The findings and conclusions on which the decision was based are -71t�(� �, noted below: A. FINDING OF FACT 0"; 1. Background The plan for NPU #5 was adopted by the City Council on August 22, 1977. The plan and corresponding zoning designations selected for the area of the subject site were Tndustria.l Park (M-4) on the north side of Sandburg Street and Heavy Industrial (M-2) to the south. Both of these zoning districts allowed for both commercial office and -industrial uses. During the city-wide review of the Comprehensive Plan in 1983, the zoning for the subject property, along with several other parcels receiving access from Sandburg Street, was changed to r-P (Commercial Professional) . Along with the change in map designation, the list of permitted uses in the C-P zone was reduced. The C-P zone does not allow industrial uses that were previously allowed in the former M-2 zone. in September, 1985, the City Council reviewed a proposed Plan Map redesignation of 21 tax lots that have access to Sandburg Street from Commercial-Professional to Light Industrial, and a zone change from C-P to 1-P. The Council approved the redesignation for only 7 of the parcels, not including the subject property (CPA 5-85) . No other land use or development applications involving the suhject parcel have been reviewed by the City of Tigard. 2. Vicinity ]Information Properties to the north and south are also zoned C-P and contain a variety of office uses. Properties to the east are zoned I-P and include a variety of industrial uses. The adjacent parcel to the east contains the Gould Pump Company. Across SW 72nd Avenue from the subject site is a vacant parcel that in zoned I-P which is a part of the Tech Center Industrial Park. Properties to th- NOTICE OF DECISION - SDR 90-0012 - McKENZIE-SAITO/MCCORMACK PACE 7 northwest are zont-6 C-P and presently contain Bingle-family residences or are vacant. SW 72nd Avenue abutting the site .is a 44 foot wide paved major (-ollector street that includes curbs and storm drainage. A sidewalk does not exist on either side of the street. SW Sandburg Street, abutting the north side of the site, is a fully improved local street- with sidewalks on both sides. 3. Site Information and Proposal The 1.8 acre parcel presently contains the 14,432 square foot combination office/storage building. A 60 Bpace parking lot is located on the north side of the parcel. One access driveway connects the parking lot with SW Sandburg Street. The site contains a large amount of relatively mature landscape materials including several large trees along the SW 72nd Avenue frontage of the site and a series of Oak Btreet trees along the Sandburg Street frontage. The applicant proposes to remodel the existing building int(- an office building for a building contractor and construction management firm. A portion of the existing storage area would be used for storage purposes by this company. Approximately 4,000 square feet of the existing storage area would be modified for leasing to another use. The applicant also proposes construction of a new 14,000 square foot single story flex space building on the east edge of thin rite. The plans tnclude expansion of the existing parking area to surround the existing building with parking requiring removal of a substantial. amount of present landscape materials. Two new access driveways from Sandburg Street to the parking lot wot:ld be provided. Also proposed is a new driveway and truck maneuvering area on the far eastern edge of the site to serve a number of overhead doors on the new flex space building. In addition, one loading dock would be provided on the west side of the new building immediately abetting the southern property line. 4. Ageruy and NPO Comments The Engineering Division has reviewed the proposal and provided the following comments: I. The applicant has submitted a preliminary site and landscaping plan. 2. The site abuts SW 72nd Avenue and SW Sandburg StreeL-. SW 72nd Avenue is a major collector requiring 60 foot right-of-way. The existing right-of-way along the frontage of the site is 25 feet from centerline. Five feet of additional right-of-way should be provided as a condition of development approval. NOTICE OF DECISION - SDR 90-0012 - McKENZIE-SAITO/McCORMACK PAGE 2 3. The street is fully improved except for a sidewalk and conversion of overhead utilities. Immediate construction of a sidewalk is not recommended since there are no sidewalks to the north or south to connect to and it would require removal of a large cedar and two Giant Sequoia trees that exceed five feet in diameter. Construction should be delayed until the trees have been removed or the sidewalk .is needed to connect to other sidewalks constructed along the east side of SW 72nd Avenue as development occurs. SW Sandburg Street is fully improved with cu--Io and sidewalks within a 50 foot wide right-of-,:,ty. 4. Access to the site is providad by two proposed driveways to SW Sandburg Street. 'although not shown, the applicant intends to abandoned an existing driveway onto SW Sandburg Street. This will require reconstruction of the curb and sidewalk. 