WHEREAS, the Tigard City Cnuncil initiated this vacation request pursuant to Section 16.08.040 of the Tigard Municipal Code; and - WHEREAS' the Council, having held a public hearing on 9/23/85, found that it was in the public interest to vacate a portion of 67th and Clinton Streets; and WHEREAS, the Council is now advised that the portion of SW 67th Avenue which was proposed to be vacated in not within City of Tigard street jurisdiction. NOW, THEREFORE' THE CITY 0F TIGARD ORDAINS AS FOLLOWS: Section 1: Thu Tigard City Council hereby amends Ordinance No. 85-37 by removing all references to the vacation of 67th Avenue by amending Section 1 of that ordinance to read as follows: "Section 1: The Tigard City Council hereby orders the vacation of Clinton Street as described on the attached Exhibit "A" and shown on the attached Exhibit "B"' and by this reference made pm�-tn hereof." Section : The Tigard City Council further amends Ordinance No. 86-37 by amending Section 2 which net forth the required conditions placed on that vacation as follows: "Section 2: The Tigard City Council further orders that the vacation be subject to the following condition: "p This vacation shall not be effective until the effective date of this ordinance and it shall not be effective until a certified copy of this ordinance has been recorded with the Washington County clerk, assessor, and surveyor," Section 3 : Effective Date: As this ordinance is to amend an ordinance passed by the Tigard City Council and effective in October, 1985, and an the Council =ap '/n;46]e to V&Cste 67th Avenue which was under Washington County jurisdiction, an emergency is hereby declared to exist and this ordinance shall become effective upon its passage by the Council and approval by the Mayor. The Engineering Division recommends the vacation known as SW 67th Avenue, between SW Baylor Street and SW Dartmouth Street (I-5 off ramp) ' and SW Clinton Street' between SW 66th Avenue and SW 67th Avenue be approved with certain conditions . A letter was sent to utility companies and comments are attached. $50.00 was deposited on 1/25/85. 67th & Clinton Jerry Cac On 1/18/86 prepetition conference held with Jerry Cach. Cach was requested to get ownership records on right-of-way. On 1/30/85, Randy CIarno and I met again with Jerry and discussed how to get requested informatiwn. On 4y25/85, I contacted Jerry Cach regarding status and he reported Fred Cooper (Cooper and Associates) is developing map and legal description for proposed vacation. Randy Clarno has received this information, 5/13/85 letter sent to utility companies and report is attached. Schriever:70th & Hampton - Fred On 12/18/84 prepetition conference was held. 12/20/84 utility letters were mailed. During January followup was accomplished with utility companies, there were no concerns voiced for the 20 foot strip. On 3/5/86' Fred and I discussed how to proceed. Frank Currie prepared petition and necessary papers. These were on my desk for mailing during 0 week illness absence. On 4y26/85 Schriever, Clarnn and I decided to request Council initiation due to time lag on staff' s response with petition. On 6/13/85 Council called hearing for 6/17/85. On 5/10/85 property owners notified by mail' public notice first appeared in Tigard Times, and request sent to Bill Monahan & Frank Currie for staff reports for hearing. On 5/21/85 area posted by Bob Thompson. On 5/30/85 Council packet information and ordinance were prepared by me with copies to 8iII and Frank. To date $347.08 has been received with $181 .50 remaining on account. 74th Avenue Near Cherry - Alan J. : On 3/15/85 prepetition conference was held with Mr. Fox. Frank Currie prepared papers for Mr. Fox to complete for vacation. Mr. Fox filed circulated petition on May 1' 1985. 1 advised Mr. Fox that process was not completed for petition circulation and discussed with him and Randy Clarno how to proceed. Utility companies were notified 5/13/86 regarding vacation request. See attached. On 5/1/85 $400.00 was received.
