PUBLIC HEARING — STREET VACATION — 66TH & ATLANTA — GERRY CACH / a. Public Hearing Opened 6. Community Development Director summarized this item. He noted that this is a street vacation request for a portion of S.W. 66th Avenue between Atlanta and Baylor Street. The request was submitted by Gerry Cach and was Council—initiated following Mr. Cach' s recommendation. The issue in whether or not to vacate a piece of street that possibly has no use as part of TiganJ' s transportation system but could become part of a larger parcel of property for future development. Community Development Director advised that the property in in the Tigard Triangle where there have been a number of street vacation requests in that area to eliminate residential streets and there by creating "super blocks." Staff has reviewed the application and received input from various entities such an PGE, Metzger Water District and the Tigard Water District. As result of input received, staff has modified the vacation area and is noted in the proposed Ordinance concerning this vacation. Community Development Director described in detail the changes and answered questions by the Council. ' C. Public Testimony Proponen o Geraldine Ball, Chairperson of NPO #4, 11515 S.W. 91st ' Avenue, Tigard, Oregon, testified that NPU #4 voted unanimously for approval of the vacation. n Randy Volk, representing Tigard Water District, Assistant Superintendent, 8841 S.W. Commercial Street, Tigard, Oregon, testified that he is not really an opponent. Tigard Water District has a double—wide gate which faces the freeway (along 00th Street) that they must get into for maintenance purposes. During discussion it was noted by City Administrator that an easement for the Water District is one of the conditions of the Ordinance for the subject vacation. The vacation will not become effective until a 20—foot wide easement is retained to the benefit of Metzger Water District and Portland General Electric for the operation and maintenance of their services over the west 20 feet of the area to be vacated. d. Council discussed the easement issue. Councilor Johnson reported that there have been approximately 20 interest applications received for the the City Center Task ' Force. Recommendations for appointments to the Task Force should be completed within the next few weeks. b. Community Development Director reported that Staff has been ' working with Portland State University in determining what their role will be with the newly created Task Force. Mr. Jerry Cach^ of Cash's Reality requested this hearing to vacate m portion of SW 66th Avenue (between Atlanta & Baylor Streets) to facilitate future development of the property. The objections filed by utility companies have been addressed in the conditions attached to the ordinance. Planning Commission and the Community Development Department have recommended approoal. Atlanta Street to S.W. Baylor Street) . BACKGROUND In January of 1980, the City received a request from Jerry Cach of Cash' s Realty, who was representing a local property owner, to vacate the above stated portion of S.W. 66th avenue (see attached map and description) . The City at the time was reviewing the possible vacation of several streets within the area, thus postponing this specific request until the review was complete. Further delays uoourru6 when the applicant temporarily withdrew the request. However, recently the applicant renewed the request and asked the Council to initiate the public vacation process. On January 12, 1087 Council heard this request and by Resolution 87-05 (attached) set the public hearing for February 23^ 1987. ( FINDINGS Planning Commission As required by Title 15.08.090 of the Tigard Municipal Code, the Planning Commission heard the request and at their January 20, 1987 regular meeting, recommended the vacation be approved (see attached memo from the planning staff) . Traffic, pedestrian and bicycle circulation As you can see on the map showing the vacation area, two properties abut this portion of S.W. 66th Avenue on the west side. The southerly parcel is owned by the Tigard Water District and the northerly parcel in a single family residence which in being represented by Jerry Caoh. Both parcels would appear to have access to public streets other than S.W. 66th Avenue, however the northerly parcels access to S.W. Atlanta Street is controlled by the State Highway Division. Access to S.W. Atlanta Street by this particular property is not recommended by the City or State for traffic safety reasons and should be prohibited. This would leave the single family residence without access to a public street, thus it is recommended that the Tigard Water District grant this property owner an easement for ingress egress purposes. The Tigard Water District also requested an easement along this portion of S.W. 66th Avenue for continued access to their property. It should be noted that an easement for their benefit would not be required as title to the vacated street in front of their property would go to them. ' Memo to City Council Page 2 February 17^ 1987 The Tigard Water District has also requested that the southerly 60 feet of the proposed vacation not be vacated. The reason being that the District wants to improve their S.W. Baylor Street frontage to City standards and complete the cul—de--sac between them and Cooper Consultants, Inc. who are on the opposite side of S.W. Bmylor� Street. Cooper Consultants have also made a similar request. The City Engineering Division has just recently received the Tigard Water District' s construction drawings for review and recommends their request to exclude the southerly 60 feet from the vacation be approved. If the above