by granting the petition. The Council may of course grant in part and deny in part so long as the findings support that. FACTS The petition that the City has received is for a portion of 68th Street and for a portion of Gonzaga Street. If these streets are vacated, a few of the properties would not have access to a public street. ISSUE You asked me if a "blanket easement" is appropriate for the properties abutting the proposed vacation. I assume this means to provide access to lots which would otherwise lose access to a public street. CONCLUSION I suggest that if the petition is granted, then that it be granted in part and denied in part and that certain conditions be put upon it. Sufficient right-of-way should be rededicated so that each property has at least one access to the public street. Such rededication is permitted by ORS 271.160.
