OWNER: SAME 15300 SW 116th Avenue Tigard, Oregon 97223 REQUEST: For a setback and height variance for one building (4580) within Summerfield Brookside Condominiums off Highland Court. LOCATION: Between Highland Court and Durham Road (Tax Map 2S1 TODD, Tax Lot 7800) PREVIOUS ACTION: Ori March 22, 1977, the Tigard Desig,i Review Board approved the site plan for Alderbrook Apartments - name later changed to Brookside Condos . One of the condition, of approval was that "U. All 1 -ildings adjacent to the single family residences shall be single story." '.-ie property owner to the north objected to the construction of a two story unit adjacent to her single story residence. The City placed a Stop Work Order on the construction of Building #530 u,itil tris issue could be resolved. The Tualatin Development Company is apl-lying for a setback variance from thirty (30') feet to thirty-five (35') feet and a height variance for a two level structure. I . FINDINGS OF FACT: 1. The structure in question has been constructed and is two stories high. 2. The setback shown on the plan is thirty (30' ) feet. Applicant is requesting an addition of five (51) feet. 3. The physical level of the new building at the peak of the roof is approximately six (61) feet higher_ than the peak of the single family home on Highland Court. 4. The new building cannot be seen from inside the home on Highland Court. 5. A strict interpretation of the conditions of development placed upon the Brookside Condos project would suggest that a violation has occurred. However, the structure has been built. STAFF REPORT AGENDA 5.5/v 11-80 TIGARD PLANNING COMMISSION September 2, 1980 Rice 7_ 6. A variance to increase the setback is not necessary. A variance from the single family unit is not really the issue. The question is - should Condition #13 of Site Design Review, SDR 4-77 be altered in this instance? II. CONCLUSIONARY FINDINGS: 1. A violation of a development condition has occurred. However, the physical impact is not that abrupt due to the fact that the new building differs in elevation from the single story residence of only six (6') feet. From within the residence on Highland Court, the new structure cannot be seen. 2. The setback variance is not an issue as it is more than was originally approved. 3. The variance in height request should be a variance from Condition #13 of Site Design Review, SDR 4-77. III . STAFF RECOMMENDATION: Staff recommends that Condition #13 of Site Design Review, SDR 4-77 be changed to allow the new structure to remain as constructed adjacent to a single family residence on Highland Drive. To lessen the visual impact from Highland Court, Staff- further recommends that a landscaped berm be constructed across the area in front of Building #580 to screen this building from Highland Court. This eval- uation included a review of the plant 's self-monitoring reN,•r*s. �! Our evaluation for this period has shown that the King City treat- ment plant was operating to its maximum organic loadiny capacity. lBiochemi :al oxygen demand and suspended solid concentrations of �,(4 plant effluent were marginal and/or exceeded permit limitations. By a letter dated January 15, 1974, the Department approved 540 f; connections to the King City plant with a condition that plant per- Vv formance will dictate the ultimate allowable load placed on the system. As of June 1977, your self-monitoring reports indicated ` that 538 connections have been made. Y \� Please be advised that no additional sanitary sewer connections ,f can be authorized to the King City treatment plant until such time that sewer service from the Unified Sewerage Agency Durham plant is available.
