Also requested is minor land partition approval to divide the resultant 22,770 square foot lot into three parcels of 7,590 square feet each. Access to the parcels would be provided by an access easement on adjacent tax lot 4104 to the west. Locations 7517 SW Landau Street (WCTM 1S1 25CD, tax lots 4100 and 4103). Zones R-4.5 (Residential, 4.5 units/acre. DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above application subject to conditions. The findings and conclusions on wtich the decision is based are noted below. A. FINDING OF FACT 1. Background The subject parcels were annexed to the City of Tigard through the Northeast Metzger annexation in November, 1987 (ZCA 87-05) . A lot line adjustment for adjacent tax lots was approved in January, 1989. No other land use applications for these parcels have been reviewed by the City. 2. Vicinity Information North of the subject parcels the properties are zoned R-4.5. Properties adjacent to the subject parcel to the south, east, and west are located in Washinc±ton County and zoned R-5 for single family residences. Further to the west properties are also zoned R-4.5. The applicants own about 7 acres in this area including the subject parcels. 3. Site Information and Proposal Description The remains of a house and attached garage recently destroyed by fire are located on the front or south portion of the site on tax .Ivt 4100. To the rear or north on tax lot 4103 is a single family dwelling. Between these is a shed. A few fir, cedar, fruit and deciduous trees are scattered over the site and along the Landau Street frontage. A rhododendron hedge is also situated along a portion of the Landau Street frontage. The applicant proposes to move the common lot line between lots NOTICE OF DECISION - MLP P9-.20/M 89-27 - BURNF.SS PAGE 1 4103 and 4100 16 feet to the north resulting in a reduction in size from 10,005 to 8,165 for tax lot 4103 and an increase in size from 20,930 to 22,770 square feet for tax lot 4100 (see exhibit A) . Tax lot 4100 is then to be divided into three 7,590 square foot parcels. Access to all parcels will be provided by do access easement to-meted on tho adjacent tax lot 4104 to the west. 4. Agency and NPO Comments The Engineering Division has the following comments: a. Access for the lots is provided by a common driveway connecting to SW Landau Street, a local street with an existing right-of-way of 60 feet. The 24 foot driveway shown on the site plan meets the requirements of Section 18.108.070 of the Tigard Municipal Code. b. SW Landau Street is e,n unimproved County road. Subsection 16.164.030.A of the :ode pez.nits the Director to accept a future improvement guarantee in lieu of street improvements on property zoned residential. The proposed land partition does not create any new streets, however, a paved surface for two- ;,ay trt,ific should be provided. C. Sanitary sewer service is available from a sewer accepted by the Unified Sewerage Agency in May, 1988. However, the line is not within a public easement. Extensior of the line is not required as long as each proposed lot has a connection to it, since there is an existing line in S.W. Landau Street. The Building Division notes that it is necessary that the applicant remove the remains of the house that was burned and that the sewer be c&ppea off and inspected by the City. Utility easements must be provided and a joint use and maintenance agreement for the driveway must be executed. Washington County makes the fallowing recommendations: a. r-.ior to final approval and issuance of building permits the applicant should: i. Sign a waiver not to remonstrate against the formation of a local '.mprovement district or other mechanism to improve ;-.nd maintain SW Landau Street to County standards, between the site's east property line and SW 77th Avenue. ii. Submit plans, obtain County Engineering Division approval, provide financial assurance, and obtain a Facility Permit for the following public i.mprovemrsnts: 1) a concrete sidewalk at ultimate location and grade along SW Landau Street frontage, with paved tie-ins to the NOTICE OF DECISION - MLP 89-20/M 89--27 - BURNESS PAGE 2 roadway edge, 2) adequate roadway drainage along SW Landau frontage, 3) a 22 foot paved width and a wearing surface and life expectancy of not less than five years on SW Landau between the site's east property line and SW 77th, and 4) private street Fccess to SW Landau. Prior to occupancy all road improvements to SW Landau shall be completed and aceeF -able to the County. Metzger Water District has no object .one to the proposal but does mention that due to possible future. property development, this project mit be required to extend the water line in order to serve this property. Portland Genera'_ Electric and the Fire Marshal have reviewed the proposal and have no objections to it. No other comments have been received. ANALYSIS AND CONCLUSION Section 18.162. 060 (Lot Line Adjustments: Approval Standards) of the Community Development Code contains the standards of approval for a lot line adjustment, they are as follows: 1. An additional lot is not crated by the lot line adjustment, and the existing parcel reduced in size by tt.e adjustments is not reduced below the minimum lot size established by the approved zoning for that district. 2. By reducing the lot size, the lot or structures) on the lot will not be in violation of the site development or zoning district regulations for that district. Lot line adjustment M 89-27 satisfies the above criteria. No additional lot is being created by the lot line adjustment. The applicant is also applying for a minor land partition as discussed below. Tax lot 4103 is reduced in size to 8,165 square feet, thus exceeding the 7,500 square foot minimum lot size of the R-4.5 zoning district. No structures or lots will be in violation of the site development or zoning district regulations as a result of the lot line adjustinent. The proposal must also meet the minor land partition criteria of Section 3.8.162.040 (Partition Approval Criteria) . They are as follows: 1. The proposal conforms with the City's comprehensive plan; 2. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and appli.cable agency standards. The proposal conforms with the City's Comprehensive Plan. it complies with all statutory and ordinance requliaments and regulations except as noted below. Adequate public facilities are available to serve the proposal. The lots conform to the size and dimensional requirements of the R-4.5 zoning district. Proposed improvements meet City and applicable agency standards. Existing Buildings Two existing buildings, a shed and the burnt house, will be in violation of the setback requirements if they are allowed to remain on the property. The applicant has indicated on the site plan that lie intends to remove both structures. The Building Division indicates thLt a demolition permit has been issued for this purpose. Approval of the minor land partition shall be s,:njet;t to the condition that these buildings be removed prior tc, record -ng the partition with Washington County. Tree Removal The applicant must apply for a tree removal permit prior to removing any trees with a six inch diameter or greater at four feet above ground level. Staff encourages the applicant to preserve the assortment of trees established on the subject parcel. C. DECISION The Planning Director's designee for the City of Tigard approves MLP 89- 20 and M 89-27 subject to the following conditions: 1. A partition survey plat clearly showing all newly created parcels as well as the adjusted lot line and an outbound description shall be submitted to the Engineering Division before recording. The plat shall clearly show: a. The access f-asement as well as ownership and maintenance responsibilities, and b. A permanent exclusive 15-foot wide public sanitary easement extending across Parcel "B".
