(continued) i I A problem discharge means any upset, slug discharge, spill or accident Which results(or may result) in a dis charge into the Agency's treatment system of a prohibited substance;or of a regulated substance in excess of l permit limits and which may: (a)cause interference or pass through at the treatment plant;or (b)contribute to a violation or any requirement of the Agency's NPDES permit;or(c)caiise vi,intion of any State or Federal water quality standard. l During normal business hours, notifications may be made by calling the Source Control Div sion at 693-4541. 1 r Emergency notifications may be made after hourclweekendslholidays by calling the duty officer at 784-6229. 2.E. If sampling nerformed by the Permittee indicates permit vioiation(s), the Permittee shall notify the Agency within 24 hours of becoming aware of the violation. The Permittee shall also repeat the sampling and analysis and submit the results of the repeat analysis to the Agency within 30 days after becoming aware of the violation ' per 40 CFH Part 403.12(g). The Permittee must continue the notification and resampling requirement until compliance is achieved. I 2.F. The Permittee shall immediately report any significant changes(permanant or temporary) to the prem;ses or operations that cause substantial changes in production, volume or character of the wastewater discharge,or j deviates from the terms and conditions of this permit, per the requirements in 40 CFR Parts 403.12(j) and 403.6(c)(7). Unless ^mergency conditions prevail, the Agency requires that changes be reported prior to being implemented. 2.G. Notification from the Permittee is required to the Agency,the EPA RCRA Director, and the Oregon State Hazardous Waste Director within 90 days o the off ective date of a published RCRA ruling, of a discharge(or changed discharge) of either a listed or cha,,acteristic hazardous waste to the sanitary sewer, per the req sire- ; ments in 40 CFR Part 403.12(p). The Agoncy requests notification even if the results of the hazardcus material sampling are submitted on self-monitoring iepor-s (Periodic Compliance Reports). t 2.H. An "Upset", and an affirmative defense for such, shall not be allowed under circumstances where non- compliance has been caused by operational error, improperly designed or inadequate treatment facilities, lack of j preventative maintenance, or careless or improper operation. In case of an upset or upon reduction, loss or failure of its treatment facility,the permittoe shall control production and/or a!I dinchwges to the extent necessary to maintain compliance with applicable pretreatment standards until treatment Is restemd or an alternative method of treatment is provided. This requirement also applies in situations where the primary source of power for the treatment facility is reduced, lost or fails. 2.1. Any Permittee subject to reporting requirements in 40 CFR Part 403.12 shat' retain and preserve all records, books, documents, memoranda, reports, correspondence and any a:,,:all summaries thereof. relating to monitor- ing, sampling and chemical analyses made by or on behalf of an the Permittee in connection with its discharge. ' Such records shall be subject to review by the Agency, and shall inclu.ie for all samples: 1) The date, exact place, time, and methods at sampling or measurements, and sampling preservation techniques; r,` tar i 2) Who performed the sampling or measurements; 3) The date(s) the analyses were performed; ' 4) Who performed the analyses; 5) The analytical techniques or methods used;and t 6) The results of such analvses. ij 3.8. The Permittee shall retain for a minimum of three years all such records defined in Se61ion 3.A. above, and , shall make such records available for inspection and copying by the Agency, the DEQ Director and the EFA Regional Administrator. This period may be extended by the request of the Aqency at any time. All records that pertain to matters that are the subject of special orders or any other enforcement or litigation activities brought by the Agency shall be retained and preserved by the permitee until all enforcement activities have concluded and all periods of limitation with respect to any and all appeals have expired. .3C. For any information taxed to the Agency,the original shall be retained on the permittee's premises for a minimum of three (3) years;or the original shall be mailed to the Agency as a follow-up to tho fax. Representative Sarnpiing a Samples and measurements taken as required by this permit shall be rcr,nentative of the volume and nature of the monitored discharge. All samples shall be taken at the monitoring points sp.rifled in this permit, and unless otherwise specified, before the permitted discharge joins or is diluted by any other wastestreams, body of water or substance. All equipment used for sampling and analyses must be routinely calibrated, inspected and maintained to ensure Its accuracy. Monitoring points shall not be changed without notification to, and approval from the Agency. 4.1'. Inspection and Entry The Age;icy may inspect the facilities of any Permittee to determine compliance with the requirements of the Agency rules and regulations. The Permittee shall allow the Agency or its representatives to enter upon the premises of the Permittee at all reasonable hours at - .vithout prior notification by the Agency, for the purposes of inspection, sampling, and records examination and copying. The Agency shall have the right to set upon the Permittee's property such devices as are necessary to conduct sampling, inspection, compliance monitoring and/ ! or metering operations. a 4.E. Cet iificaf,on Statement j All reports arld testing results submitted by any Permittee shall be accompanied by the signed certification statement defined in 40 CFR Part 403.6(a)(2)(ii). 4.f. Proper Disposal o/SludgesiSpent Chemicals The disposal of pretreatment sludges and spent chemicals shall be done in accordance with Section 405 of the Clean Water Act (CWA) and Subtitles C & D of the Resource Conservation & Recovery Act (RCRA), and any siate hazardous;waste requirements. 4.0. ;cls%tying Informa;ron/Tampering With Monitoring Equipment Knowingly making any false statement on any report c-other d3cument required by this permit, or knowingly rendering any monitoring method or device Inaccurate, may result in punishment I;nder criminal laws of the �r Agency, as wol as being subject to civil penalties and relief. 4.N. Emergen;y Suspension of Services/Revocation of permit The Agency may suspend the wastewater p©rmit of a Permittee,whenever necessary in order to stop an actual or threatened discharge vohir..h reasonably appears to present or cause an imminent or substantial endangerment ' to the health or welfare of persons, interferes with the operation of the Agency's wastewater system, or which present or may present an endangerment to the environment. In additi ;n to further penalties and remedies in any Ordinances or R&O, the Agency may terminate the wastewa- ter permit f;f any Permittee for violations of any Ordinance, R&O, or discharge permit condition. z.
