86-025312 ~ Pacific Highway 99W Frontage Road ~ Park Street ^ V�u� � � — � } � ����w ^~ � � � �� CITY 0F,TIGARD' OREGON ORDINANCE NO. 86-_/_/__ ` AN ORDINANCE VACATING A PORTION OF THE 09W FRONTAGE ROAD IN THE VICINITY OF PARK STREET WITHIN THE CITY OF TIGAHD, WASHINGTON COUNTY~ OREGON, AND DECLARING AN EFFECTIVE DATE, WHEREAS' the Tigard City Council initiated this vacation request pursuant to Section 15.08.040 of the Tigard Municipal Code; and _ WHEREAS, the reason and purpose for this vacation is to return a portion of the frontage road along 99W in the vicinity of Park Street to the adjacent property owners to facilitate a commercial development planned for the area; and WHEREAS' the vacation in recommended by the Planning Commission and the City Engineer; and WHEREAS' in accordance with ORS 271. 100' and TMC Section 15.08. 110^ the Council fixed a time and place for the public hearing and the Recorder published notice and posted notice in the area to be vacated; and WHEREAS' notice has been mailed to all property owners abutting said vacation area and all owners in the affected area, as described in ORS 271.080; and WHEREAS' the Council, having held a hearing on April 14' 1986' finds the public interest will not be prejudiced by the vacation as provided by ORS 271.120 and T`MC Section 15.00.130; and WHEREAS' the Council finds that it is in the public interest to approve the request to vacate a portion of the 99W frontage road in the vicinity of Park Street because the public interest will not be prejudiced; and WHEREAS, the Council finds that the following condition is necessary to vacate said land: The vacation shall not be effective until the effective date of this ordinance and it shall not be effective until a certified copy of this ordinance has been recorded with the Washington County Clerk' Assessor, and Surveyor. THE CITY OF TIQARD ORDAINS AS FOLLOWS; Section 1: The Tigard City Council hereby orders the vacation of that portion of the frontage road along 99W in the vicinity of Park Street an described on the attached Exhibit ''A" and shown on the attached Exhibit "B" , and by this reference made parts hereof. Section 2: The Tigard City Council further orders that the vacation be subject to the following condition: ORDINANCE NO, 86- Page 1 -+—�-- lw/3750A , . . Frontage Road Street Vacation I recommend the vacation known as "S.W. Pacific Hwy. Frontage Road Street Vacation" be approved without special conditions. This recommendation is based on the following findings: (a) There is no effect on traffic, pedestrian, or bicycle circulation. No response was received from fire or police relative to response time. Drainage in the area can be adequately provided for without use of the street right-of-way. No response was received from any utility company relative to existing or proposed facilities; (b) The proposed vacation is not contrary to the transportation element of the Comprehensive Plan; and, (c) The vacation is not contrary to the Capital Improvement Plan. Comments are hereby submitted on all three proposed vaca- tions as noted below: a. S. W. 66th & Atlanta Street. While the Tigard Water District owns the two 1-million gallon water tanks and a short stretch of 12-inch water main (including a fire hydrant) along S. W. 66th Avenue, Metzger Water District has an existing 6-inch main along 66th Avenue as shown on the attached drawing. You should verify this with Metzger Water District. In any event, both Metzger and Tigard water districts would desire that provisions be made in any vacation for continued use of this area for existing pipelines. b. S. W. Windsor Place Sewer Easement. That portion of the proposed easement located in the public right-of-way is the exact location where an existing 6-inch main (water) was installed just a few weeks ago. The easement should be on the north side of the road (where the sewer is located) . Please see attached drawings by OTAK Engineers dated May 1985. C. S. W. 99W Frontage (across from Park Street) . Tigard Water District has an existing 12-inch main along the east side of the frontage road. Provisions must be made so that this main can remain or be relocated at developer' s expense. WHEREAS, prior to 1977 the State of Oregon, by and through its Department of Transportation, Highway Division, (hereinafter "State") relocated the Park Street-Watkins Avenue section of Pacific Highway West, State Primary Highway No. 1W, (hereinafter "Pacific Highway West") in Washington County, Oregon; and WHEREAS, that by reason of the relocation of the Park Street- Watkins Avenue section of Pacific Highway West, the following described section of the right-of-way of the former route of the highway was no longer needed by the State, to-wit: All of the land within the right-of-way boundaries of the Pacific Highway West, State Primary Highway No. 1W, as formerly routed lying outside the southeasterly right-of-way boundary of said Pacific Highway West, as now relocated from approximately opposite relocated highway engineers stations 119+00 to 134+50, and lying in Section 2 , Township 2S, Range 1W, Willamette Meridian, Washington County, Oregon. The state agrees to accept the property as an eliminated section of a highway and to determine, pursuant to ORS 366 . 