The rise and run for the alteration to the stairs adjacent to the "eunroom` shall match the existing, and in no case exceed 7 inch rise or have less than an 11 inch run. No riser or tread shall have a variance of more than 3/8 of an inch from any other. 2. The landing in the "receiving, area shall not be more than one Inch below i the threshold of the door. There shall be stairs off the landing which comply with item 1 above. There shall be a handrail for the stairs in compliance with section 3306 (j) of the structural specialty code. The electrical conduit penetrating the two hour firewall shall be adequately firestopped. 3. The patching of holes in the two.-hour firewall, shall require that the face layer of gypsu4 board be cut back a minimum of 16 inches or to the next stud which ever is greater. The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1 . Background `.,o previous approvals have been granted by the City relating to '.ne development of the property (SDR 32-76, SDR 15-77) . 2. Vicinity Information 'he properties that are adjacent to the north and south alone Pacific Highway are also zoned C-{;. The property to the east :s zoned R-12 (Residential., 12 units/acre) and is developed with a nursing home. 3 . Site Information and Proposal Description The property is developed with two large retail building which have access to Pacific Highway . The subject property does no* contain any landscaping between the buildings and the easterr property line. The applicant plans to remodel the building and construct a sun room which will encroach upon tha required 20 foot rear yard setback by three feet . This addition will. be 16 feet in length and it will connect the two buildings. 4 . Agency and NPO Comments The Engineering Division and Building Inspection Office have no objection to the proposal . The Building Inspection notes that B-2 occupancy requires a ono hour fire wall construction for all walls with a setback of less than 20 feet. B. ANALYSIS AND CONCLUSION Section 18. 134.050 of the Code requires the following approval criteria for variance proposals: NOTICE OF DECISION - V 6-85 - PAGE 1 I !M MMM i141011A MR 1. The proposed variance will not be mater-ially detrimental to the purposes of this Code, be in conflict witil the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity; 2. There are special circumstances flat exist which are peculiar to the lot size or shape, topography o,- other circumstances ove,- which the applicant has no cintrol, avid which are not applicable to other properties in the same zoning district; 3 . The use proposed will be the same as permitted under this Code and City standards will be maintained t- the greatest extent that is reasonable possible, while perm ;,Ling some economic use of the land; 4. Existing physical and natural systems, such as but riot limited to traffic, drainage, dramatic land forms or parks will not be adversely affected many more than would occur- if the deve'opment ware located as specified in the Code; and 5. The hardship is riot self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The primary purpose of the setback standard:, for the C-G zone is to allow for adequate spacing. air, light, and privacy for adjacent residential structures.
