You must take immediate action to remove the fence posts. I have enclosed a summary of the City's requirements pertaining to fences and walls. As you will notice, a two foot fence setback from the right-of-way line is required in aide yards of corner lots such as yours. Unfcrtunately, the diagram noes not accurately represent your situation. The diagram allows the inner edge of the sidewalk and the right-of-way line as conterminus. In your situation the sidewalk is adjscen, to the street and the preen strip is Located between the sidewalk and property line. The right-of-way extends to the property 'line represented by the survey staKe you removed to install your northeast corner fence post. The fence posts must be r_elocatee less than two feet 1naidt! of that line. if you believe that an undue or unnecessary hardship would result from the literal interpretation of the fencing requirements of the Tigard Municipal Code, you may apply for an administrative variance to those requirements.
