APPLICATION SUMMARY FILE NAME: BCS DEVELOPMENT, LLC CASE NO.: Lot Line Adjustment(LLA) LLA2016-00010 Development Adjustment(ADJ) ADJ2016-00117 PROPOSAL: The applicant is proposing a lot line adjustment affecting two properties: WCTM 2S103CA,Tax Lot 101 (Parcel 1);and 13185 SW 115th Avenue;WCTM 2S103CA, Tax Lot 110 (Parcel 2). As a result of this lot line adjustment, Parcel 1 will be 18,077 square feet in size, and Parcel 2 will be 12,691 square feet in size. This proposal is the first in a series of three applications for lot line adjustments. The applicant ultimately proposes to reconfigure Parcels 1, 2, and an adjacent property (WCTM 2S103CA, Tax Lot 111), in order to accommodate the future construction of two new detached, single-family homes. In addition, the applicant requests one development adjustment to reduce the rear yard setback for Parcel 2 from 15 feet to 12 feet(20%). The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370.020.B, 18.410.040 LL-12016-00010 and ADJ2016-00117 BCS Development,LLC 1 SECTION IL DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the west side of SW 115th Avenue, north of SW Gaarde Street, and south of SW Fonner Street. Parcel 1 is currently a vacant lot that has approximately 25 feet of direct frontage along SW 115th Avenue. Parcel 2 has approximately 125 feet of direct frontage along SW 115th Avenue, and is currently occupied by a detached, single-family dwelling with attached garage, a paved driveway, and associated landscaping. Both parcels are zoned Low-Density Residential (R-4.5), as are surrounding properties. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.410 Lot Line Adjustments: 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created as a result of this lot line adjustment. Parcel 1 will be 18,077 square feet in size, and Parcel 2 will be 12,691 square feet in size. Accordingly, both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for detached units. This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; As a result of this lot line adjustment, Parcel 2 will be reduced in size from 19,565 square feet to 12,691 square feet.The applicant has also submitted a request to reduce the rear yard setback for Parcel 2 from 15 feet to 12 feet (20%), which is addressed below under TDC 18.370 Variances and Adjustments. Taking into consideration this development adjustment request, staff finds this lot line adjustment will not result in any violations of the site development or zoning district regulations for the R-4.5 zone. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; LLA2016-00010 and ADJ2016-00117 BCS Development,LLC 2 The average minimum lot width for the R-4.5 zone is 50 feet for lots with detached units. Staff reviewed the applicant's submitted site plan to confirm the lot widths for both parcels exceed 50 feet. Therefore, this criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the access way may not be included in the lot area calculation; Parcel 1 will be 18,077 square feet in size, and Parcel 2 will be 12,691 square feet in size. Accordingly, both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for detached units. In addition, the applicant is not proposing to create any flag lots with this lot line adjustment. This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and As a result of this lot line adjustment, Parcel 1 will have more than 15 feet of direct frontage along SW 115th Avenue, and Parcel 2 will have approximately 100 feet of direct frontage along SW 115th Avenue. This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Parcel 1 currently does not contain any structures; accordingly, compliance with minimum setback requirements for the R-4.5 zone will be confirmed prior to building permit submittal. Parcel 2 contains a detached, single-family dwelling with attached garage. As a result of this lot line adjustment, Parcel 2 will be reduced in size from 19,565 square feet to 12,691 square feet. Accordingly,the applicant has also submitted a request to reduce the rear yard setback for Parcel 2 from 15 feet to 12 feet (20%),which is addressed below, under 1'DC 18.370 Variances and Adjustments. Taking into consideration this development adjustment request, staff finds that all existing structures on Parcel 2 meet the minimum setback requirements for the R-4.5 zone.This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots as a result of this lot line adjustment. Therefore, these criteria do not apply. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot line adjustment. In addition, fire hydrants are already in place.This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing to create a common drive to serve more than one lot with this lot line adjustment. This criterion does not apply. LLA2016-00010 and ADJ2016-00117 BCS Development,LLC 3 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. As a result of this lot line adjustment, Parcel 1 will have more than 15 feet of direct frontage along SW 115`h Avenue, and Parcel 2 will have approximately 100 feet of direct frontage along SW 115`h Avenue. This criterion is met. B. Exemptions from dedications.A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. No floodplain,greenway,or right-of-way dedication will be required as part of this lot line adjustment application. C. Variances to development standards.An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. (Ord. 09-13) The applicant has also submitted a request to reduce the rear yard setback for Parcel 2 from 15 feet to 12 feet (20%). This development adjustment is addressed below,under 1'DC 18.370 Variances and Adjustments. 18.370 Variances and Adjustments 18.370.020.B Development Adjustments. 1. The following development adjustments will be granted by means of a Type I procedure, as governed by Section 18.390.030, using approval criteria contained in paragraph 2 of this subsection B: a. Front yard setbacks. Up to a 25% reduction of the dimensional standards for the front yard setback required in the base zone. Setback of garages may not be reduced by this provision. b. Interior setbacks. Up to a 20% reduction of the dimensional standards for the side and rear yard setbacks required in the base zone. c. Lot coverage. Up to 5%increase of the maximum lot coverage required in the base zone. The request is to reduce the rear yard setback for Parcel 2 from 15 feet to 12 feet (20%), which meets the description of 18.370.020.B.1.b. This request is a development adjustment and is being processed through a Type I procedure. 