A variance Is requested from the 7,500 square foot mini-num lot size of the R-4.5 zone (Residential, 4.5 unite/acre) . Location: 11895 SW 113th Court (WCTM 1S1 34DC, Tax Lot 3602; . DECISION: Notice is hereby given that the Planning Director's designee for the city of Tigard has APPROVED the above requests subject to certain conditions. The findings and conclusions on which the decision is based are noted below: A. FINDINGS OF FACT 1. Background An essentially identical minor land partition proposal was approved by the Planning Division on October 1, 1990 The application also included a lot line adjustment to adjust the common boundary between tax lot 3602 and tax lot 3600 to the east so as to create parcels of 53,470 and 9,256 square feet. The applicant Is pursuing completion of the lot line adjustment sepa_ate from the current application. The partition plan approved in Octot,er, 1990, was intended to result in building lots esti::iated to range in size from 7,500 to 9,500 square feet. However, upon a detailed survey being conducted in order to prepare the final partition plat, it wan determined that the original topographic maps used to assess the property were incorrect with regard to the amount of tax lot 3602 that is within the 100 year floodplain of Summer Creek. Because there is not ennugh upland area w;-thin tax lot 3602 to create the three parcels proposed by ttre earlier partition application at a size at least as large as the 75OG square foot minimum lot size of the R-4.5 zone, partitirn approval is now being applied for with a slightly different plan. No other previous land use or development applications regarding these parcels have been reviewed by the Planning Division. 1. Vicinity Information The subject parcel is surrounded by other properties zoned R- 4.5. Properties to the north and east are developed with NOTICE OF DECISION - VAR 91-0005/MLP 90-0017 - LLOYD OLSON PAGN 1 a . single family residences on lots close to the minimum lot size for the R-4.5 zone and therefore do not have potential for further re-division. Parcels to the south and west primarily contain floodplain of Summer Creek. Some of these parcels have single family residences on them, although the residences are located some distance from the subject parcels. None of the adjacent area of Summer Creek is under public ownership at this time except for an approximately 4,000 square foot tract to the northwest that was dedicated to the City as a condition of aoproval of the Dawn's Inlet subdivision. SW 313th Place provides access to this parcel and other ,larcels to the north and east. SW 113th Place is a fully improved local street consisting of 34 feet of pavement, curb-j, storm drains and sidewalks on both sides. A short stub street extends westward from SW 113th Place providing direct access to the property. This stub street has 34 feet of paved width, is curbed, but contains no sidewalks. 3. Site Information and Proposal Description A single family residence and several outbuildings were previously located on Tax Lot 3602. The house has recently been demolished. The area surrounding the house's former location includes several fruit, nut, and landscaping trees and bushes that are now quite overgrown. The remainder of the parcel contains a number of trees, brush and wild grasses leading down to the floodplain of Summer Creek. A 20 foot Hide sanitary sewer easement crosses the southeast corner of the property and an 8-inch sanitary sewer is located within this easement. In addition, a 1 -foot wide sanitary sewer easement extends roughly northwest to southeast through the floodplain area. This easement contains a Unified Sewerage Agency sanitary sewer. trunkline. As noted above, the applicant is in the process of adjusting the common boundary between tax lots 3600 and 7602 so that the parcels will be modified from their current sizes of 18,295 square feet and 44,431 square feet to parcels of approximately 9,256 and 53,470 square feet as approved by the Planning Division's decision for MIS 90-0014. The lot line adjustment is illustrated on attached Map One. The applicant requests minor land partition approval to divide the resulting 53,470 Square foot parcel into 3 parcels ranging in size between 7,068 to 7,316 squAre feet. A variance :is requested from Community Development Code Section 18.50.050.A.1.a which specifies a 7,500 square foot minimum size for lots in the R-4.5 zone. NOTICE OF DECTSTON - VAR 91-0005/MLP 90-0017 - LLOYD OLSON PAGE 2 A common access tract would be provided at the western end of SW 113th Court leading into these parcels. The access tract would consist of a paved hammerhead style turnaround area. Each of the four parcels to be served by the private road are proposed to have an equal and undivided one-quarter interest in the