A. i I,NDING OF FACT 1 . Background No previous land use applications have been reviewed by the City Pe(-Tarding this property . Earlier this year, an application for a Lot Line Adjustment (M 6--86), 'Subdivision (S 13-86), and Variance (V 1.3---06) was submitted but it was withdrawn prior to the public hefiring. 2. Vicinity Information Properties to the north and sough are also zoned R- 4.5 and developed with single family r•e.idances. The western portion of the property is bordered by 114th Avenue and single family homes zoned R--•2 (Residential, 2. units/acra) lie beyond. Land zoned R--12 (Residential, 1.2 units/acre) is immediately east of 112th Avenue and to the southeast. 3 , Site Information and Proposal. Description The property is vacant except for one residence facing 114th Avenue (T.L, 2300) , Tax Lot 2.200 has frontage on 112th Avenue plus a 2.8 foot wide access strip to 11I,th Avenue. Tho applicant proposes to first combine the access strip for Tax Lot 2300 with Tax Lot 2200 which contains the house, Tax Lot 22.00 is then to be into three lots with direct access to 11.2th Avenue. City policy requires the improvement of all abutting street right-of--way and since no street is necessary, Cho. applicant should initiate vacation proceedings . C. The subject property was within `_-he boundaries of the Derry Dell Trunk Sanitary Sewer L.I.D. (Bancroft 04) and City records indicate all assessments have been paid, d. Because complete storm sewer facilities do not serve this area, the applicant should execute a non-remonstrance agreement to participate in a future local improvement district (L,I,D. ) for storm drainage facilities. The Building Inspection Division and P.G.E. have no objection to the proposal . The Tualatin Rural Fire Protection District notes the fire hydrants must be within 500 feet of all structures. No other comments have been received . B. ANALYSIS AND CONCLUSION The proposed lot line adjustment is consistor.t with Community Development Code criteria relatod to lot size, building setbacks, and access . The proposed is not totally consistent: with lot dimension requirements as noted in the variance discussion below: Section 10 . 164.060(a)(2) states that the depth of any lots created may riot exceed 2 -1/2_ times the average width. In order to approve such a variance, the following criteria from Section 18. 134 of the Code must be satisfied: (1 ) The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity; (2) There are special circumstances that exist which are peculiar to the lot size or shape, topography or other, circumstances over which the applicant has no control, and whict are not applicable to other properties in the same zoning district; NOTICE OF DECISION -- MLP 10--86, M 13 86, & V 30--86 - PAGE 2 (3) The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonable possible, while permitting some economic use of the land; (4) Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms, or parks will not be adversely affectad anymore_ than would occur if the development were located as specified in the Code; and (5) The hardship is not self--imposed and the variance requested is the minimum variance which would alleviate the hardship. Lots with frontage on 112th Avenue after right--of--way dedication will be 159 feet in length and 52.2 feet in width. The lots exceed the maximum length by approximately 21 feet after the right-of--way dedication requirement is fulfilled. The purpose of this standard is to avoid the creation of parcels that can not be redivided or redeveloped when appropriate and that do not waste land by being excessively long and narrow. In this case, the applicant has virtually no other option for, dividing the property and all lots meet or are close to complying with this lot dimension standard, The proposed creation of single family residential lot of over 7,500 square feet is consistent with the raquiremernts of the R-4 .5 zone and the variance will. riot have any affect upon physical. or natural systems . The hardship is not self-imposed acid given the size and dimensions of the property, the applicant does not. have any other realistic options for dividing the property is another manner. C.