300 (2) , that the Property is no longer needed for right-of-way purposes, and that the portions of the Property to which the State did not hold deeded title shall vest in the abutting landowners; and 2. The State agrees to dispose of the Deeded Portion of the Property pursuant to ORS 366. 395 in such a manner to preserve enforceable access to the adjoining landowners. BE IT FURTHER RESOLVED, that upon the fulfillment of the above conditions, the City of Tigard shall adopt a Resolution transferring the Property to the State, and the City of Tigard , shall authorize and direct the Mayor and City Recorder to execute on behalf of the City of Tigard a Relinquishment of Title relinquishing the Deeded Portions of the Property to the State. If the Council does -, desire to commence proceedings to relinquish the right-of-way, or to explore the feasibility of such proceedings, it should adopt the attached resolution. Adoption of the attached resolution does ;-not relinquish the right-of-way. The resolution merely indicates that the city is willing to undertake such relinquishment if the .conditions listed in the resolution are fulfilled. B. Bishop in regard to property located southeast of Pacific Highway West in Tigard, Oregon, near the intersection of Park Street and Pacific Highway West (roughly across from Pietro ' s Pizza) . The City of Tigard owns a strip of property located between our client' s property and Pacific Highway West, as illustrated on the enclosed drawing. The City of Tigard acquired this property pursuant to an Agreement with the State of Oregon, acting by and through its Department of Transportation, dated January 6 , 1977 , relating to the elimination and dis- position of a portion of the right-of-way of Pacific Highway West which was no longer needed by the State due to the relocation of Pacific Highway West. Pursuant to this Agreement, the Department of Transportation adopted Abandonment and Retention Resolution No. 560 , relinquishing the following described property to the City of Tigard: "All the land within the right-of-way boundaries of Pacific Highway West, State Primary Highway No. 1W, as formerly routed lying outside the southeasterly right-of-way boundary of said Pacific Highway West, as now relocated from STOEI:,RivEs,BOLEY,FRASER AND WYSE Mr. Frank Currie March 5, 1982 Page 2 approximately opposite relocated highway engineers station 119+00 to 134+50 , and lying in Section 2 , Township 25, Range 1W, Willamette Meridian, Washington County, Oregon. " (the "Relinquished Property" ) The portions of the above described property to which the State of Oregon held deeded title, shown in red on the attached drawing, were conveyed to the City of Tigard by a Relinquishment of Titled dated April 5, 1977 (the "Deeded Property" ) . The documents transferring the Relinquished Property to the City of Tigard require the Relinquished Property to continue to be used for public purposes and require the City of Tigard to maintain the Relinquished Property as part of the City' s public street system. Our client and the other landowners whose properties abut the Relinquished Property desire to acquire the Relinquished Property for use in connection with the development of their properties. I understand that our client has discussed this matter with you. It is also my understanding that the City of Tigard does not wish to continue ownership of the Relinquished Property and would be willing to allow the abutting property owners to acquire the Relinquished Property. Since the documents conveying the Relinquished Property to the City of Tigard require continued public use of the Relinquished Property, I do not believe the City of Tigard can convey the Relinquished Property to the abutting landowners . In order to allow the abutting landowners to acquire the Relinquished Property, I propose that, in cooperation with the Department of Transportation, the following steps be followed: 1) The City of Tigard relinquish the Relinquished Property back to the State of Oregon; 2) The Department of Transportation determine that the Relinquished Property is no longer needed or valuable for public purpose; 3) The portions of the Relinquished Property which are not Deeded Property would, by virtue of ORS 366 . 300 (2) , automatically vest in the abutting landowners; and STOEIC,''IIVEs,BOL-EY,FRASEIR AND WY.SE Mr. Frank Currie March 5, 1982 Page 3 4) The Department of Transportation would dispose of Deeded Property in accordance with the normal methods for disposal of state property. Before we can proceed along the lines referred to above, we need to confirm that the City of Tigard does not wish to continue ownership and maintenance of the Relinquished Property, and is willing to cooperate in transferring the ownership of such property to the abutting landowners . our client is in the process of confirming development plans for his property and we would like to proceed with the transfer to the abutting landowners as soon as practicable.
