7 This matter having come on regularly before the Board at
8 its meeting of July 3, 1973; and
9 It appearing to the Board that this matter came on regularly
10 and was considered by this Board at its regular meeting of the
11 26th day of June, 1972; and
12 it appearing to the Board that a petition has been filed for
13 the vacation of a portion of Inez Street, lying between Lots 32
14 and 36, the duly recorded plat of Tigardville Heights, Washington
15
County, Oregon, and that said petition has been signed by William J.
'
16 Frederick, Jr. and Irene G. Frederick, husband and wife; Herbert H.
17 Knebel, Jr. and Maxine Knebel, husband and wife; Charles L. Bloodgood
18 and May K. Bloodgood, husband and wife; Ellis H. Mathis and
Melba R. Mathis, husband and wife; Jerald R. Heater and Colleen
19
20 L. Heater, husband and wife; and Fred E. Treaux and Sylvia V.
Treaux, husband and wife; and
21
22 It appearing to the Board that the road to be vacated is not
23 within the corporate limits of any city or town; and

24 It appearing to the Board that the only parties that would be
particularly affected by the said vacation are the petitioners who
25
own all the land adjacent to and affected by the said proposed

oIt appearing to the Board that all owners of the property

immediately adjoining the road to be vacated have duly acknowledged

30 the petition for vacation of the consideration and same are the
only persons particulary affected by the proposed vacation of said
31 i
32 portion of Inez Street proposed to be vacated and as defined by

1 ORS 271.020; and
2 It appearing to the Board that said petition did describe
3 the portions of the street to be vacated, the names of the parties
4 to be particularly affected thereby, and set forth the particular
5 circumstances of the case; and it appearing further that notice
6 of the pendency of said petition was given by written notice being
7 posted more than thirty days prior to the date of the hearing, said
8 notices being posted in three of the most public and conspicuous places
9 within the limits of said road as shown by the affidavit on file
10 herein; and
11 It appearing to the Board that the notice contained a description
12 of the portion of said street to be vacated and gave the date of
13 June 26, 1973, at 7:30 o'clock p.m. as the time, and Room 402 of ..he
14 Washington County Administration Building, Hillsboro, Oregon, as the
15 place for hearing the matter and remonstrances thereto and no remon-
16 strances having been made; it is, therefore
17 RESOLVED AND ORDERED that that portion of Inez Street, lying
18 between Lots 32 and 36, Tigardville Heights, a duly recorded plat in
19 Washington County, Oregon, be and hereby is, vacated upon the condition;
20 that the owners of the property adjacent to the street to be vacated
21 make and file a deed of dedication to the public of 20 feet on each
22 side of the centerline of the existing street proposed to be vacated 4
23 and agree therein to never revoke same and that such shall constitute
24 a continuing offer of dedication which may be at any time in the
Z 25 discretion of Washington County, accepted as a public road, filing

26 and acceptance of said deed is hereby acknowledged; and it is further
27 RESOLVED AND ORDERED that the County Curveyor of Washingtcn
s
28 County, Oregon, be, and hereby is, authorized and directed to inark
r 29 said street as vacated on the plats and records of Washington County,
30 Oregon, and to file the deed of dedication hereinabove referred to
31 in the Deed Records of Washington County, Oregon; and it is further
32 RESOLVED AND ORDERED that the Director of Records and Elections !

1 of Wa6hington County, Oregon, is hereby authorized and directed
2 to collect from petitioners herein, the required statutory fees
3 for payment to the Surveyor as Surveyor's Fees and payment to the
4 Recorder as Recorder's Fees and have this order of vacation recorded
5 in the records of Washington County, Oregon.
