Responsible party: Mr. & Mrs. Lorinc, 12435 121st Avenue. 3-1-90 Found contractor had excavated public R/wy w/o Street opening permit, East side 122nd & adjacent to Lorinc property. Street had not been cleaned. I contacted owners and advised them of the violations. They called John Hagman and made appointment for 3-2-90 to obtain permit. I gave verbal instructions to owners as follows: * No further work in the Public R/wy w/o required permit. * Clear. 122nd Avenue without thi use of water. ( No silt/soil can go into ANY catch basin, as the system drains directly into the lake W/O 122nd Avenue) Cleanup effective 3-1-90. I asked them both if they understood my instructions, they both said they did understand. 3•-5-90 I was off on sick leave. 3-6-90 I inspected and found that not only was cleanup inadequate, rain was washing soil into drain system. I advised owners of their responsibilities. They said they would clean the street. I instructed them to install filtering devices at the back of curb ( hay bales ) for additional rain damage/erosion. 3-8-90 122nd has not been touched. It appears the parent parcel was previously divided as the result of a land sale when the parent parcel was still in the County. This explains why the western lot, Tax lot 6800, is below Tigard's minimum lot sire for a parcel in the R- 4.5 zone. [loth parcels were in existence at the time of annexation. An accessory structure approval for the construction of a 384 square foot detached garage was recently given by the City (Case No. M 88-24) . 2. Vicinity ]nformation Properties to the north, west, and east are also zoned and developed R--4.5. Properties immediately to the south are in Washington County and are zoned R 6 (;angle-Family residential, 6 units/acre) . The subject site has frontago on both 1219t Avenue and 122nd Avenue. 121st Avenue is a major colloctur street and 172nd Avenue is a local street. An existing house is on the parcel fronting 121st: Avenue. 121st Avenue right--of--way is currently 21, feet from centerline, whereas 30 feet is required for major collecL"r streets. The existing pavement is approximately 20 feet wide and is rough from the 'several patches it has received in the past. 122nd Avenue right-of-way is currently 40 feet. wide, whereas 50 feet is required for• local streets . The exi ting pavement is ir, good condition with curb along the site frontage and curb with sidewalk on the opposite side. 122nd Ptionue provides access to five lots beyond the subject parcel to the end of Lhe roadway. Tax lot: 6900 has a single family residence and will soon have a detached garage at its southwestern corner. The applicant is proposing to shift the common lot line between lots 6800 and 6900 to the east. This will enlarge the undeveloped western parcel to 7,505 square feet and as a result, both parcels will conform with the minimum lot size of 7,500 square feet for the R -4.5 zone. 4. Agency an4 NPO Comments The City Buildinq Division has reviewed the proposal and has the following comment. All existing utilities shall be provided with easements if they crus, tho new property line. The Tigard Water District, the Consolidated Fire and Rescue District, Portland General Electric, NW Natural Gas, and General Telephone have all reviewed the proposal and have no objections to it. The City Cngineering Division makes the following observations or findings : a. Half- street improvements are not typically required for lot line adjustments for residential lots and are riot recommended at this time for 121st Avenue. Right-of-way dedication is typically required for lot line adjustments. 121st Avenue requires an additional 5 foot of right--of-way to meet major collector, standards. 122nd Avenue requires an additional 5 fest of right--of-way on each side tc conform to the 50 foot total right-of-way width requirement _ for- local streets . However, since the street is presQnLly curbed and the steep bank will prevent the logical construction of a sidewalk, additional right-of--way along 122nd Avenue is not recommended. b. A steep bank exists from 122nd Avenue to the parcel Fronting 122nd Avenue. Access to this parcel from 121.st Avenue is not possible due to the location of this existing house and required side yard clearances . The driveway access for the wesLerly parcel will F,Ave to be from 122nd Avenue. C . Sanitary sewer to serve the two parcels exists in 121nd Avenue. The parcels frontirig 122nd Avenue v1ill require a scparate connection to the sewer and an easement will be required across; the parcel fronting 121st Avenue. No other comments were received. By ceducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district.
