I found that there were no wetlands present in that area. This letter documents my observations and the results of the determination. Site Description i The site is located in Tigard, at 113th and Durham Road, the southeast quadrant of that intersection . The project arca is planted to meadow grasses over most of the site. The arra of interest is a drainage channel that begins at a culvert on the south aide of Durham road, and flows south across the project Property. The area of concern is the first 300 ft of the stream channel , from Durham Road to the first_ Douglas fir encountered downstream. The upper 200 ft of the stream channel is a gently sloped Swale lined with Himalayan blackberry. Moving down tho channel, the side embankments become steeper and develop a shrub community comprised of black hawthorn, serviceberry, hazel and cherry. Farther downstream is a riparian forest of red alder, western red cedar, and Douglas fir . Methods I This wetland determination was made using the techniques described in the Federal Manual for Identifying and Delineating J'!risdictional Wetlands (Federal Interagency Committee for Wetland Delineation, 1989 ) . The manual focuses on the three criteria listed below that must be met: 1 . Soils Hydric soils usually develop certain morphological characteristics due to prolonged wetness. These are listed in Hydric Soils of the United States (SCS 1987) and the federal delineation manual (F'oderal Interagency Committee for Wetland Delineation 1989) . According to Washington County soil surveys, the soil along this drainage is Verboort silty clay loam, a poorly drained soil which is classified as hydric by the Soil Conservation Service i,SCS 1967) . The predominant soil on rest of the site is the Quatama loarl, a moderately well drained upland soil. Determination: Site examination confirmed the presence of hydric soils with soil characteristics typ+cal of Verboort silty clay loam on the site. These soils were in the stream Channel, and extended about one foot on either side of the channel . Vegetation On a species by species basis, plants can tolerate different ranges of soil moisture. For the purposes of determining wetland or hydrophytic vegetation, plants are classified into five categories based on their frequency of occurrence in w&tlands . The categories are obligate wetland plants (OBL) , facultative wetland plants (FACW) , facultative plants (FAC) , facultative upland plRntr. (FACU) , and ooligate upland plants (UPL) . There are two other designations: no indication (NI) is for those species which lack saifficient information on their frequency of occurronce in wetlands; and not listed (NL) is for those species that are not included in the National. List of. Plant Species That Occur in Wetlands (Reed 1988) . It is frequently inferred that NL species are UPL. The criteria for determining it a site, under normal conditions, has hydrophytic vegetation is that the site must have more than 50 percent dominance by OBL, FACW, and/or FAC species. The upland meadows are dominated by a variety of non-wetland grasses, legumes, and other herbs. Zoning: R-25 (Residential, 25 units/acre) Location: southeast corner of SW 113th Avenue and Durham Road (2S1 15A, Tax Lots 1700 and 1300) . DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions listed on pages 8 through 11. The findings and conclusions on which the decision was based are noted below: A. FINDINGS OF FACT 1. Background The subject site was annexed to the City of Tigard in October, 1983. The site has been designated for Medium-High Density Residential use by the Comprehensive Plan and has been zoned R-25 since annexation. No land use or development applications regarding this site have been reviewed by the City of Tigard. 2. Vicinity Information The 94 unit Sycamore Terrace Apartments are under uonstruct',,n on property zoned R-25 to the eaot of the subject site. Properties to the north are zoned R-25 (PD) (Planned Development), are developed with apartments, and are located within the Summerfield planned community. The Tigard Towne Square shopping center is located to the west across SW 113th Avenue on property zoned C-G (General Commercial) . Properties to the south are presently within Washington County but are within the City of Tigard's active planning area. Plan designations are provided for these parcels by the Comprehensive Plan Map. A 1.0 acre parcel designated for Medium- High Density use, which presently contains a single family residence, is located immediately south of the subject. site. This parcel shares 484 feet of the subject-. property's 594 foot southern boundary. The remaining 100 feet of this border is shared with a parcel which is desiynated for Low Density Residential use by the City of Tigard's Comprehensive Plan. The shared border between the subject site and this second adjacent parcel is within the wooded ravine area which extends to the Tualatin River. 