Recitals 1 . 'the Morleys are the owners in fee simple of certain real property located at 10345 SW McDonald, Tigard, Oregon and as more particularly descr.-ibed by the Washington County Tax Assessor as 2S1 2.CC 3400. City has determined that the Morleys must install certain public services to their- property to bring their lnpxty in a mpliance with Washington County Health Department regulations. 2. The Morleys have demonstrated that they are unable to currently pay for the cost of the sewer assessment fee of $3,000 and the sewer connection and inspection fee of $1,135. The City has agreed to allow payment of fees to be made in installments over a period of five years at an interest rate of nine percent. Agreement Now, therefore, the parties hereto agree as follows: 1_. City shall. issue a sewer connection permit to the Morleys for connection of the above-mentioned property to the sewer system, upon the signing of this agreement. In addition, upon the signing of this agreement, the City will consider the asses.-4nent requirement to be met. 2. The Morleys agree to pay the balance due of $4,135 over a period of five years at nine percent interest to the City. such amortization results in monthly payments of $85.83. The first such payment will be due or. July 15, 1989, and each subsequent payment will be due on the 15th day of each following month. 3. A late charge of $5 will be charted on all payments not paid within to days of the due date. McDonald 2S1 -2CCC-3400 Dear Mr. and Mrs. Morley: It has come to the attention of the Washington County Department of Public Health that sewage and/or waste water is discharging on the surface of the ground because of a malfunctioning of the sewage disposal system at the above noted address. This is in violation of Oregon Public Health Laws and Regulations governing the disposal of domestic sewage and other household wastes. Gerhar:i Matheis, Sanitarian conducted an investigation and substantiated tkp violation referred to above on May 31, 1989. You are respectfully requested to correct this public health hazard by establishing hook-up to the public sewer available to this residence. For information on sewer hook-up, contact City of Tigard at 839-4171 . Since the above .is a safety hazard as well as a public health violation, we must request correction within 30 days from the date of this letter. Please call or write the Department of Health and Human Services as soon as correction has been accomplished. In my opinion the cause of this water appears to be drainage from the front ( south ) and side ( east ) yards and appears to be entering under the below grade windows .
