Main Tigard, Oregon 97223 Dear Sir: I was the contractor for construction of the Springwood Duplexes on S.1+1. 121st Avenue, Tigard and did the street improvement as a part of my contract. Subcontractors worked for me on a lump sum firm contract basis. It is unfortunate that owner and contractor received a lot of misinformation before starting. We were told originally that the street was to be constructed to city specifications using the property line and existing street center line to control our work. When work was complete, the System Development Charge would be refunded upon application to the city recorder. Our contract was predicates on that information. When we paid the System Development Charge and asked for a permit, I was told personally by the Engineer in charge that the Owner must employ engineers to prepare a plan of the improvement and to estimate quantities involved, even though the men in the field had all the information they needed. Marx and Chase prepared a plan, for which they were paid $961 .00, and an estimate, which we gave to the city of Tigard to receive the permit. You will note that on July 3, 1979, the City Administrator told us that Engineering, bond fee, permit fee, barricades and contractor's overhead and profit were not a part of the cost of the improvement. Why did we have to pay these amounts if they were not a part of the cost? They are not free to an, contractor, yet if I include them in another cost I cannot certify the 11actual cost'. I might say that in unit pricing for bid purposes, a contractor may normally include these items in another cost such as concrete or paving and get a correspondingly higher unit cost, which gets them paid without being listed. Overhead and profit are added as a percentage of each unit cost. Since the / O s January �cs•- fir. � �,}� ��O�USki�n There seems to bas to the pr;cedure or applying, for a credit against the System Development Charge for the cost of extra capacity improve- ments. A brief descrip �onr of the process might be in order including an indication specifically of requirements for receiving credit against the charge. I. Fees are paid according to type of land use. 2. Extra capacity facilities are built according to need. Need is established by conditions and specifically indicated by an engineered plan. The Engineered plan should supply sufficient information to estimate quantities. This estimate of quantities should be supplied with the plans. Actual quantities need to be itemized, and documented (ie., invoiced) by the developer in sufficient detail that the Engineerin.a Department can readily verify the actual cost of the improvement. The developer is required to participate in cost of these improvements to the extent of the cost of a local street as estimated annually by the Public Works Department. The cost plus method of doing construction jobs ?s a widely used and acceptable method in the construction industry . The only dissimilarity in the fixed amount contract and the cost plus contract is that the cont r-actor profit is not set out separately . However, as you are aware if the contractor does not include a pro- fit amount in quoting a fixed fee , he will not be in business very long. According to a letter from Mr. Story to Mr. Hagman, dated May 2, 1979, certain costs were involved in providing an oversized collector street. Glazer, AIA L �y HLG:mw copy: Ken Story G V \�10` All c. 0 1 Letter to Frank Currie - from Ken Story Company 2 City of Tigard required actual paid invoices, those costs had to be detailed, and could not be lumped as in an Engineer's Estimate for pay purposes. That does not make the costs any less valid. I enclose another copy of my letter of May 2, 1979. This is the amount the owner paid me for the work. You have the recei.pted invoices in your files. Evidently the sewer is not to be considered part of street improvements , so Ed Thoennes' bill for $1,099.00 should not have been included, and I have revised it accordingly. There is no other way I can submit costs on a "paid invoice" basis. The one-half street improvement actually cost $42.61 per lineal foot, which is $14.47 more than the city standard as calculated in the City Administrator' ; letter of July 3. As I remember it, the ci`.y ordnance refers to "actual cost". An engineer's estimate has nothing to do with actual cost. This job was done on a time and material basis and I have no way to correlate it to an engineer's guess of what materials might or might not be used, or what they would cost. In any case, the engineer's estimate prepared by Marx and Chase was evidently inaccurate and incomplete. The Engineer's stamp is certainly no guarantee of accuracy nor completeness. Please review this file to see if you can understand the conflict in trying to account for costs both on a "unit price" and "actual cost" basis, so that Mr. Glazer may receive a fair settlement. I shall be glad to talk to you personally or to appear at a City Council meeting if it will help.
