Specifically, Mr. Waddle was interested in future access from two parcels owned by Key Bank to SW 72nd Avenue. These parcels front on SW 72nd on the curve south of SW Sandburg Street. SW 72nd Avenue is classified as a major collector streot by the Comprehensive Plan's Transportation Plan Map. In general, the City discourages direct access to mao.r collector streets and arterial streets if a property has a reasonable alternative access point. However, the City will not prohibit direct access to a collector street: on which a parcel. has frontage if there is no reasonable alternative. As a condition of approval of granting access to a public street for a proposed development,. the City may require street improvements to be provided by tho site's developer to assure that the access will not reoult in undue traffic congestion or a traffic safety problem. Such improvements may include widening the roadway with turn and merge lanes, traffic signals, streetlights, site grading to improve site distance, or other measures necessary to assure traffic safety. Additionally, it is possible that as a condition of development approval for the first of these parcels to develop, the City may require that an access easement be granted in favor of the other parcel so as to result in a reduced number of driveways. At this point, without a development plan for either of these parcels, we are unable to be specific as to what roadway or site improvements may be necessary for the City to approve access for either of those parcels to SW 72nd Avenue or whether these parcels would be required to utilize a joint access . The only exception would be along the frontage of this development and the one property to the north. (The City can require the property to the north to install a sidewalk under the condition in SDR 90-0012.) In the Engineering Department's original comments for the Site Development Review 91-0019, it was stated that it is normally required that the applicant finish the improvements along the frontage of the Bite. With this application those improvements would involve both tax Iota 3900 and 4100. It was determined that with such limited improvements (an access drive) the improvements which were required along tax lot 4100 frontage could be delayed until future development. The Engineering Department also determined that with the i_ reased development activity in the area (primarily to the south) ti,at the applicant should now be required to install a sidewalk along the entire frontage of SW 72nd Avenue (both tax lots 3900 and 4100). This would enable the sidewalk to be continuous and to relieve any potential pedestrian problems. In addition, it was required that the property to the north would install a sidewalk if this development occurred; thus completing the sidewalk along this area. V. The City of Tigard Planning Commission reviewed and considered the applicants request and the information presented above. The Planning Commission voted unanimously in favor of this appeal to amend condition of approval number 3 to read as follows: The applicant shall be required to sign an agreement to cons=,such sidewalk for the entire frontages of tax lots 700, 3900 and 4100 time as the property to the south develops (tax lot 700) . The Planning Commission has found that an on-site water quality facility is required as per Washington County Resolution and Order 91047. City staff is directed to work with the applicant in approving an acceptable on-site water quality facility. Additionally, the Planning Commission has determined that the decision to underground utilities shall he delayed until a decision is reached by the City Council regarding the general undergrounding policy. All other conditions approved under the December 11, 1991 approval .issued for SDR 91-0019 remain the same. THIS APPROVAL IS VALID IF EXERCISED WITHIN 18 MONTHS OF THE FINAL DECISION DATE AS NOTED BELOW. It is further ordered that the applicant be notified of the entry of this order. COMMENTS The staff report was presented by Senior Planner Dick Bewersdorff and Development Review Engineer Chris Davies. Mr. James Waddlu (applicant's architect) presented oral testimony in favor of the appeal. No other public testimony was received. A taped recording of tt,e oral testimony was made at the hearing. Minutes of the public hearing are being prepared at this time. IV. ANALYSIS 1. Condition 2 - Water Quality Facility The requirement for the Water Quality Facility is mandated by DEQ and is being administered by USA of Washington County. The City of Tigard is under agreement with USA and :.herefore is also required to administer the • aqui cement. The use of dry wells may or may not meet this requirement. The purpose of ,.his requirement is to ensure compliance with certain standards in water ;uality. It is required that the applicant's engineer demonstrate that a proposed facility will meet these minimum requirements. Sufficient data has not been presented at this time which would permit the Enqineering Department to make a recommendation on the use of dry wells. 