access tract and will be responsible for the operation and maintenance of the road. In addition, approximately 0.63 acre within the Summer Creek floodplain is proposed to be dedicated to the City of Tigard for floodplain and open space purposes. The proposed partitioning is illustrated on Attached Map Two. The lots are proposed to be provided with publi- water service through an extension of a water line from SW 113th Place. Sanitary sewer service will be provided through construction of separate sanitary sewer laterals from the homes to the existing 8-inch City of Tigard sanitary sewer in the southeastern corner of the parcels. Storm drainage from the parcels is intended to follow the natural drainage to Summer. Creek. Storm drainage from tho private roadway is intended to flow eastward onto SW 113th Place and into existing catch basins approximately 100 feet to the east. 4. Agency and NPO Comments NOTE: BECAUSE THE PROPOSED PARTITION IS ESSENTIALLY THE SAME AS WAS PROPOSED AND APPROVED FIVE MONTHS AGO, REQUESTS FOR COMMENTS ON THE PRESENT PROPOSAL WERE SENT ONLY TO NPO N7, THE CITY OF TIGARD BUILDING DIVISION, AND THE CITY OF TIGARD ENGINEERING DIVISION. COMMENTS ON THE EARLIER PROPOSAL ARE INCLUDED BELOW. COMMENTS ON THE PRESENT REQUEST ARE LISTED AS SUCH. The Engineering Division has reviewed the prop.3sed partition and has offered the following commence: a. Access is provided by S.W. 113th Place, a public local street with a right-of-way that is 40 feet wide. The existing road is 24 feet wide, has curb on both sides, and a 5 foot sidewalk on the south side. b. The site drains to the south to Summer Creek. C. Sanitary sewer service would be provided by individual laterals connecting to an existing line along the back of the proposed lots. No additional extension of the line is required. d. The Unified Sewerage District has established and the City has agreed to enforce Surface Water Management Regulations requiring the construction of on-site water NOTICE OF DECISION - VAR 91--0005/HLP 90-0017 - LLOYD OLSON PAGE 3 V quality facilities or fees in lieu of their construction. Requiring sarface water quality facilities on small sites could result in numerous facilities that could become a maintenance burden to the City. Furthermore, the applicant has not: proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities. Regional facilities, funded by fees in lieu of construction of these facilities, would provide the required treatment with improved reliability and less maintenance. Consequently a fee in lieu of the construction of on-site water quality facilities should be assessed. e. The Engineering Department has no comment on the proposed variance to the minimum lot size of the zone. The Building Division has reviewed the proposed partition and offers tho following comments: a. The private access drive shall be constructed prior to Issuance of any building permits. The construction of the private drive shall be inspected by the Engineering Department. b. The 100 year floodplain shall be clearly identified in the field prior to the issuance of building permits . No fill material or debris of any kind will be allowed to encroach into the floodplain. i C. If the property hnB not participated in the construction of a public sewer, the lots will be subject to a $3000 sanitary sewer assessment. d. A plan shall be submitted showing the former location of the house on the property, the proposed property lines, and the location of all underground utilities. e. The Building Division has no comment on the proposed variance to the minimum lot size of the zone. The City of Tigard Park Board requests that the applicant dedicate "Tract A -- Flood Plain and Open Space" to the City. At the Board's meeting, it was noted that public ownership of this parcel is important tc: the City's open space plan. The Park Board was ambivalent on whether publL� access from "Tract B -- Private Drive" was necessary because the area is not expected to serve as an active recreational area but more as open space for flood protection and wildlife habitat purroses. The Board _felt that limited public access could beat be provided from another point, up or downstream as additional areas are acquired. NOTICE OF DECISION - VAR 91-0005/MLP 90-0017 - LLOYD OLSON PAGE 4 Neighborhood Planning Orlanizatior. #7 recommends denial of the requested variance to the R-4.5 zone's minimurr, lot size. The members noted that the ^ -ld react favorably to the proposal if the request was prc^eased through the planned development review a in order to assure that all neighborhood concerns aL�- taken i:.to account. The NPO members see the issue as a matter of proce.iure. The Tigard Water District, Tualatin Valley Consolidated Fire District, Portland General Electric, General Telephone, and the Metropolitan Area Communication Commission (cable television) have reviewed the proposal and have not offeree, comments or objections. No other continents have been received. B. ANALYSIS AND CONCLUSION Minor Land Partition The proposed minor land partition, as shown on Map 2, complies with the Minor Land Partition Approval criteria specified by Sections 18. 