The following will be required in order to continue its use as one of three apartment units: o Each of the two upstairs bedrooms must be provided with an egress window. The window must have a minimum of 5.7 square feet of clear openable area, with a minimum of 24 inches clear height, ane 20 inches clear width opening. Common Storage area o If the lower unfinished area cannot be used for any purpose other than for the maintenance of the furnace or water heaters . No storage or other use is allowed. o All water :eaters must be equipped with a pressure relief valve. o The stairway must have the handrail at between 34 and 38 inches above the tread nosing. The handrail must extend the full length of the stair and the ends must return to the wall . a The wall common with the adjacent bedroom must be insulated with to a minimum R--11 . All units v Smoke detectors shall be installed on each floor and outside each bedroom. The smoke detectors shall receive power from the building wiring. It is obvious, that the biggest problem is the lack headroom in two of the unitk , and without some modification you may be limited to only two units. Unfortunately there is no way to grant an exception to this rule. The Code is very clear on this point, and dates back to at least 1958. The rouse has been divided into four dwelling units . The parcel and surrounding properties have been zoned R-4 . 5 (Residential, 4 . 5 units per acre) since the property was annexed to the City on November 3, 1976 . The R-4 .5 zone allows single-family residences as a permitted use. Duplexes may be allowed as a conditional use. Three plexes and four plexes are not allowable uses in this zone. The City of Tigard Planning Division ai.d Building Division records do not include any approvals for development or conversion of the house to anything beyond a single family residence since annexation. I contacted Washington County's Department of Land Use and Transportation regarding the zoning histr:ry for this parcel prior to annexation. Senior Planner, Hal Bergsma reported that the County's files also do not include any land use or development approvals for this property. Mr. Bergsma reported that the County began use restrictions through zoning for this property in the early 19601x . The property was zoned by the County for single family residential use from the inception of zoning until annexation to the City of Tigard. Under the County's zoning laws, uses existing prior to zoning that did not comply with the zoning regulations were allowed to continue as legal non-conforming uses subject to restrictions on expansion and intensification. The City of Tigard would view this situation similarly (See Code Section 18 . 1.32 . 040 .D) Based upon Jane Halvorson's November 24 , 1990 letter and the Washington County and City of Tigard zoning laws which apply to this situation, the Halvorson's have an apparent right to use the house at 11285 SW 121st Avenue for no more than three dwKlling units . This determination is based upon Ms . Halvorson's statement that the conversion to a three-plex occurred in the late 1950 's prior to the establishment of use restrictions through County zoning. The addition of a fourth dwelling unit in the mid-70 's without County or City land use approvals and without a bui_ldi.ng permit constitutes an illegal intensification of a legal non- conforming use. In elir last conversation on November 1.3 , 1990 you asked me to provide wt,atever I could to verify the building ' s conversion to a 3-plex before C-ptember 1959. I must admit that nothing in the documents that my mother provided me at the sale of the building in 1984 proves that i+- was a 3-piex in 1959 . 1 have past fire insurance policies that have the building listed as a 3-plex and eventually a 4-plex, but 1 do not have a copy of. the 1959 fire policy. However, I can provide you with copies of what insurance records that I do have. Another possihle way to confirm the building' s timely conversion is if I could get a statement from a tenant who lived there in the 19501s. Presuming I can locate someone, would this be of help? Sincerely, �� / FiL7`vsr 12555 S.W. Summercrest Dr. Tigard, Oregon 97223 November 24 , 1990 TO WHOM IT MAY CONCERN: We purchased and bega,. living at 11285 S.W. 121st Tigard, Oregon in 1953 . At the time it was a ten-acre parcel with a large bare and several outbuildings. We did considerable work to they place over the years, including its conversion to a four- plex. The initial conversion to a three-plex occured in the late 19S.0 's when we began renting out the place. As to the exact dates of the conversions, I am no longer sure. My husband worked at it gradually, adding on a garage, then enlarging and dividing they original structure. It is my best memory that we were renting out the three units by the end of the 1950 's. The last unit was added in the mid-1970's. We have never been too sure as to the legal status of the property. As far as any good records on the conversion, I am afraid I no .longer have any. In 1984 we sold the property to our son, William, and anything we might have hid, I must have given to him.
