The Board recommended that such signs be permitted
within the City of Tigard and that the Planning Director
prepare an ordinance and submit such ordinance to the
City Council for approval with these following concerns:
1.. The ordinance to be submitted within 60 days
of the hearing.
2. That ,he sirens be conditional uses--not permitted
outright.
3. Signs maybe located at bus stops.
4. If signs are located at places other than bus
stops thnse signs must be laheled an both sides
"THIS IS NOT A BUS STOP"
5. Signs will not block vision of traffic.
6. Signs will not be in conflict with businesses
in which they front or are near.
7. That the Sign Company obtain written approval
from the business in which the sign would
front.
B. That the Planning Director regulate tht? amount,
location, size and all other _guidelines concerning
bench signs.

Dear Sir: '
It has been brought to my attention that your company nas installed a considerable
amount of bench signs, advertising a number of businesses, within the city limits
of Tigard.
After an inspection of the City, I find this information to be correct. This type
of advertising comes under "Outdoor Advertising" signs as covered in our City
Ordinance No. 71-5. However, before any sign can be accepted in the City you must
(1) obtain a city business license to operate within the City limits and (2)
submit to this department a sketch showing locations, sizes, etc. of proposed
bench signs ana obtain a sign permit. Apparantly you have not complied with either.
These signs ate only allowed in regulated areas of the City. Please find enclosed
a copy of our Municipal Code No. 1.6.40.090 which better defines ordinance No. 71-5.
I have been instructed to advise you r.o remove all bench signs within the City
limits and go through the normal channels to obtain, if possible, the necessary
permits to continue this type of business within the City limits of Tigard.
All of the above mentioned bench signs must be removed within ten (10) days from
receipt of this letter, or they will be confiL-a`ed by the City. We shall also
Look to you for pavment of our time in doing this.
If you have any questions concerning this matter, feel free to call either
myself or Mr. Nick Hiebert, Director of Public Services and Facilities, at b39-4171.

SUBJECT: Bench J,gn Violation,
Over the past few weeks I have become aware of numerous bench
type aigns lining uur public nights-of-way, especially along
Pacific Highway and Main Street. To our departments hnuwledge,
the company providing these signs has not obtained permits
for the placement of such signs.
Please find attached an analysis of the situation from
Dick Bolen. We feel strongly that this situation should be
rectified as soon ah possible. The signs, from my point of
view are an obvious attempt at circumventing the provision.i
of the City's ,sign Code.

SUBJECT: Bench Signs
As we discussed previously, no permits have been
taken out for the bench 0.gns now .located within
the City. These are iff-premise signs and are
permitted under the outdoor advertising section
of the sign ordinance. The; are therefore required
to comply with the same standards as billboards for;
zone:; permitted in, height, size, and permitted locations.
While the size and height limits are not an issue here,
the spacing requirement is. The ordinance states that
"Outdoor advertising signs shall not be located within
three hundred feet (300' ) of another outdoor advertising
sign on the opposite side of the Street or highway
or within five hundred `*et (500' ) of another outdoor
advert.linp, sign on the same side of the street or
Highway .
The txi.,ting bench signs have been placed along Pacific
and Maio► street ana in numerous cases violate this spacing
requirement. In addition, based upon the ordinance definition
which as I interpret it, places billboards and bench sigiis
In the same category, the locating of either type of sigil
aiubt regard one another for spacing purpt7ses . This rai,3eb
the lnterebting point that a billboard eoulu nut be located
to within either 3W or ')OU feet of a bench sign. Therefore
if the aduitional locations which could accomodate billbuards
were occupied by bench signs, no additional billboards could be
erecl.eu -�n Pacific Highway. I believe thin point is worth
investigation, eg. an opinion from Fred Anderson.
To deal with the existing bench sign problem the first course
of action is to notify the company that they are in violation.
The;- should then work with this office in order to comply with
the ordinance. Actually these signs ao provide a public service
and should have a place. They should however, only be located
at designated bus stops as this Is the function they are
a&.

Intended to serve. In fact they have created confusion
as to where the bus stops are in Tigard by their random location.
I woc:der if this ever results in people who think they are at
a bus stop bring passed by a bus.
I have been told that New York City has solved this problem
by constructing bus shelters on which they rent advertizing
space. It is supposedly a very sucessful program. Perhaps
we should contact Tri-Met about doing this sortof thing
in Tigard.