162.030 and 18.162.050 of the Community Development Code, with thc, exception of consistency with the minimum lot size of the R-4.5 zoning district. The variance is considered separately below. The ini.nor land partition approval criteria are: 18.1622030 Partition Approval Criteria - A request to partition land shall meet all of the following criteria: (1) The proposal conforms with the City's Comprehensive Plan; (2) The proposed partition complies with all atatutory and o•.dinance requirements and regulations; (3) Adequate publ+.c facilities are avai:able to serve the proposal; (4) All proposed iota conform to the size and dimenPional requirements of this Code; and (5) All proposed improvements meet r7i.ty and applicable agency standards. 18.162.05C_ Special _Provisions for Lots Croated Through Partition Proc%.es (a) Lot Width. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. Nr�I - , OF D^CISIGN - VAR 91-0005/14LP 90-0017 - LLcvD OLSON PAGE 5 (b) Lot Area. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. (c) Lot .Frontage. Each lot created through the partition process shall front a public right-of-way by at least 15 feet. (d) Setbacks , Setbacks shall be as required by the ,ipplicable zoning district. (e) Frcnt Yard Determination for Flat Lot. When the partitioned lot ie a flag lot, the developer may determine the location of the front yard, provided that nu side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. (f) Screeninq on Flag Lots. A screen shall be provided along the property line of a lot of record where the paved drive in and acceeeway is located within 1C feet of an abutting lot in accordance with Sections 18.000.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and .o provide usable outdoor recreation areas for proposed development. (g) Yire Prot -tion. The Fire District may require the installatic of a fire hydrant where the length of an accessway would have a detrimental efect on fire-fighting capabilities. (h) Reciprocal Easemprts. Where a common drive iu to be provided to serve more than one lot, a reciprocal easement which will ineure access and maintenance rights shall be recorded with the approved partition map. (i) Acceesway. Any accessway shall comrly with the standards set forth in Chapter 18.108 (Access and Egress) . The proposed partitioning would promote in-filling of vacant and underdeveloped residentially designated property within an otherwise developed area, and thus would promote development at or near t'ie density called for by the Compreheneive Plan for this area. The proposal complies with applicable requirements of the Plan and Community Development Code. All propored parcels meet the R-4.5 zone's average minimum lot, width (50 feet for detached dwelling units) and are shaped so that homes can be constructed on the lots without requiring variances to setback or. ocher dimensional criteria of the zone or other Code dimensional standards. A variance IF; requested tc all-w the proposed parcels to be less than th• 7,500 square foot minimum lot size of the R-4.5 zone. That request is addressed separately below. NOTICE OF DECISION - VAR 91-0005/MLP 90-0017 - LLOYD OLSON PAGE 6 Adequate public facility capacities for water supply and sanitary sewer service cyists. Water service is available to serve the site from an existincl line in SW 113th Place. Sanitary sewer lines already erose this property and provide a variety of options for connecting to sanitary sewer service. The proposed drainage to Summer Creek and to the catch basins in SW 113th Place should provide adequate storm drainage for the development. Public service and utility agencies have reviewed the partiteion plan and have not commented that the proposal would confl3.ct with their development standards. The preliminary plat notes that all public works improvemer.ts will be constructed to the City of Tigard standards and specifications. The proposal also complies with the other special provisions for lots created through the partition process. All three lots to be created through the partition process will have greater than 15 feet of frontage on a private right--of-way and will be provided with access to a public right-of-way through the commonly held and maintained private drive. A fire hydrant is located within an aprropr'_ate distance for all proposed lots. A blanket easement for ingress, egress, drainage, water supply and public and private utilities is