2. Approval criteria. A development adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: a. A demonstration that the adjustment requested is the least required to achieve the desired effect; The applicant requests to reduce the rear yard setback for Parcel 2 from 15 feet to 12 feet (20%). The purpose of this development adjustment is to accommodate a larger building envelope on Parcel 1, for the future construction of a detached, single-family home of a particular design. Staff has evaluated the applicant's submitted site plan and narrative to determine that this adjustment is the least required to achieve the desired effect. This criterion is met. b. The adjustment will result in the preservation of trees, if trees are present in the development area; There are no trees present in the relevant development area. This criterion does not apply. c.The adjustment will not impede adequate emergency access to the site; LLA2016-00010 and ADJ2016-00117 BCS Development,LLC 4 Staff reviewed the applicant's submitted site plan to determine the proposed adjustment will not impede adequate emergency access to the site. In addition, the subject property has approximately 100 feet of direct frontage along SW 115th Avenue.This criterion is met. d.There is not a reasonable alternative to the adjustment which achieves the desired effect. The applicant requests to reduce the rear yard setback for Parcel 2 from 15 feet to 12 feet (20%). The purpose of this development adjustment is to accommodate a larger building envelope on Parcel 1, for the future construction of a detached, single-family home of a particular design. As demonstrated above, the applicant's proposal complies with the 20% reduction for rear yard setbacks. There is not a reasonable alternative to the proposed adjustment which achieves the desired effect. This criterion is met FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments and Development Adjustments are either met, satisfied through conditions of approval, or do not apply.The proposal is in compliance with the applicable requirements of this Tide. The Lot Line Adjustment exhibits and legal descriptions, prepared by a Professional Land Surveyor, are as follows: Lot Line Adjustment 1: LLA2016-010 between Tax Lots 101 & 110. The following are the required findings per Chapter 18.410. Chapter 18.410 Lot Line Adjustments 18.410.010 Purpose The purpose of this chapter is to provide rules, regulations and criteria governing approval of lot line adjustments. COMMENT: The applicant is requesting a 3-phase Lot Line Adjustment application. The adjustments are as follows: Lot Line Adjustment 1: LLA2016-010 between Tax Lots 101 & 110. Lot Line Adjustment 2: LLA2016-012 between Tax Lots 101 & 111. Lot Line Adjustment 3: LLA2016-013 between Tax Lots 101 & 110. 18.410.020 Approval Process A. Decision-making process. Lot line adjustments shall be reviewed by means of a Type I procedure,as governed by Chapter 18.390, using approval criteria contained in Section 18.410.040. COMMENT: Lot Line adjustments 1, 2 & 3 are being processed through separate Type I applications. B. Time limit on approval.The lot line adjustment approval by the director shall be effective for a period of 1-1/2 years from the date of approval. C. Lapsing of approval.The lot line adjustment approval by the director shall lapse if: 1. The lot line adjustment has been improperly recorded with Washington County without the satisfactory completion of all conditions attached to the approval; or 2. The final recording is a departure from the approved plan. D. Extension.The director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year provided that: 1. No changes are made on the original plan as approved by the director; 2. The applicant can show intent of recording the approved partition or lot line adjustment within the one year extension period; and 3. There have been no changes in the applicable comprehensive plan policies and ordinance provisions on which the approval was based. Page 3 COMMENT: The applicant intends to complete and record the lot line adjustments in a timely manner prior to expiration. 18.410.030 Application Submission Requirements A. General submission requirements.All applications shall be made on forms provided by the director and shall include information required for a Type I application, as governed by Chapter 18.390. B. Specific submission requirements.All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the director. COMMENT: The applicant has submitted the required materials including lot line maps with legal descriptions, other exhibits and this narrative. 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment,and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. COMMENT: No new parcels are created through these lot line adjustments. All adjustments are in compliance with the minimum 7,500 sq. ft. lot area standard. 2. By reducing the lot size,the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. COMMENT: The common lot line between existing residence on Tax Lot 110 and Tax Lot 101 will be reduced to 12-ft. upon approval of a related rear yard setback adjustment. All other setbacks are in compliance with the standards of the R-4.5 zone. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; COMMENT: All three parcels will have a minimum 50-ft. lot width. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the accessway may not be included in the lot area calculation; Page 4 COMMENT: All three parcels exceed the minimum 7,500 sq. ft. lot area standard of the R-4.5 zone. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement;and COMMENT: Tax Lots 101 & 111 are flag lots with a minimum 15-ft.frontage on SW 115th Avenue. d. Setbacks shall be as required by the applicable zoning district. COMMENT: The residences on all three parcels will comply with the setback standards of the R-4.5 zone subject to approval of the requested rear yard setback adjustment. 4. With regard to flag lots: a. When the partitioned lot is a flag lot,the developer may determine the location of the front yard, provided that no side yard is less than 10 feet.Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within 10 feet of an abutting lot in accordance with Section 18.745.050.Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. COMMENT: Setbacks on Tax Lots 101 & 111 will be determined prior to building permit issuance. The shared driveway will be screened from adjacent Tax Lot 110 with an existing landscape strip. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. COMMENT: A fire hydrant is located across SW 115th Avenue. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. COMMENT: A reciprocal access easement will be recorded over the shared access on Tax Lots 101 & 111. Page 5 7. Any accessway shall comply with the standards set forth in Chapter 18.705,Access, Egress,and Circulation. COMMENT: No accessways are proposed or required. B. Exemptions from dedications.A lot line adjustment is not considered a development action for purposes of determining whether floodplain,greenway, or right-of-way dedication is required. COMMENT: This project is exempt from the requirement for dedication of additional right-of-way. C. Variances to development standards.An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. Recording requirements.