2. Condition 3 - Sidewalk Installation Section 18.164.030(A) (11L_l states that streets within adevelopment, and adjacent streets, shall be improved in accordance with this title. FINAL ORDER 91-01 YC KEY BANK PACE 3 Section 18.164.030(Al (1) (c) contains the Code standards for allowing the execution of a non-remonstrance agreement in lieu of the installation of street improvements at the time of development (attachment A). The acceptance of such agreements is discretionary. Section 18.164,.120(A) states that all utility lines including, but not limited to those required for electric, communication, lighting and cable television services and related facilities shall be placed underground, except for surface mounted transformers, surface mounted connection boxes and meter cabinet_ which may be placed above ground, temporary utility service facilities ,luring construction, high capacity electric linea operation at 50,000 vol.tb or above. Comprehensive Plan Policy 8.1 (Traffic Ways) Implementation Strategy 5 requires developers of land to dedicate necessary rights-of-way and install ne^essary street improvements (emphasis added) to the City's standards wrhen su--h improvements have not been done prior to the developer's propcials. These necessary dedications may be required upon approval of any development. proposal. The applicant has stated that the sidewalk and undergrounding of utilities should be delayed for the following reasons: 1. Properties directly to the North, South and across the street do not have sidewalks at this time; 2. It will create a potential safety hazard for pedestrians who use it because it has no connection on either end; 3. The South end would terminate a� she blind corner of SW 72nd Avenue (at- tax lot 41[,0) and the North end would terminate at a 6 foot landscaped hill; and 4. Construction of the sidewalk and undergrounding of utilities at this time places an economic burden on a project which consists of a remodel and 5,000 square foot addition. The Planning Commission has reviewed the following staff comments: Southwest 72nd Avenue is currently fully improved, meeting major collector stand&rds, from SW Fir Street to south of SW Upper Boones Ferry Road; except for sidewalks and undergrounding of utilities. The improvements were installed as part of a Local Improvement. District in the early 1980'9. After the L.I.D. , and as new development occurred along the frontages of SW 72nd Avenue, it has been a requirement of the developer to install sidewalks and underground utilities. Therefore, it is very unlikely that the City will form an L.I.D. to install sidewalks and undergrounding of utilities at various and scattered locations. There has been one exception to the sidewalk installation requirement. This exception was for the development to the north of this proposed development. At the time of the development to the north (SDR 90-0012) , it was determined that the sidewalk would be delayed until such time as either the Giant Sequoia trees were removed or the sidewalk was extended. The City has approved numerous developments along SW 72nd Avenue since the formation of the L.I.D. sidewalks have been Lnstal.led as part of these developments. In addition, the property due south of this proposal has recer.tly been subject to City Development Review. The only exception would be along the frontage of thin development and the one property to the north. (The City can require the property to the north to install a sidewalk under the condition Ii SDR 90-0012.) In the Engineering Departments orifi -nal. comments for the Site Development Review 91--003.9, it was stated that it is normally required that t`ie applicant finish the improvements along the frontage of the site. With this application those improvements would involve both tax lots 3900 and 4100. It was determined that with such limited improvements (an access drive) the improvements which were required along tax lot 4100 frontage could he delayed until future development. The Engineering Department also .,etermined that with the increased development activity in the area (primarily to the south) that the applicant should now be required to install a sidewalk along the entire frontage of SW 72nd Avenue (both tax late 3900 and 4100) . This would enable the sidewalk to be continuous and to relieve any potential pedee^. :.