proposed to be recorded for the private drivt� area. No flag '.ots are being created; therefore, ther, is no requir.ment for screening. Setbacks will be reviewed upon the submittal of development plans for each of the lots. The proposed private drive complies with the standards set forth is chapter 18.108. That chapter allows private roadways to serve no more than six dwell'ng units as long as the private drive contains a minimum of 24 feet of pavement and a sidewalk on one side of the i private drive. The proposed private drive would be 34 feet wide where it connects to :,W 113th Place, narrowing to 20 feet in width in the turnaround areas. A sidewalk would be provided alonq the southern edges of the private drive. The design of the private drive constitutes an appropriate size and shape for a turnaround for emergency vehicles. Variance to Minimum Lot Size Stande_-d The applicant requests variance approval to allow the three lots proposed to be created through the minor land partition to range in size bEcween 7,068 and 7,376 equ"i.- feet rather than the 7,500 square feet minimum lot size required by the R-4.5 zone. At the time of the earlier application, the lots were planned to range between 7,500 and 9,500 square feet in size. The survey done for the final partition. plat resulted in a finding that the area of the parent parcels with+.n the 100 year floodplain of Summer Creek is substantially larger than had been previously assumed, thereby leaving lees area outsLle of the floodplain for division into the Iota. The land within th.: 1.00 year floodplain will be required 'co be dedicated to the City of. Pigard for park and open apace purposes. NOTICE OF DECISION - VAR 91-0005/MLP 90-0017 - LLOYD OLSON PAGE 7 Section 18.134.050 of the Code contains the following criteria for approval of a variance to a Code requirement: 1. The proposed variance will not be materially detrimental to the purposes of this Code; be in conflict with the poli.:ies of the Comprehensive Plan; to any cther applicable policies and standards; and to other properties in the same zoning district or vicinity. 2. There are special circumstances that exist which are peculiar to the lot size or shape, topography, or other circumstances for which the applicant has not control and which are not applicable to other properties in the same zoning district. 3. The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting come economic use of the land. 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code. 5. The hardship is not self-imposed and the variance requested is the minimum variance which would eliminate the hardship. The applicant states that the variance is requested in order to allow the property to be divided into a reasonable number of lots, considering the large amount of the original site area that will bea required to be clodicated for public purposes. Forty four percent of the original site would be dedicated for public purposes. The applicant purchased the property after consultirg topographic maps which showed that i.;,ere was more area outside of the floodplain than the recent survey indicates. The applicant relied upon the topographic maps in determining that there would be an opportinity for four lots to be created from the parent parcels. Staff agrees that in light of this unusual situation, requiring all lots to be created co be tulle consistent with the 7,500 square foot minimum lot size of the R-4.5 zone, thereby limiting development of tax lots 360^ and 3602 to three lots, would create an undue hardship for the applicant. This would be an especially severe situation for the applicant 3.n light of the requirement for dedication of over 44 percent of the site within the floodplain for public purposes. Community Development Code Chapter 18.92.030 permits a residential density transfer of 25 percent of the housing opportunities from floodplain areas to the buildable portions of the site, thereby allowing smaller lot sixes. The density transfer is permitted only when the development application is reviewed as a planned development. This approach would appear to allow the applicant the number of lots he seeks. However, staff advised the applicant that \ NOTICE OF DECISION - VAR 91-0005/MLP 9f-0017 - LLOYD OLSON PAGE 8 prior to submittal of the application that the planned development review process would riot be the preferred approach for review of the proposed development for several reasons. The planned development review proce3s is typically intended for larger sites than the subject 1.44 acres (including tax lot .3600) , especially if the property is not already zoned with the PD (planned development) overlay zone. Staff typically would not recommend rezoning a site this small with a zone different than surrounding properties, even If the requested zone is an overlay zone. In addition, the proposed development would not contain other typical elements of a planned developnient such as reduced setbacks, common privately-owned open space, or an unusual development pattern. The proposed development would appear to be a very typical small residential subdivision. In order for the proposal to be reviewed as a planned development, substantial fees and time would be necessary to process a zone chantle and planned development application for such a small project. Additionally, the Community Development Code apparently has presumed that variances to lot size standards are possible. Code Section 18. 