3. Site Information and Proposal Description The 8.73 arse suhject site is an open, undeveloped field cut by a ravine in the eastern third of the site. The site has 594 feet MITICF, (q, Iit?rlhlo14 - SDR 90-0003 - BARICEVIC Page 1 of frontage on Durham Road and approximately 760 feet of frontage on SW 113th Avenue. Durham Road is classified as a major collector street by the Comprehensive Plan's Transportation Map. Durham Road is scheduled for major improvements and widening this summer. SW 113th is functionally classified as a local street. The applicant proposes to develop a 172 unit apartment complex on the site. The development would include eleven 2-1/2 story tall residential buildings. Also proposed are a single-story office and recreation building, an outdoor pool, a spa, and a putting yreen. Recreational facilities would be located in the northwestern corner of the site. The development is designed to have three accesses to SW 113th Avenue. The northernmost access will be approximately 150 feet south of the centerline of Durham Road, directly across from the driveway from the Tigard Towne Square Shopping Center. The other driveways would be located 150 feet and 350 feet south of the first driveway. Half street improvements are proposed to be constructed along SW 113th Avenue, including 20 feet of pavement from the road's centerline, curbs, sidewalk, storm drains and streetlighti.ng. Twenty-five additional feet of right-of-way along Durham Road will be dedicated for future street improvements. No improvements to the site's Durham Road frontage are proposed. Internal circulation for the development will be provided by a network of 24-foot wide roadways. An eastern segment of the roadway system would extend parallel to the ravine and the Sycamore Terrace Apartments site to the east. Thirty-six apartment units would be located in the two apartment buildings along this easternmost driveway. The driveway would terminate with a hammerhead-type vehicle turnarOL.nd approximately 170 feet from the end of the driveway. Eight garages would be located at the southernmost end of this eastern driveway. A total of 287 parking spaces would be provided including the 8 garages, 176 carport spaces, 97 uncovered parking stalls, and 6 uncovered handicapped spaces. The designated handicapped spaces are all located on the western one-half of the site. The proposed site plan calls for approximately 398 of the site to be landscaped. The landscaping plan calls for maple trees to be located within the development site and behind a fence along the site's border to serve as street trees along the Durham Road frontage. Maple trees would also line the proposed development's Pastern border with the Sy%:amore Terrace Apartments. A number of linden trees would be located along the southern border of the site. Landscaping alonq the SW 113th Avenue frontage would include a combination of hornbeam trees, arborvitae, Douglas fir, and other smaller bushes and shrubs. The landscaping plan also provides for the provision of three picnic areas scattered NOTICE OF DECISION - SDR 90-0003 - DARICEVIC Page 2 throughout the site including one area in the far northeastern corner of the site underneath the large oak tree located just to the east on the Sycamore Terrace property. The landscaping plan also calls for a 6-foot tall fence to be located along the Durham Road frontage and a sign to be located at the intersection of 113th Avenue and Durham Roade. The development .is proposed to be connected to the public sanitary sewer system through installation of an B-inch private sewer line connecting to a proposed Unified sewerage Agency public sewer line within the ravi-ne to the south. Unified Sewerage Agency has applied for a Sensitive Lands permit for installation of the sewer line in the drainageway through a separate application. Water service to the site exists from a 12-inch line along Durham Road, and an 8-inch line along SW 113th Avenue. Water service development on the site would include installation of six fire hydrants. Storm water drainage would be provided through storm sewers draining to the ravine on the edstern third of this site. 4. Agency and NFO Comments The Engineering Division has reviewed the proposal and offered the following comments: 1. The site fronts onto Durham Road and 113th Avenue. Durham Road is a 2 lane paved road classified as a major collector. street. The exi9ting right-of-way is 20 feet from the centerline whereas 45 feet is required for Durham Road. Thi.s additional right-of-way is shown appropriately on the submitted plans. Additional right-of-way must be dedicated at the intersection of 113th Avenue to allow a 25 foot radius curb return and sidewalk to be constructed within the public right-of-way. Improvements to Durham Road, typically required of developments such as this, should not be requires: since the Major Streets Bona is providing for these improvements. The future curb will transition from the existtng width west of 113th Avenue to the standard 22 feat from centerline along the sites frontage. 113th Avenin is a two lane paved local street, improved on the opposite side through the recent development of that site. Half street improvements should be constructed, as shown on the submitted site plan, to local street standards along the site's frontage. 