-Lan problems. In addition, it was required that the property to the north would install a sidewalk if thin development occurre#,,; thus completing the sidewalk along this area. V. DBCISION The City of Tigard Planning Commieeion reviewed and considered the applicants request and the information presented above. The Planning Commission vrted unanimously in favor of this appeal to amend condition of approval number 3 to read as follows: The applicant shall be required to sign an agreement to construct a sidewalk for the entire frontage of tax lots 700, 3900 and 4100 at such time as the property to the south develops (tax lot 700) . The Planning Commission has found that an on-site waster quality facility is required as per Washington County Resolution and Order 91047. City staff is directed to work with the applicant in approving an acceptable on-site water quality facility. Additionally, the Planning Commission has determined that the decision to underground utilities shall be delayed until a decision is reached by the City council regardir.l the general undergrounding policy. All other conditions approved under the Le ember 13, 1991 approval issued for SDR 91-0019 remain the same. FINDING OF FACT 1 . Background Development of the Key Bank Service Center was approved by the City of Tigard in the mid-70s (Files SDR 38-73, SDR 19-75, and SDR 33- 77) . The building and site improvements were constructed in several phases. The Plan designation ane zoning for the tax lots 4100 and 700 to the east were changed from Heavy Industrial (I-H) to Commercial Professional (C-P) on c—ober 24, 1984 so as to match the designations of tax lot 3900 (Cn 21-84/ZC 1.4-84) . No other land use or development applications involving the subject parcels have been reviewed by the City of Tigard. 2. Vicinity Information Properties to the north and east of the subject site are zoned I-P (Industrial Park) and contain a variety of industrial uses. The parcel immediately to the north contains two buildings, including the administrative offices for McCormack-Pacific, Inc. its the westernmost building, and a multi-tenant flex-space industrial building along the property's eastern boundary. The Key Bank Service Center shares use of a driveway from SW Sandburg Street with this easternmost building on the McCormack-Pacific site. This driveway and parking area is located on tax lot 3801, a separate parcel owned by Key Bank. Properties to the northwest of the site across SW 72nd Avenue are also zoned I-P and are developed with a variety of industrial uses within the Tech Center Drive industrial park. Properties to `he west and southwest are zoned I-H (Heavy Industrial.) and are developed with a variety of more intensive industrial uses. SW 72nd Avenue abutting the site is a 44 foot wide paved major collector street which includes curbs and storm sewers. A sidewalk is located along the west aide of this str--t. No sidewalk is provided on the east side of SW 72nd Avenue near the subject site, although sidewalk construction was required as a condition of development approval for two flex-space industrial buildings proposed to be buil.t. on the western portion of the Williams Controls property to the south (SDR gl-0007/MLP 91-0004) . The applicants request Site Development Review approval to add 5,752 square feet to the existing building through enclosing the existing central courtyard and by adding a small room and exterior exit on the rear or western portion of the building. The parking area would be expanded by 43 parking spaces. Additional landscaping is proposed in the expanded parking arca and along SW 72nd Avenue. The only proposed development on tax portion of. the driveway and some landscaping. lot 4100 is a 4• Agency and NPO Comments The Engineering Division has reviewed the proposal and provided the following comments: a. STREETS: The site is located on S.W. 72nd Avenue in the vicinity of the "S" curves. S.W. 72nd Ave. is classified as a major collector street and has the following minimum standards: 60 feet of right-of-way with 44 feet of pavement, and curbs and sidewalks on both sides of the street. Adjacent to the site, all improvements are installed except for the sidewalk. The existing right-of-way is 30 feet from centerline. Therefore, the only improvement required as a condition of approval of the proposed expansion is the installation of the sidewalk along the frontage of the site. Currently access to the site and existing buildings is provided from a driveway which connects with S.W. Sandburg St. The applicant is proposing to install an additional access Point from S.W. 72nd Ave through T.L. 4100. The only other improvements that are proposed, except for the access drive through T.L. 4100 to T.L. 3100, 1_8 some landscaping which would be installed between S.W. 72nd and the access drive. Normally, it is required that the applicant finish the improvements along tha frontage of the site, which, in this case, would involve both tax lots. The Engineering Department feels that this IS somewhat of a unique situation in that no "development" is planned at this time for T.L. 4100. The applicant is using It only for an access point and that if in the future there were plans for development, we would be able to