164.060.a.1.c states that. . ." unless a variance has been granted, lot sizes shall not be less than the size required by this Title. " Therefore staff does not find it necessary, or practical, for this proposal to be reviewed as a zone change and planned development in order to obtain the housing opportunities needed. We do appreciate the NPO's comments and concern with regard to the necessary process but we feel that the NPO may have been unaware of some of the factors that entered into the staff's recommendation to the applicant regarding the proper application process. The variance request would not chancre the uses allowed on the parcels. The applicant intends to build single-family residences on the lots - the primary permitted use in the R-4.5 zone. The amount of variance requested is minimal. The average size of the proposed lots, would be 97 percent of the 7,500 square foot minimum lot size of the zone. At 7,068 square feat, parcel 1, the smallest of the proposed lots, would be 94 percent of the minimum lo:: size. No adverse effects upon adjacent parcels are foreseeable. Because of the amount of open space adjacent to the proposed lots, the slightly smaller size of thene iota will not be noticeable compared to other lots in the area. Most of the neighboring parcels are also close to 7,500 square feet in size. Most of these lots are not adjacent to open areas like the subject parcels. No adverse impacts r1pon physical or natural systems resulting from the requested variance are foreseeable. Site Information and Proposal�Veacription A single family residence ands,several outbuildings are located on Tax Lot 3600. The house has L"n abandoned for some time and shows evidence of being vandalized And has been reported to the City as being used as a gathering placd for neighborhood children. The area surrounding the house includes several fruit, nut, and landscaping trees and bushes that are now quite overgrown. The remainder of the parcels contains a number of trees, brush and wild gran aes leading down to th® floodplain of. Summer Creek. A 20 foot wide sanitary sewer easement crosses the southeast corner of the property and an 8-inch sanitary sewer is located within this easement. In addition, a 10-foot wide sanitary sewer easement extends roughly northwest to southeast through the flcodplain area. This easement contains a Unified Sewerage Agency sanitary sewer trunkline. The applicant proposes to adjusts the commot: boundaries between tax lots 3600 and 3602 so that the parcels will be modified from their current sizes of 18,295 square feet and 44,431 square feet to parcels of approximately 9,256 and 53,470 square feet. The proposed lot line adjustment is illustrated on the attached map. 1 The ap.A.i.cant also requests minor land partition approval to divide the resulting 53,470 square foot }parcel into 3 parcels ranging in size between 7,500 and 9,500 squats feet. A Camm�n access tract would be provided at the western end of SW 113 Court leading into these parcels. The access tract would co si$t of a paved hammerhead style turnaround area. Each/ of, t 4 parcels are proposed to have an equal and undivided oro-quart interest in tho access tract and will be responsible fvr, the operation and maintenance of the street. In addiltiou, roximately one half acre within the Summer Creek flood lain is tosed to be dedicated to the City of Tigard for floodplls Apd open space purposes. The proposed partitioning is illustrated on thq attached map. '1 The four lots are proposed to be provided with public water service through an extension of a water line from $W 113th Place. Sanitary sewer service will be provided t)hroug4 construction of four separate sanitary sewer laterals from the flumes to the existing 8- inch Cit} of Tigard sanitary sewer in the \southeastern corner of the parcels. Storm drainage from the parcel is intended to follow the natural drainage to Summer Creek. Sturm drainage from the private roadway is intended to flow eastward onto SW 113th Place and into existing catchbasina approximately 100 feet to the east. 4. Agency and NPO Comments The Engineering Division hr.s reviewed ther sed partition and has offered the following comments: NOTICE. OF DECISION - MIS 90-0014/MLP 90-0017 - LLOYD OLSON PACE 2 a. Access is provided by S.W. 113th Place, a pub13^ local street with a right- .