Klock and Son Co•nc .ruction Co. for the construction of a sidewalk and curb along Scoffins Ave. for the new post office. As of the receipt of your lettere May 9e 1975, no application had been received by the City for this portion of the post office prod ecti ( ' however, I am aware that Mr. Klock was in City Hall this week for the purpose of making application. In that no application had been received by the City at the time of the Planning Commission meeting, I believe this obviates any contention that you have made that the City is at fault for the difficulties now being experienced with this portion o: the project. In other words, we cannot review an application nor issue a permit until an application is submitted. I would also like to respond to some of your other comments. Under item "J" you state that the previous Public Works Director, Mr. Nick Hieberte discussed the finished grades of the new driveway at Scoffins and you use his comments as the basis for your present contention that it is not necessary to pave the area of Scoffins between the existing pavement edge and the proposed curb. Let me state that yo,,. have misinterpreted Mr. Hiebert's comments. It is unfortunate that th?se two issues were not handled concurrently; however, I hope you appreciate that the City cannot be held accountable for reviewing a portion of a project wherein no application has been madri. Staff represented by Powell and City Attorney Anderson. 3. MINUTES The minutes of the April 15, 1975 meeting were considered. Wakem asked that they he amended to show that at item 4.2 he had abstained and tha ` item 4.3 hL:d been tabled by a 5 to 4 vote. The minutes were then approved ac read. COMMUNICATIqNS o Staff asked that the agenda be amended to delete items 4.3 and 4.4. o Chmn. Whittaker discussed the Council 's actions with respect to those revisions of the C-3, General Commercial Zone, recommended by the Planning Commission. The Commission concensus was to ask that the additional provisions (separating the Main .St. zoning from Pacific Hwy. zoning and the 750 ft. distance from schools for high traffic generators) be set for hearing at the next Planning Com- mission meeting. o Ball moved to schedule future hearings for 7:30 instead of 8:00, seconded and carried. o Ball asked that a City Attorney ' s opinion be made available to the Planning Commission on the recent court cases of Culver v. Dag (Appeals) and Baker v. Milwaukie (Oregon Supreme Court) . WhittaRer directed that a presentation by the City Attorney be 4endized for the next meeting.-­­­ o Staff presented a memorandum from the Public Works Dept. to the Planning C2!nmission concernint* the U. S. Postal Service Building now under construction on SW Main St. 14 Staff explained that public works was asking the Commission's 1 recommendation for the improvement of SW Scoffins Street I adjacent and contiguous to the rear delivery entrance to the Postal Service Building. Commission discussion centered or: why this matter had not been previously addressed by public works or the Planning Dept. Staff explained that the post; office had not applied for any review of the project and the first official contact had recently occurred with resl)ect to this particular problem. The contact had occurred when the City had required a street opening permit. Porter moved to table the matter, directing staff to discuss it with the Postal Service. Second (Wakem) , carried. 4. PUBLIC HEARINGS 4.1 Zoning Ordinance Amendment ZOA 2-75 A proposed amendment to Sections 18.04.011 (condit�6nal uses) and 18-40.070 (signs) in the chapter dealing with, the Commercial- Professional zone. Commissioners Wakem and Ball announced they felt they had a con- flict of interest and asked the chairman's pArmission to abstain from participation in discussion and voting' on this amendment. Chairman Whittaker granted that permission'. A. Staff Report I Powell read staff findings afid the proposed text changes with an alternate wording ?T 18-40.070 (1) (a) . B. Public Testimony ' o Lynn Wakem (represebting Farmers Insurance Corp. ) said that the company had studied the proposal and favored it. o Bill FlatteryLincoln Properties) stated that he felt the proposed ordinance amendment was still not adequately Addressing Lincoln Properties ' needs. o Bill McM,oriagle asked if variances would be necessary in order for a developer to exercise his options under paragraphs requiring Design Review Board approval. o Staff said that variances would not be necessary for the forseeable project.
