The Buscha's were issued a permit, with bond required, under the provisions of this chapter. The Tigard City Council has approved all provisions wi.thin the Tigard Municipal. Code. With respect to Title 15, the Eroineering Division, formally a part of the now dismantled Public Works Department, is responsible for issuing these "Street Opening Permits", including accepting and releasing performance and maintenance bonds. As Manager of the Division, I am responsible for these acceptance and releases. Therefore, the Tigard City Council, through Title 15 of the Tigard Municipal Code, and the Department Director has given me the authority to release these bonds. An assignment is a transfer of ownership interest in all or a portion of a savings account to another party, usually to guarantee performance of a specific act. Accounts may be pledged as collateral for loans, assigned to the state .in lieu of posting a bond , or assigned to another individual . The person to whom the account is assigned has the authority to order Far West to withdraw all or part of the assigned monay from t ,e account and to pay him. This usually does not occur, and generally happens if the conditions establishing the. assignment are not fulfilled; i .e . , the loan is not paid . To establish an assignment, the assignment letter must be filled with Far West ; normally, Far west signs the letter to confirm receipt and acceptance of the assignment , places a restriction on-line, and files a restricted withdrawal card with the signature card . CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW SDR 28-84 VARIANCE V 18-84 APPLICATION: Request by Emily Moellman for Site Development Review approval to convert a residential building into a commercial use and for a Variance to allow a 3-foot landscaped buffer along the western property line where 10 feet is required and to allow an 11 foot wide driveway widch where 12 feet is required. The property is zoned C-N (Neighborhood Commercial) and is located at 9960 S.W. Walnut St. (Wash. Co. Tax Map 2S1 2BD, Tax Lot 2200). DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described applications subject to certain conditions. The findings and conclusions on which the Director based his decision arca as noted below. A. FINDING OF FACT 1. Background In 1984, the City approved a variance request to allow the re-establishment of a residential use in the C--N zone (V 14-84). 2. Vicinity Information Commercial development zoned C-G (Commercial Gererbl) lies between the subject property and Pacific Highway. Other adjoining properties are developed and zoned R-12 (Residential 12 units/acre) . 3. Site Information and Proposal Description A residence and detached garage are located on the property which has been recently been rezoned to C:-N. The applicant proposes to use the building for a personal service type of business. A one-way, loop driveway with six parking spaces in the rear IF; envisioned. The applicant intends to keep the garage for storage purposes. A variance is also requested to allow a 3 to 6-foot wide landscaped buffer to the west and north where a 10-foot wide buffer is required by the Community Development Code. The applicant is also requesting that the landscaping requirements within this buffer area be reduced and that the driveway width on the south side be 11 feet. 4. Agency and NPO Comments The Building Inspection Office and the Tualatin Rural Fire Protection district have no objection to the request . The Engineering division has the following comments: NOTICE OF DECISION - SDR 28-84 b V 18-84 - PAGE 1 a. The driveway -just be one-way if two curb cuts are employed. b. Walnut Street is identified as a major collector route and therefore a right-of--way width of 30 feet from centerline is required. C. Half-street improvements to major collector standards is necessary. The applics,t is eligible for a credit towards the systems development charge which is equal to the difference in cost between a local and major collector street improvement. NPO 113 has no objection to the proposal including the variance application. B. ANALYSIS AND CONCLUSION The proposed conversion of the property is in basic conformance with Code requirements except for several standards related to parking lot design. The proposed site plan shows six parking spaces in the rear with a one-way driveway featuring an entrance on the south side of the property and an exit on the north. The! parking spaces as proposed have an insufficient aisle width between the building and the spaces. The Code requires four parking spaces for this type and size of business. The parking area should be redesigned to meet City standards. A design with four spaces in back and two compact spaces along the northern or southern driveway will achieve the applicant's desire for six spaces as well as conforming with City requirements. The garage presently has a 10-foot separation from the house. At least a portion of the garage must be removed to provide a minimum driveway width of 12 feet. It should be noted that the entire site plan could be Improved is the garage is completely removed. A variance is requested to allow landscaped buffers of less than 10 feet along t"e rarth and west property lines. In order to approve a variance, th, following review criteria must be addressed: 1. The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity. 2. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3. The use proposed will be the same as permitted under this Code and city standards will be maintained to the greatest extent that is reasonably possible, while permitting some economi; use of land; NOTICE OF DECISION - SDR 28-84 & V 18-84 - PAGE 2 i 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code; and S. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The purpose of the landscaped buffer requirement is to provide for the more compatible relationship between different uses which are adjacent. A 6-8 foot high wood fence which was constructed by the adjoining apartment development is on the north and west property line. A 10-foot landscaped area would not be visible from the apartments. The Code requires that landscaped buffers contain a combination of general cover, shrubbery and trees. Trees will be the only plants that would be apprec.ated by the apartment complex and a 10-foot area is not needed just for trees. i Because of the small size of the lot and location of the building, a 10-foot landscaping buffer would not allow enough space for the necessary parking. The proposed site plan should be modified to comply with the intent of the landscaping requirement as closely as possible. A revised landscaping plan should be submitted along with an adjusted parking arrangement which preserves as much of the existing vegetation as pc,ssible, including the large walnut tree in the rear yard. Also, additional trees should be planted ns required by the buffering regcirements of the Code. Criteria 4. does not apply in this case. The hardship is not self-imposed. the variance is the minimum necessary to comply with the City's parking requirements. The applicant has indicated a desire to amend the site plan to allow for para11el parking along the driveway between the house and the Circle K ` property. Preliminary measurements indicate that. a 20-foot distance I lies between the house and the property line.. In order to meet the parking space and aisle width requirements, a total of 21 feet is necessary (9-foot parking space, 12-Foot aisle width). The purpose of these dimensional requirements is to provide adequate space for parking and maneuvering. The proposed development will not generate large volumes of traffic and the one-foot variance will still provide sufficient space. C. DECISION The Planning Director approves SDR 28-84 and V 18-84 ,ubject to the following conditions: 1 . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MF_f PRIOR TO ISSUANCE OF BUILDING PERMITS. The Section will require posting of a 100% performance bond and the payment of a permit fee.