2. Three acceunes are proposed to the site off 113th Avenue and none are proposed to Durham Road. Access to Durham Road is not recommended since an alternate access exists off 113th Avenue . A traffic analysis should be performed to determine if right and left turn lanes are warranted for vehicles entering Durham Road from 113th Avenue. The analysis should consider the full development of areas to be served by 113th Avenue to the south, this apartment complex, and the commercial development across 113th Avenue. Traffic volumes for the commerr;ial site and for Durham Road are available from the Engineering Division of Tigard. 4. Since the site contains a large drainage Swale, storm drainage is provided. However, the drainage swale should be evali.iated to determine if wetland areae are involved within the swale. A Corp. of Engineers permit should be pursued to determine the limits of any wetland area and how much fill can be allowed within any wetland area. Sanitary sewer and storm drainage lines are proposed to be installed within the Swale. Since the swale contains slopes in excess of 25 percent and is a drainageway, the installation must comply with the Sensitive Lands requirement of the TMC Section 18.84.040. 5. The site is to be served by public sanitary sewer at the southeast corner of the site. The sewer service is to be provided by a local improvement district formed through the Unified Sewerage Agency. Tigard School District 23J has reviewed the proposal and has commented that the proposed apartment complex is located within the Templeton Elementary/Twality Junior High attendance boundaries. This complex is expected to generate 42 new students for Templeton Elementary and 69 students at Twality Junior High. Because 2.7 other developments are also now being planned c..- rinstructed, prospective occupants of this development should be advised that students may need to be bused to other schools in order to accomodate this growth. After the District completes its new middle school in 1992, there should be room available at Templeton Elementary and Twality Junior High schools to accommodate the anticipated additional students. The Tualatin Valley Fire and Rescue District has reviewed the proposal and has provided the following comments: 1. The District recommends that an emergency access be provided along the site's eastern boundary connecting with the internal roadways for the Sycamore Terrace Apartments; 2. "No Parking, Fire Lane, Tow Away" signs shall be posted at the turnaround on the eastern edge of the site in accordance with ORS 478.910; NOTICE OF DECISION - SDR 90-0003 - BARICEVIC Page 4 WW AM 3. Fireflow shall be provided an required by the Uniform Fire Code. NPO #6 has reviewed the proposal and has provided the following comments: 1. More lighting is needed in the proposed development's far southeast corner garage area; 2. The proposed landscape buffering along the southern border ►nay need to be increased; 3. The NPO recommends that one of the picnic areae be converted to a children's playground for the ties of the tenants; 4. The hammerhead turnaround for emergency vehicles in the southeast corner does not appear to provide adequate area in accordance with Code requirements. The Park Board has reviewed the proposal and has recommended tl.mit the eastern side of the site be left undeveloped. The Park Boar-i recommends that the developer consider a combination of sale and dedication of this area for development of a ravine/parkway connection with a trail to the Tualatin River Greenway. The Park Board feels that this proposed greenway connection would be a great asset to the proposed development as well as to the City. However., if development of this greenway area un the eastFrn third of this site cannot be accommodated, the Park Board would like the area within the drainageway to be dedicated for greenway purposes. The Building Division, Tigard Water District, General Telephone, PGE, and the Metro Area Communications Commission have reviewed the proposal and have issued no comments or objections. No other comments have been received. B. ANALYSIS AND CONCLUSION Proposed site improvements comply with Community Development Code R-25 zoning district (Residential, 25 units/acre) requirements for netbackb, building height (35 foot maximum height) , lot coverage (maximum allowed site coverage of *15%; 61% site coverage proposed) , and landscaped area (25% minimum required; 39% site .landscaping provided) . Multi-family residences are a permitted use in the R-25 zone. The proposed number of dwelling units, 172, complies with the permitted density standard as applied to thin parcel. Plan and Code standards would permit in excess of 200 residential units on this site. The proposal also complies with Code standards for internal roadway widths, total parking spaces (258 parking spaces required; 287 total NOTICE OF DECISION - SDR 90-0003 - BARICEVIC Page 5 I parking E )aces provided), covered parking (172 covered spaces required; 184 covered spaces provided), and provision of 6 designated handicapped parking spaces as required. The site