5. Stony drainage is provided by an existing line in SW Sandburg Street. Sanitary sewer service is available from an existing line .in SW 72nd Avenue. The Tualatin Valley Fire and Reacue District reviewed the proposal and commented that hydrants shall be Flaced as required by the Uniform Fire Code. Placement should be ^.00rdinated with the Fire District as well as the Tigard Water District. The proposed building exceeds allowable fire flow requirements and will therefore require additional protection. If the nature and use of the existing building changes, additional. protection may also be required. The Building Division, Tigard Water District, PGE, GTE, and NPO #5 reviewed the proposal and offered no comments or objer_ti�r.A. No other comments have been received. B. ANALYSIS AND CONCLUSION Site Development Review The proposal for redevelopment of the existing building at the southeastern corner of 72nd and Sandburg, as well as construction of the new 13,000 square foot flex space building on the site con£orrs with Community Development Code C-P (Commercial Professional.) zoning district requirements for type of use with regard to W. L. McCormack Company's operations, setbacks from property boundaries, building height (45 feet: maximum allowed - 25.5 maximum building height. NOTICE OF DECISION -- SDR 90-0012 -- MCKENZIE-SAITO/McCORMACK PAGE 3 proposed) ; site coverage (85 percent maximum allowed - approximately 80 percent coverage proposed) ; and rite landscaping (15 percent minimum landscaping - approximately 20 percent landscaping provided) . The proposal complies with Community Development Coda requirements for street trees and parking area trees, access dnd internal circulation, vision clearance at driveway/roadway intersections, and connection of the development to necessary public services (water, sewer, storm sewers) . The site plan provides an adequate number of parking spaces to comply with Code standards for the various uses likely to locate in this type of. development (94 spaces provided at a ratio of 3.4 parking spaces per 1,000 square feet building area) . It is noted that the applicant would place the parking spaces on the south side of the existing building right against the property line without a landscaped buffer area. If wheel stops or a curb are not provided three feet in from the property line, parked cars will overhang the property line. The site plan shall therefore be revised to provide either wheelstops or a curb three feet in from the southern property line of the site. The site plan provides for an appropriate number of designated handicapped parking spaces (2 required; 2 provided) . No bicycle rack parking spaces are proposed. Cede Section 18.106.u20.P requires that 1 bicycle parking space within a rack be provided for every 15 automobile parking spaces. Therefore, 7 bicycle parking spaces are required. The applicant will be required to revise the site plan to provide for adequate bicycle rack parking. The site is already attractively landscaped including a number of trees along the site's street frontages. Increasing the size of the parking area an well as adding access driveways will necessitate removal of a significant amount of the existing landscaping, although the site has been designed to retain the most significant trees on the site including two Giant Sequoia trees and several cedars along the site's SW 72nd Avenue frontage. The Planning Division is concerned with the site plan's proposal to provide parking area pavement within the dripline areas of several of these large existing trees including within 5 feet of the trunks of some trees. We are especially concerned because the plan would seem to provide for a surplus of on-site parking spaces for the uses likely to be located within the buildings. An arborist's report on the proposal 's impact on the existing trees should be submitted prior to the issuance of a gradinq permit: for the site. If the report recommends additional pavement- setback from the trees, a revised site plan shall be r+iilhmit:ted. No sign locations or sign dimensions have been included in the site plan. Sign size and location requirements are prescribed by Chapter. 111. 114 in the Community Development Code. Sign size and location will ho reviewed at the time the sign permit is applied for. NOTICE OF DECISION - SDR 90-0013 - MCKRUSID-SAITO/McCORMACK PAGE 4 Permitted U9es in the C-P Zone Staff has contacted tt_a applicant regarding concerns related to future use of the proposed 13,000 square foot flex-space building. The building would include four overhead loading doors on the east side of the building, as well as one loading dock on the western side of the building. The building elevations appear typical of a flex-space industrial building rather than more typical buildings found in the C-P zone that typically contain more office space. The applic"nt has responded that their client is aware of the nature of the existing C-P zoning and the uses that are permitted and prohibited in that zone. The applicant states that the intent of the building design is to offer flexibility for accommodating a variety of tenants with the expectation that uses permitted in the C-P zone will occupy the facility. The applicant feels that such uses can be attracted to this type of building design. However, the applicant also notes that the property owners may pursue a Comprehensive Plan Amendment/Zone Change to Light Industrial (I-P) in the future, which would increase the range of possible tenants. The applicant states that, therefore, the building has been designed to provide for both situations. Staff recommends that the applicant contact the Planning Division regarding whether potential lessees of the available portions of the buildings are permissible uses in the C-P zone. Such contact should be made prior to the applicant making any commitments to prospective lessees. The City will. not allow the possible industrial nature of the building's design to be used as an argument in favor of a Plan and zone change proposal or a ..Director's Interpretation regarding use of the building. C. DECIBION The Director's designee approves Site Development Review 90-0012 subject to the following conditions: BUILDING PERMITS WILL NOT BE ISSUED UNTIL THE FOLLOWING CONDITIONS ARE SATISFIED OR A PERFORMANCE ASSURANCE IS POSTED. 1.
