During they rainy season and most of the winters, water is coming out of the ground in four or five different spots, rune to and under my house causing flondin� in the crawl opace and on the Bide of the house. DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director based his decision are at noted below. A. FINDING OF' FACT' 1 . Background No previous applications have been reviewed by the Planning Di�sision for this property . 2 . Vicinity Info-mation The subject property is bounded by R--4 .5 zoning to the north and east, C.-P (Professional Adirinistrati.ve Office Commercial) zoning across SW Pfaffle to the south and R-12 (Multi-Family Residential, 12 units per, acre) zoning to the west. Development in the vicinity is pr•edo-ninantly singl- family residential. with some multi-family units located to the west in the R-1.2 zone. Most of the properties in the C-P zone are lacant and undeveloped . 3 . Site Information and Proposal Description There is presently a single family residence with an attached garage on this property. The applicant is proposing to construct a 460 squaro foot; accessory structure on the sits to be located behind and 4:o the side of the main structure. 4. Agency and NPO Comments The Building Division has reviewed the proposal and had a concern about the proposed structure being built on or across a septic System drain field. No other comments were received regarding this proposal . R. ANALYSIS AND CONCLUSION the proposed accessory structure is consistent with Section 18. 144 of the Community Development: Code. (his section permits the construction of an accessory structure up to 500 square feet when a lot is under 2.5 acres. The applicant' s 400 square foot structure will he under the maximum allowable size. The site plan submitted by the applicant shows that. the structure will adhere to the minimum setback requirements of the Code. In this case, NOTICE OF DECISION - M 87-04 - DAVID ROBERTS - PAGE 1 setbacks for accessory structures may be no less than 5 feet from the side and rear property lines except on a corner lot where the side yard setback is increased to 15 feet. The proposed structure is to be located on a corner lot and will be required to maintain the 5 and 15 foot setbacks which are consistent with the applicant's site plan. A site inspection brought attentic^ to the use of an illegal access point from the property out to SW 83rd. Since the driveway exit is located on SW Pfaffle, the second access must be discontinued since it presents a safety problem for traffic approaching the stop sign on SW 83rd where it intersects with SW Pfaffle. C. DECISIk,N The Planning Director approves M 87-04 subject to the following conditions: 1 . All necessary building permits shall be obtained prior to construction, 2. The access onto SW 83rd shall meet access standards (at least 30 feet from intersection) or be discontinued and landscaped t.,:qr. 3 .