plan also satisfies Code requirements for private and shared outdoor recreational areas, site and parking area lighting, and number of accesses. Issues of special significance regarding the proposal are detailed below: Landscaping/Buffering The landscaping proposed satisfies Code standards for amount of landscaped area and for street trees along Durham Road. Parking area landscaping requirements are also satisfied. However, modifications to the landscaping plan will be necessary to provide for an adequate number and type of street trees along the site's SW 113th Avenue frontage. The landscaping plan must also be revised to remove oversized landscaping materials from the required vision clearance areae at the intersections of internale driveways with SW 113th Avenue and to modify the fence at the site's 113th Avenue/Durham P.oad intersection. Landscaping, fencing, and signs within required vision clearance areas may not mock motorists' or pedestrians' vision between 3 and 8 feet above grade. In addition, the landscaping plan should be revised to provide additional landscaping or fencing along the site's southern and eastern borders to provide privacy for the residents of the proposed development and adjacent properties. The present landscaping plan calls for a combination of linden and maple trees along these borders. Additional understory landscaping or screening would serve to also provide low level privacy not afforded by these trees. Park Dedication/Park Access: Comprehensive Plan Policy 3.5.3 requires that developments which include land within and adjacent to floodplain areas and drainageways dedicate sufficient land area for the development of a greenway/open space system. The ravine on the eastern portion of the s.►bject site is designated as a drainageway on the Comprehensive Plana Floodplain and Wetlands map. The ravine is lirgely undevelopable because of its steep slopes. Several pieces of thio ravine have previously dedicated to the City of Tigard as conditions of approval of the Dover Landing II and Rebecca Park subdivisions and the Sycamore Terrace apartments. The site plan notes that the ravine area below the 140 foot elevation is intended to be dedicated an greenway in conformance with the preceding development approvals and City policy. It is recommended that the remainder of the heavily vegetated ravine area also be dedicated in order to better preserve thts important open space area. It in also recommended a public use pedestrian easement be provided between the head of the ravine and either SW 113th Avenue or SW Durham Road. In the event that rainy weather is encountered during site preparation, it may be necessary to suspend operations or use a clean granular material (i.e. , sand, gravel or crushed rock) , Granular fills can be constructed in any kind of weather and can be compacted to support even heavy structures with comparatively modest compactive effort. Structural fills should be spread in uniform lifts not exceeding 9 inches loose thickness with each lift thoroughly compacted by repeated coverages of loaded hauling equipment, heavy crawler tractors, or vibratory rollers. Fills should be compacted to 95 percent of maximum density as determined by laboratory compaction test AASHTO T-180. 4 . Foundations may be constructed in structural fill or in undisturbed native soil at shallow depth beneath finished grade (18 inch minimum) using bearing pressures of 2000 psf and a minimum footing width of 18 inches. 5. Foundation Preparation Inasmuch as the native soil units which will. provide support for the main portion of the structure are extremely sensitive to disturbance in the presence of excess moisture, care should be taken to protect prepared bearing surfaces until footing concrete can be placed. Precautions to achieve this end would consist of. (1) covering of prepared bearing surfaces with impervious membranes or granular blankets (4-in. minimum thickness) or (2) cessation of work during rainy weather . r'. Surface run-off (from roofs, parking areas, etc. ) should be tight-lined to the storm sewer or other approved disposal areas. 7 . Under no circumstances should surface run-off be led into foundation drains. 8 . Any areas or the building which are to be developed below the exterior site grade must be provided with a well-designed drainage system, in order to control hydrostatic pressure against walls, seepage of groundwater through base walls, etc. 9 . Prior to placing base course the subgrade should be proof- rolled with a loaded dump truck to detect areas or pockets of unusually soft material . These should then be excavated and replaced with suitable compacted fill . The civil engineer for the project may have more traffic and project design data available than is presently known and may wish to modify and refine these pavement sections. We will , upon request be pleased to provide a more detailed pavement design when definite traffic and building plans are available. 11 . We request that we examine and identify soil exposures created during project excavatinns in order to verify that soil conditions are as anticipated.
