Reilly, City Administrator Subject: Request for reimbursement of sewer costs. Issue: A citizen has made a request to the City for reimbursement of costa incurred in extending the public sanitary sewer, and requiring another property owner to pay a sewer surcharge for not particiYating in the coat of extending the public sewer. The staff has attempted to resolve the issue between the two owners involved, with no success. The staff has no authority to effect any refund for sewer extensions. The questions before the Council are: 1. Should t:.- ^-icy reimburse a citizen for part of the cost_ incurred in extending a public sewer, were no previous agreement for payback has been made? 2. Should the City force payment of a sewer surcharge on a citizen who was inadvertently not charged at time of issuance of a permit? History: Mr. Steve Knebel (14535 SW 97th Ave) has requested that he be reimbursed for one-third the cost of a public sewer he was required to build in 1984. Please see his attached letter. In May of 1984, Mr. Steve Knebel made a request for a minor land partition to create two residential. lots. One lot was contained an existing house, the other was for construction of a new residence. A condition of approval of the partition, was that Mr. Knebel extend the public sanitary sewer 80 feet to serve the new and existing residences. Mr Knebel complied with the condition, divided the lots and constructed the new residence. Mr. Knebel eventually sold the property with the existing house (14525 SW 97th Ave) to Mr. Jim Corliss (9750 Sw Inez St) . Along with the sale of the existing house went the rights of sewer participation for the property. In February cf 1988, Mr. corliss made application to conn•3ct his property at 9750 SW Inez St to the public sewe-•. Because he owned the property at 14525 SW 97th Ave, he granted himself an easement to through that property to connect to the available sewer lriteral (and transferred participation to the sewer extension from that property to his 9750 SW In,3z St) . The property at 14525 SW 97th Ave was to pay the $3000.00 "In Lieu of Assessment" fee wn•,en it lllilla -- - - illiiillllrd - III! - -- I connected to the sewer at a later date. [luring the course of excavation to connect his home to the sewer, Mr. Corlien found that the property at 14525 SW 97th F.ve had already been connected to the sewer, there was however, no records of a permit issued to connect the house. Mr. Corlisb requested that the City allow him to connect both houses to the same sewer lateral, along with him paying for the p.,cmit for 14525 S4 97th Ave. The City approved the connection and Mr. Corliss paid the permit fees for connec..ion of both houses (however the "In Lieu of Assessment " fee was inadvertently not charged) . It would seem that Mr. Knebel would have recovered eons c:r his costs when he sold the property at 14525 SW 97th Ave, because the property would have had a greater value with sewer available to it. His bel-ng required to extend the public sewer did however, result in the benefit to Mr. Corliee's property at (9750 SW Inez) . Alternative "A": 1. Deny Mr. Knebel's a request. 2. Approve Mr. Knebel's reque©t, refunding to him 1/3 the cost of construction. 3. Refund to Mr. Knebel 1/6 the cost of the sewer. Mr. Knebel should be entitled to recove•- a maximum of 7./3 the cost of the sewer. Since Mr. Knebel sold the lot with the existing house (14525 SW 97th Ave) he would presumably would have .included in the selling price 1/2 of his cost for the sewer, thus he has recovered 1./2 of the cost as of this date. The 1/6 refund would therefore provide Mr. Knebel with a total recr�,Pery of 2/3 the cost. Alternative "B": 1. Take no action to require Mr. Corliee to pay any further sewer surcharge fees. 2. Require Mr. Corliss to pay the $3000 "In Lieu of Assessment." fee, as ?rescribed by City Ordinance. 3. Require Mr. Corliss to pay an "In Lieu of Asoesement" fee equal to 1/6 the cost of the sewer. Each property would then have been assessed an equal. share of the cost. Mr. Knebel has submitted copies of bills for the work. The total of the appropriate chargee to be considered is $8,922.00. The Council decided that Mr. Knebe_'. should have mr-Ze `±Ls request for an agreement- in 1984, before the sewer was constructed. Mr. Knebel's request was denied. As for whether Mr. Corliss should be charged the "1n Licu of Asnessment " fee, the Council decided that the, City made a mistake in not collecting the fee, and It should be the city's loss. Mr. Ed Murphy Dear Mr. Murphy, In May of 1984 application was made to the City of Tigard for a minor land partition of a piece of property at 14535 SW 97th, Tigard. The following is a list of events that led to the writing of this letter. 1. Sewer service was necessary as -t condition of the Minor Land Partition. 2. In planning the minor land partition the city made it clear that they were doing us a favor by allowing us to hook to the existing sewer system, as it would tax the already overloaded line. In addition the city stated that we would be the only two homes to ever hook to this line. (reference the existing ana proposed honic.) Mr. Frank Curry, of the city of Tigard, went on to mention that any sewer addition to service Inez St. would require a new system to run down Inez and NORTH on 97th to another existing system. With this knowledge, Application was made for an casement across the newly planned lot to the clean-out that was at the southern boundary of the existing lot. Our intention was to avoid opening the newly recovered street and the expense of running 80 feet of "never to be used sewer line." 3. .pplication for the easement was turned down. Mr. Curry made it clear that a new sewer line would be run in front of the newly created lot (80 ft.) and we would submit engineering drawings to the city for approval. He also mentioned that the city "opens newly paved streets all the time". 4. Engineering drawings and application was made to the city and the plane were approved. Under Special Provisions/Conditions on the application it was noted. . "To be built to attach(ed) Approve(d) Plan." 5. Excavation was started in June 1984, and the first problem encountered was the existing line was 3 feet deeper than shown on the cities plans. This did not appear to be z major problem until the city came out and determined that it was deeper because the existing line was no graded as shown on their plans. Upon surveying the existing line, the city determined that it was virtually level. Evidently, according to the surveyor, the inspector missed this section of lire when the adjoining neighborhood was built. What was going to be a "clean-out" in our new extension was changed to a Manhole. We argued that the city should bear the additional cost but were informed ; y Mr. Curry that, . . . "it wasn't the City of Tigard's' idea to extend the sewer", and that if you "want a house here, you'll put it in." 6. The project was completed and both homes were hooked to the system. The existing house was sold in early 1986 to the neighbor to the west. 7. in the summer of 1988, an easement was granted to the new owners on SW Inez to run through the property thty purchased, (The same property we were turned down on) to hook to the sewer that we paid for. This brings up a question: Since the owner obviously did not have to extend the system, was the new owner asked to contribute to the System Development Fond? If so, I would be interested in seeing the receipts and applicable paperwork. Enclosed are copies of receipts. checks, permits, plans, etc. I am asking that the city take into consideration that the s,wer is now serving more homes than was originally intended, and that the City Mr. Ed Murphy 18 December, 1989 - Page 3 of Tigard participate in the c( sts incurred in the construction of this line. I am aware that a condition existed to provide sewer service to both 14525 and 14535 SW 97th in order to obtain a building permit.
