THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council finds that a resolution was adopted by the
Council on November 27, 1972, pursuant to chapter 271.130
QRS, whereby the Council initiated vacation proceedings with respect
to the hereinafter described dedicated unopened portion of a public
way and that a public hearing was thereby called to be held on
January 8, 1973 and that notice of said hearing was given as required
by chapter 271. 110 ORS as set forth in said resolution.
Section 2 : The Council further finds that a public hearing as
thereby called to be held, was duly and regularly held ;
at the regular Council meeting on January 8, ' 1973 at which time
and place the Council afforded all interested persons an opportunity
to be heard for or against the proposed vacation of said lands, and
the Council further considered all objections thereto.
Section 3: The Council further finds that a majority of the owners
of the area affected by said proposed vacation, computed
on the basis provided in Chapter 271.080 ORS, did not abject thereto
in writing and that all Viers affected thereby did, in fact, favor
the vacation of said area; and the Council finds that said vacating
will not substantially affect the market value of any abutting property.
Section 4: The Council further finds that the public interest will
not be prejudiced by the vacation of the hereinafter
described lands and that said lands are not useful as part of the
public street or road system of the City of Tigard and that it is in
the public interest that said vacation be approved.
Section S: The Council further finds that the City recording officer
has filed in her office a certificate showing that all
city liens and taxes have been paid on the lands proposed to be
vacated.
t Section 6: The Council finds that the area proposed to be vacated
may be subject to easement (s) for sewer lines, water
lines, electrical or telephone or other utility uses now present or
installed thereon, and such pre-existing easement (s) rights should be
preserved.
Section 7: Subject to pre-existing easement rights, if any, for
' sewer, water, telephone, electrical or other utility
'r purposes now present on the hereinafter described lands which rights
are hereby expressedly excepted from the legal effect of this ordinance,
the following described portion of dedicated, unopened street be,
and the same is, hereby vacated and the rights of the general public
therein and thereto for street and road purposes are hereby annulled
and held for naught:
That portion of roadway situated in Section 1, Township
2 South, Range 1 West, Willamette Meridian, Washington
County, Oregon, being more particularly described as follows:

• A strip of lana (now known as S.W. IR'VING STREET, old
NINTH STREET) lying parallel to, along the North side and
within thirty (30) feet, when measured at right angles, of
the South line of WEST PORTLAND HEIGHTS, a subdivision
of record in said County. EXCEPTING, that portion thereof
lying Easterly of a Southerly extension of the East
boundary line of Block 37 of said subdivision.

Section 8: That the City Recorder be, and she is, hereby authorized
and directed to have a certified copy of this ordinance
filed for record with the following Washington County departments:

1. Department of Records and Elections
2. Department of Revenue and Taxation-Attn: Assessor
3. Department of Public Works-Attn: County Surveyor
all as required by Chapter 271. 150 ORS.
Section 9: This ordinance shall be effective on and after the 31st
day after its enactment by the City Council, and approval
by the Mayor.
PASSED: BY unanimous vote of all Council members present,
after being read three times by number and title only, this
22nd day of January i, 1973.

application for conditional use, therefore, would only
apply to the M-3 zone portion of the property.
(f) Motion by Councilman Norton that the findings of the Tigard
Planning Commission be sustained to deny the request, and
that the Council further finds the use as applied for,
cannot be the solt. use on the subject land in accordance
with the conditional use provisions of M-3 or M-4 zoning
as established by the Tigard zoning ordinance.
Motion approved by unanimous vote of Council. Findings
of the Planning Commission as amended by the Council were
upheld and the appeal denied,
17. VACATION OF DEDICATED UNOPENED PORTION OF S.W. IRVING STREET
(a) Staff report given by City Planner.
(b) Public Hearing 8000 P.M.
No Testimony
Public Hearing Closed.
(c) City Attorney questioned if there were any water or sewer
easements in the right-of-way of the proposed vacation.
• City Planner stated there were utilities in the roadway
and recommended proposed ordinance be amended to reserve
the public easement.
(d) Motion by Councilman Bergmann to table to next regular
Council meeting, January 22, 1973, seconded by Councilman
Moore.
Approved by unanimous vote of Council.
18. RESOLUTION No. 73-2 R. I.'D. E, AGREEMENT BETWEEN WASHINGTON
COUNTY AND CERTAIN CITIES THEREOF INCLUDING
THE CITY OF TIGARD.
(a) City Administrator recommended adoption of resolution and
approval of agreement.
(b) Motion to adopt: Councilman Cook$ seconded by Councilman
Moore.
Approved by unanimous vote of Council.

various aspects of your proposed addition. . The matter of
street vacations should he handled as follows: Irving
Street can, and should he, vacated and I would suggest you
write a. letter to my attention requesting the City Council
initiate vacation pr6cedi,ngs. As we discussed on the telephone
several days ago, the matter of the westerly 20 feet of block; 38
and the southerly 20 feet of- Hampton Street should perhaps be
handled at a later date. it would be most agreeable to the
City Planning staff to seek a dedication from the, easterly
portion of block 39 and vacate a similar portion on the
westerly margin of block. 38 in order to center the right-of-way
in 68th in order to accomplish the proposed future access to
the Farmer's insurance property. she kampton Street vacation
should probably not be accomplished instil we are certain of the
ultimate development of the properties north. of Lamb Weston.
Your zoning on block 38 and 39 will have to be changed. it- is
our intention to have the Planning Commission initiate this
effort in order to change the zoning can the Lamb weston and
Farmer's property to C-F, Co 4erci.al-Professional zone, in which
your land use would be an outright permitted use. The Tigard
Planning Commission will initiate such action at their meeting
Tuesday night, July 18th.
Your question with respect to suer connections can be answered
only after more detailed plans are available indicating the total
additional plumbing facilities, if any. Unified Sewerage
Agency policy requires a recalculation of connection charges when
thane is an additional sanitary sewage head being introduced to
the system. This method does provide credit for previous connection

fees. As we have discussed previously, it would be desirable
to merely close: off the existing sewer lane in 67th so that it
noes not harper the construction of your building addition..
The ratter of water will have to be handled with the Metzger
Water District. Incidentially, I am still curious as to what
your grater pressures are, both from the standpoint of fire
protection and domestic use.

Dear Steve:
We just picked up the option on the Wardin two acres, Block 39 of Wast
Portland Heights for additional parking. Is Block 39 properly zoned
for our purpose? Please confirm that we have been zoned correctly
for Block 38 (our parking) and Block 37 (office building and research
lab) .
Could we have copies of the sat-back limitations on Blocks 37,38 and 39Y
Within a year we will be constructing an addition to our present building
for an additional 60 to 70 employees. Will we be covered under our
sewer and water use permits?
In regard to building over the water main and sewer line on 67th, Bob
Hill informed us that the sewer would have to be cut off for the portion
under the building on 67th and that we could empty into it at the south-
west corner of the new building. What about the emergency water mains
down 67th? Can we build over them?
Is there anything else we should be apprised of before we sit down with
the architect?