-way that is 40 feet wide. The existing road is 24 set wide, has curb on both sides, and a 5 foot sidewal an the south side. b. The site drains to, the{ Outh to Summer Creek. C. Sanitary sewer s ry would be provided by individual. laterals connectihg_t an existing line along the back of the proposed lots. No additional extension of the line is required. d. The Unified Sewerage District has established and the City has agreed too enforce Surface Water Management Regulations requiring the conetruL;tion of on-eite water qual!.ty facilities or lees in lieu of their construction. Requiring surface water quality facilities on small sites could result in numerous facilities that could become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities. Regional facilities, funded by fees in lieu of construction of these facilities, would provide the required treatment with improved reliability and less maintenance. Consequently a fee in lieu of the construction of on-site water quality facilities should be assessed. The Building Di.vieion has revilewed the proposed partition and offers the following comments: 1. The private access drive sha 1 ba '�onst,'ructed prior to / Issuance of any building permits. 2he construction _of the private drive shall be in"ctecA by the Engineering Department. 2.. The 100 ear floodplain shall be clearly identified in the field prior to the iwouance of building permits. No fill material or debitie,'of any kind will be allowed to encroach into the floodplain. 3. If the property has not participated in the construction of a public +wer, the lots will be subject to a $3000 er sanitary sewasseesmeht. 4. If the existing house and outbuildings are to be removed, a demolition permit is required. 5. If the existing ho s �ed to remain, it shall be boarded up so that no unau �o ipersons can gain entry until :.ach time as the ho " is returned to residential use. A NOTICE OF DECTSTON - MIS 90-0014/MLP 90-0017 '4- LLOYD OLSCA PAGE 3 plan shall be submitted showinq the location of the house on the property, the proposed property lines, and the location of all underground utilities. The City of Tigard Park Board requests that the applicant dedicate "Tract A -- Flood Plain and Opcan Space" Lo the City. At the Board's meeting, it was noted that public ownersh'.p of this parcel Is important to the City's open space plan. The Park Board was ambivalent on whether public aCCess from "Tract B -- Private Drive" was necessary because the area is not expected to serve as an active recreational area but more as open space for flood protection and wildlife habitat purposes. The Board felt that limited public access could best be provided from another point, up or downstream as add.Ltionai areas are acquired. The Tigard Water District, Tualatin Valley Consolidated Fire District, Portland General Electric, General Telephone, and the Metropolitan Area Communication Commission (cable television) have reviewed the proposal and have not offered comments or objections. No other comments have been received. B. ANALYSIS AND CONCLUSION Lot Line Adjustment The proposed lot line adjustment is consistent with the Community Development Code criteria for approval of a lot line adjustment. No additional lots will be created through the adjustment between Tax Lots 3600 and 3602. Neither of the lots involved in the adjustment would be reduced below the minimum lot since for the R-4.5 zone. All applicable lot dimensional and setback standards would be satisfied for both lots through the lot line adjustment alone, as long as the house is removed prior to recording as the applicant intends. Minor Land Partition The proposed minor land partition, as shawn on Map 2, complies with the Minor Land Par.titicn Approval criteria specified by Sections 18.162.030 and 18. 162.050 of the Community Development Code. Those criteria are: 18._162.030 Partition Approval Criteria - A request to partition land shall meet all of the following criteria: (1) The proposal conforms with the City's Comprehensive Plan; I (2) The proposed partition complies with all statutory and ordinance requirements and regulations; (3) Adequate public facilities are available to nerve the proposal; NOTICE OF DECISION - MIS 90-0014/141.P 90-0017 - LLOYD OLSON PAGE 4 (4) All proposed lots conform to the size and dimensional requirements of this code; and (5) All proposed improvements meet City and applicable agency standards. 