require the installation of the sidewalk. Therefore the applicant should be required to install a sidewalk adjacent to S.W. 72nd Avenue only along the frontage of T.L. 3900. SANITARY SEWER: The existing ctructure is currently connected to the public sanitarl, sewer system. Therefore, no additional requirements should be required at this time. C. STORM SEWER: There is an existing public storm sewer syetem located adjacent to the site in S.W. 72nd Avenue. Therefore, the applicant should be required to connect the existing on-site drainage system to the public system. Effective December 1, 1991, the City is required to comply with a new requirement of the State Environmental Quality Commission (EQC) . The EQC is requiring that all new developments, that add additional impervious surface area, within the Unified Sewerage Agency (USA) service diatr.ict must include a stormwater quality treatment facility on site. Previously, developments without a suitable site for stormwater quality treatment were allowed to pay a fee in lieu of on-site stormwater quality treatment, with the fees to be used to construct regional facilities. The Engineering Department feels that the new requirement is inappropriate. For many small developments, it is not feasible to build an on-site facility. Construction of numerous small facilities will create maintenance problems for the cities and USA. However, we have no choice. Effective December lst, we must require the facilities as a condition of development approvals or be in violation of State regulations. This issue was not addressee in our earlier staff reports, as we expected the issue to be resolved between USA and the EQC. The Engineering Department is still hopeful that the issue will be resolved within the next three months. Therefore, the applicant should be required to install a stormwater quality facility; but we recommend that the City Engineer be allowed to waive this requirement if the regulations are subsequently amended. The Tigard Water District has commented that the existing one inch diameter water meter will be inadequate to serve the expanded building and landscaping irrigation needs. The water meter will need to be replaced with a one and one half inch met••�r at the applicant 's expense. In addition, the Fire District should review the adequacy of fire protection plans for the proposed expansion. The Tualatir, Valley Fire and Rescue District, the City of Tigard Building and Operation Divisions, PGE, GTE, and NPO N5 have reviewed the proposal and offered no comments or objections. No other comments have been received. B. ANALYSIS AND CONCLUSION Site Development Review The proposal for construction of a 5,752 square foot addition to the existing Key Bank Service Center :wilding conforms with Community Development Code C-P (Commercial Profesgional) zoning district NOTICE OF DECISION - SDR 91-0019 - KEY BANK PAGE 3 I requirements far usage (administrative offices are a permitted use) ; with minimum building setback from property boundaries standards; with the maximum permitted building height. (45 feet maximum allowed; no additional building height proposed) ; with the maximum permitted site coverage (85 percent maximum coverage allowed - approximately 50 percent coverage proposed) ; and with the minimum site landscaping standard for the zone (15 percent minimum landscaping - approximately 50 percent landscaping to be provided) . The existing and expanded site improvements comply with Community Development Code requirements for Parking for administrative office use (100 apaces required for 34, 794 aq. ft. of offices; 126 spaces to be provided) , access driveways (2 access points required for 100+ required parking spaces; 2 driveways provided), adequate internal circulation, vision clearance at driveway/roadway intereections, and provision of necessary publi= services (water, sewer, storm sewers) for the proposed erpanded use of the site. The site plan, however, does not provide for an appropriate number of designated handicapped parking spaces as required by the Oregon Revised Statutes (3 required; 2 provided) . The site plan will therefore need to he revised to add one additional designated han(licapped parking apace. No bicycle rack parking spaces presently exist or are proposed. Code Section 18.106.020.P requires that 1 bicycle parking space within a rack be provided for every 15 automobile parking spaces. Therefore, the Bitr- plan will need to be revised plan to provide for nine bicycle parking spaces in a secure rack. The developed portion of the site is already attractively landscaped. The landscaping plan includes some additional landscaping in the presently developed area along with extending this landscaping theme through tie expanded parking area. The plan also would provide for the planting of nineteen pin oaks along the SW 72nd Avenue frontage of the site as street trees. C.
