NOW, THEREFORE, in consideration of each party's grants and agreements hereinafter desc:ihed, and other valuable consideration each to the other in hand paid, the receipt of which is hereby acknowledged FIRM King hereby grants and conveys to Hunziker Family and to Hauf4ar a non- exclusive easement for construction and maintenance of a etorm sewer on, over, across, under and through that portion of Tax Lot 2400, as dencribpd on Exhibit D attached hereto and ircorporated heresin. Said easement Is hereafter referrn<i to as the King Eaaemant.. SECOND: Said con4truction and mAintenance shall be by and at the Axpenyn of the Huntiker Family and HAustr. The Hunziker Family and Hauser warrant the storm sower to be constructed on Tax Lot 2400 to be of equal or better mnitorial and capacity than the now existinq catch basin and storm drain. The Hunziknr Family and Hauser shall , indemnify and hold King harmless from any liablity arising out of the construction of said storm sewer, including but not lf.mited to the paym('nt: of any materialmen's liens. The Hunriker Family and Hauser and respective successors in interest shall henceforth maintain at their expense, comprehensive general liability insurance in the amount of FIVE HUNDRED THOUSAND Cx)LLARS (5¢00,000,00) , covering said easement, naming King or his nuccessvrs as additional insureds and provide King or his successors evidence of the aaule, The Hunziker Family and Hauser shall provide King or his successors ovidc,nce of workmen's compensation insurance for any workman providing mai.ntenancn or construction on said sewer line before such work is perform-id. THLRD% Hauser grants and conveys to Hunziker Family a perpetual, non-exclusive eaoement to construct and maintain a storm sewer pipeline along, over, undur, through and across, a strip 10 feet in width adjacent to the southwest property lire of Tax Lot 2201 extendir.a 275.05 feet, more or less, from Hauser's east pronerty line to Hausez 's west property line. Said eaeemont is morn particularly described on Exhibit F hereto attached and by thin reference incorporated herein. Hausar agrees that the Lulrillment deed for Mauser 's contract of purchase from Hunziker. Family shall rasnrve (raid easement for the benefit of All of Tax Lot 2200. FOURTH Hunziker Family agrrr_s to Pay all costs and exp«uses of initial construction and/or modification of storm drain system to 1,04 installed along the southwesterly line of Tax Lots 2200 and 2201 to a manhole in Lhe easem"e:c. granted by King to accAss the storm sewar in that easement ext_emtli:vy to Hwizi:ger Road. FIFTH: if King, within five years of the effective date of this agreement, desires to move the location o: the existing storm sewer line, King will grant such easomant modifications as may be necessary to provide continued storm eew„r drainage from the Hunziker Family property and the Hauser property! The Rtinziker Family agrees that it will pay 50• of the reasonable construction cost of relocating said storm drainage across King's pro}H,ety to Hunciker Road, if moved within said five-year period. This obligation shall be persQnA1 to the Hunziknr Family. Hunziker and S.W. Hall Blvd. I Gentlemen: As requested, a soils investigation was conducted on Tax Lot 2.202 located at the southeast corner of Hall Blvd. and S.W. Hunziker in the City of Tigard, Oregon. The purpose of the investigation was for a proposed single story office/warehouse block and steel building and was conducted at about 2:30 p.m. on January 3, 1989. Using a backhoe, a test pit was dug at the northwest corner and at the southeast corner of the proposed building. Both test pits indicated 12 to 18 inches of black organic topsoils followed by 18 inches of soft to firm brown native clayey silts. At minus 3 feet in both pits, hard brown native clayey silts was encountered. No water was found in either test pit. It is recommended that all organic and soft clayey silts be removed and all footings be placed on the hard underlying clayey silts. All debris and other unsuitable or deleterious materials must be removed from the existing building area to the hard clayey silts below. Over excavations shall be backfilled with 3/4" to 1 1/2" minus crushed rock and compacted to 95% maximum density. All footings shall be placed on clean, undisturbed native soils or on supervised structural fill . All footings must be placed a minimum of 18 inches below finished grade. It is recommended that a soils engineer examine the footing areas after stripping and site preparation and prior to placing fill materials to confirm the suitability of the subgrade. Subgrade prepared as indicated above may be designed for a soil bearing value of 2000 pounds per square foot.. Engineering or consolidated testing were neither requested nor performed.