18.162.050 Special Provisions for Lots Created Through Partition ProcEas (a) Lot Width. The minimum width of the building envelope areF. shall meet the lot requirement of the applicable zoning district. (b) Lot Area. The lot az^a shall be as required by the applicable zoning district. In the case of a flag lot, the ac^eaaway may not be included in the lot area calculation. (c) Lot Frontage. Each lot created through the partition procesi shall front a public right-of-way by at least 15 feet. (d) Setbacks. Setbacks shall be as required by the applicable zoning district. (e) Front. Yard_ Determination for Flat Lot. When the partitioned lot .is a flag lot, the developer may determine tha location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be to,-ziued so as to maximize separation from existing structures. (f) Screening on F1aq Lots. A screen shall. be provided along the property line of a lot of record where the .)aved drive in and acceesway is located within 10 feet of aii abutting lot in accordance with Sections 18.000.080 and 18.'L00.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation, areas for proposed development. (g) Fire _ Protection. The Fire District may require the installation of a fire hydrant where: the length of an nccesaway would have a detrimental effect on fire-fighting capabilities. (h) Reciprocal Easements. Where a common drive is to .tee provided to serve more than one lot, a reciprocal easement witch will insure access and maintenance rights shall be recorded with the approved partition map. (i) Accesaway. Any accessway shall comply with the standards set forth in Chapter 18.108 (Access and Egress). The proposed partitioning would promote infilling of vacant and underdeveloped residentially designated property within an otherwise NOTICE OF DECISION - MIS 90-0014/HLF 90-0017 - LLOYD OLSC:4 PAGE 5 developed area, and thus would promote developmentat or near the dennity called for by the Comprehensive Plan for this area. The proposal complies with applicable requirements of the Plan and Community Development Code. All proposed parcels meet the R-4.5 zone's minimum lot size standard (7,500 square feet), average minimum lot width (50 feet for detached dwelling units), and, because the existing house and outbuildings will be required to be removed prior to recording or alternatively it will be necessary that the existing buildings be shown to comply with setback standards after the parcels are created, the proposed partitioning will not result in any encroachment upon required Betbacks of the R-4.5 zone. Adequate public facility capacities for water supply and sanitary sewer service exists. Water service is available to service to the Bite from an existing line in SW 113th Place. Sanitary sewer lines already cross this property and provide a variety of options for connecting to sanitary sewer service. The proposed drainage Summer Creek and to the catch basins in SW 113th Place should provide adequate storm drainage for the development. Public service providing reviewing agencies have reviewed the partition plan and have not commented that the proposal would conflict with their development standards. The preliminary plat notes that all public works improvements will be constructed to the City of Tigard standards and specifications. The proposal. also complies with the other special provie,ions for lots created through the partition process. All three lots to be created F through the partition process will have greater than 1.5+ reet of frontage on a private right-of-way and will be provided with access to a public right-of-way through the commonly held and maintained private drive. A fire hydrant is located within an appropriate distance for all proposed lots. A blanket easement for ingress, egress, drainage, water supply and public and private utilities is proposed to be recorded for the private drive area. No flag lots are being created; therefore, there is no requirement for screening. Setbacks will be revie d upon the submittal of development plane for each of the lots. The proposed private drive complies with the standards sot forth in Chapter 18.108. That chapter allows private roadways to serve no more than six dwnllinq unite ova long as the private drive contains a minimum of 24 feet of pavement and a sidewalk on one aide of the private drive. The pro—sed private drive .could be 34 feet wide where it connects to SW 113th 1 _ace, narrowing to 20 feet in width in the turnaround areas. A sidewalk would be provided along_, the southern edges of the private diivP. The design of the private drive constitutes an appropriate size and shape for a turnaround for emergency vehicles. C. DECISION The Director' s designee APPROVES Lot Lire Adjustment MIS 90-0014 and Minor Land Partition MLP 90-0017, subject to the following conditions: UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL HE MET PRIOR TO RECORDING THE IAT LINE ADJUSTMENT/PARTITION PLAT WITH WASHINGTON COUNTY.