recommendations are adopted, then there will be no negative impacts to traffic' pedestrian or bicycle circulation. Fire and Police Service Responses were received from both the Police Department and the Tualatin Fire District. The Police Department had no concern relative to service or response time. However, the Fire District requested that access to the single family residence via S.W. Baylor Street be retained. H privately maintained driveway access, which was recommended above under "traffic circulation" would be acceptable to the Fire District. < Drainage and Sanitary Sewer Utilities . Drainage and sanitary sewer service in more practically directed away from S.W. 66th Avenue toward the west and south, therefore the Engineering Division is not recommending that an easement be retained for that purpose. Other Utilities Responses were received from the following other utility service provides: Willamette Cable General Telephone Northwest Natural Gas Portland General Electric Metzger Water District Portland General Electric and Metzger Water District do have services within the westerly 20 feet of the area to be vacated. Therefore it is recommended that a 20 foot wide easement be retained to the benefit (grantee) of Metzger Water District and Portland General Electric for the operation and maintenance of their services over the west 20 feet of the area to be vacated. This is the location of our primary access. Furthermore, all of our property is within the City of Tigard and we have made improvements to SW Baylor Street to City standards. Please be advised that the most southerly half of the pro- posed vacation, that portion immediately adjacent to the water district' s reservoir sites on 66th Avenue, is very important to the district in that it provides an access to the reservoirs as shown on the attached drawing. It is requested that this portion not be vacated or that conditions be placed on said vacation to allow the water district continued use of this right-of-way. The most southerly 60 feet of the proposal should not be vacated in any event. The water district has retained Cooper Consultants, Engineers, to design street improvements along the northerly half of S . W. Baylor Street, between 66th and 67th Avenues, as shown on the attached drawings . The cul de sac formed will be brought up to city street standards . Comments are hereby submitted on all three proposed vaca- tions as noted below: a. S. W. 66th & Atlanta Street. While the Tigard Water District owns the two 1-million gallon water tanks and a short stretch of 12-inch water main (including a fire hydrant) along S. W. 66th Avenue, Metzger Water District has an existing 6-inch main along 66th Avenue as shown on the attached drawing. You should verify this with Metzger Water District. In any event, both Metzger and Tigard water districts would desire that provisions be made in any vacation for continued use of this area for existing pipelines. b. S. W. Windsor Place Sewer Easement. That portion of the proposed easement located in the public right-of-way is the exact location where an existing 6-inch main (water) was installed just a few weeks ago. The easement should be on the north side of the road (where the sewer is located) . Please see attached drawings by OTAK Engineers dated May 1985. C. S. W. 99W Frontage (across from Park Street) . Tigard Water District has an existing 12-inch main along the east side of the frontage road. Provisions must be made so that this main can remain or be relocated at developer' s expense. Unless otherwise noted, the vacation requests are for street right-of-ways only at this time. Bishop:Ash Avenue - JB On 4/11/85 a prepetition conference was held. JB was instructed to have McKenzie Engineering file a good map with the City along with JB'n "Intent To Vacate" request. This is on hold for action by JB Bishop, Cherry Street (7410) - Wayne & Joyce Jolly, 3/15/85 prepetition conference was held. On 4/25/85 1 contacted Mm. Jolly and was advised they would contact the City when they were ready to begin the process. On 5/20/85 Ms. Jolly requested a letter from the City noting the responsibility of maintenance for public improvements within a vacated area. On 6/4/85 Randy CIarno responded to her request in writing. Dartmouth Area Vacation - Mozinski - Robert Randall Co. On 1/18/86 a prepetition conference was held. On 2/15/85 Mr. Mozinnki advised me that during' or after' the Dartmouth Street LID process, he would again contact staff to proceed with request. 66th and Atlanta - Jerry : No prepetition conference has been held, Jerry Cach is interested in vacation of a portion of right-of-way in this area. Prepetition conference will he scheduled in the near future. 70th Avenue (Superblocks) - Jerry : No formal prepetition conference has been held. Jerry Cach advised staff in January (1/14/85) of Don PoIlock'm interest in this area. Caoh was advised that staff would discuss with Planning Commission and NPO #4 and contact him with staff' s recommendation for possible vacations in the area. Prepetition conference would then be scheduled with Pollock & Canh. Issue presented to NPO #4 on 6/5/85 by Keith 116th & Katherine - Dale : On 2/15/85 prepetition conference was held. On 4/25/86 Mr. Ott was contacted and advised that he is still interested but would not have time to persue this issue until fall. This vacation would include right-of-way and easements. Ward:130th Avenue - Russ Krueger/Susan On 1/18/85 prepetition conference was held. Russ Krueger will work with Washington County to determine how to proceed, Contacted Russ Krueger 4/25/85 and he stated contact is continuing with Washington County . He will. contact staff when ready to proceed .
