MINUTES TIC.ARD PLANNING COMMISSION August 21 , 1973 Twality Jr. High School - lecture room 14650 S.W. 97th Ave. 1. CALL TO ORDER A. The meeting was called to order at 8 :30 P.M. Proceeding the public hearing a study session was held which began at 7:30 P.M. 2. ROLL CALL A. Present : Commissioners Barkhurst, Lewis, Nicoli, Sakate, Mickelson; Chairman Whittaker; Planning Director, Wink Brooks; Associate Planner, Dick Bolen B. Absent: Commissioners Ball, Hartman and Fraizer 3. STUDY SESSION 3. 1 General Telephone Site Plan A. Staff presented the submitted site plan and recommended approval wi. L`h conditions which included additional landscaping as required by the Site Development Review Ordinance. B. Darrel Baker of Genera?. Telephone wRs present and stated that his company could comply with recommended staff changes. C. Lewis moved to approve the site plan with staff recommended conditions and Barkhurst seconded. The motion passed by unanimous vote of the Commission present. 3. 2 Kim' s Furniture Site Development Plan A. Staff presented the submitted site development plan and recommended approval with the condition that plant types, plant sizes and spacing be opacified and that Norway Maple replace the Vine Maple in the area show;) in paving stones. 8. Barkhurst moved to approve the submitted site plan with staff recommended conditions. Lewis seconded and the motion passed by unanimous vote of the Commission :resent. 3. 3 Puget Die Cast Site Development Plan A. Staff recommended disapproval of the submitted site development plan based upon findings which concluded that the applicant had not met the submission requirements of the Site Development Plan Review Ordinance. B. Mr. Van Thiel of Puget Die Cast presented his company ' s intentions for development of the site and requested ' that the Planning Commission approve the plan tc allow a building permit for their next anticipated expansion. C. N9coli stated that he was concerned that the Planning Commission is doing work more appropriately done by staff. He stated, "All they want is a building permit and they shouldn ' s have to come back every two weeks attempting to get approval. " D. Whittaker stated that the submitted site plan is not detailed enough and does not meet the minimum ordinance requirements. E. Lewis said that he deplores regulations which makes it nearly impossible for developers to carry out their business and said, "We are going off on a tangent. " F. Lewis moved to approve the submitted site plan with the conditions that: 1, Deciduous shade trees be provided and an additional tree be placed one-hundred feet north of the south property line. 2. The type and spacing :,F ivy to be planted in the 20 foot landscaped area adjacent the street right-oF-way be specified. 3. The assurance of maintenance of tI_ plant materials be provided. 4 . That the loading berth area be defined. 5. That the amount of area paving he defined. 6. That the treatment of the employdes court yard be more detailed. The minutes for the regular meeting for July 17, 1973 were approved as submitted. The minutes for the regular meeting of August 7, 1973 were not submitted, the staff stating they would be submitted prior to the regular meeting of September 49 1973 5. PUBLIC HEARING 5. 1 Conditional Use CU 14-73 (L.ee) A request by Way W. Lee to construct a motor hotel to a height of 75 feet. The proposed building site is in s C-3 , General Commercial zone located on the south side of S.W. Pacific Highway in a line with S.W. Pacific Highway' s intersection with S.W. 69th Street. The site comprises 6. 9 acres. (Tax Map 151 36AD, Tax Lots 6500 and 6501) Staff Findings A. The staff presented findings and pre. .:nted three documents submitted by the api,livant for Planning Commission review. These were; 1. A 24-page document entitled "Feasibility Study for a 232 unit motor motel, Blachly , Loch, Stenberg, Architects. 2. Preliminary site plan and architectural elevations dated October 3, 1972. 3. Letter dated August 15, 1972 relating answers to the "Fasano Decision". B. The staff stated that the applicant ' s proposal is .important to the community identity of Tiga^d because of its size and proposed location at a major entrance to the City. The staff also stated that the applicant has not early demonstrated the affect of his 75 Foot bui1L.L; upon adjacent or proximitous properties. Thi would include view impairment and the possibility of roof views of the proposed project from adjacent or proximitous properties. Testii-tiony and Cross Examination A. Proponents 1. Robert Losch spoke as the architect for the project. He stated that the proposed building would not have an adverse affect upon surrounding properties wither by substantially obstructing views or casting shadows and that it i)as in basic conformance with the adjacent land uses. Mr. Losch answered that 50 feet will be above the road levet. 3. Lucy Mayernik of 15790 S.W. 173rd spoke for the project stating that it represents ' he type of development needed in Tigard. She stated that she owns the property across the street on the northeast corner of 69th and Pacific Highway and this project would have no deLr.imental affect upon her property. B. Opponents 1. Mr. Henry White of .11.150 S.W. Pacific Highway spoke stating that he was not for or against the project until he is provided with more information about it. He added that the project would not obstruct view from his property. Staff Recommendation A. Staff recommended the applicant ' s request be approved at such time as the Planning CommissiL.n approves the applicant' s site development plan. In addition, as part of the submitted material with the site development plan the applicant shall submit a visual impact analysis of the proposed project. Commission Discussion and Action A. Lewis moved that the variance for the 75 feet be epproved with staff recommendations and Nicoli seconded. B. Barkhurst suggested an additional condition be included that signs not be Permitted on the proposed tower. C. Lewis amended his motion to include the condition that no wall signs or identification be above! the 35 foot level. Nicoli reaffirmed his second. D. Mr. Brooks stated that the staff recommendation I providss Lhat actual approval of the 75 foot variance will come concurrently with the approval of the site development plan. He asked Mr. Lewis 10 if this were the intent of his motion. Hampton Street, to continue to use a portable office for eight months Staff Findings A. The staff presented a list of five fiidings which essentially stated that the request conforms to requirements of the Zoning ordinance and the preceeding six months has resulted in no complaints from surrounding property owners concerning the use of a portable office on the Lamb-'weston Site. SUBDIVISIONS - Preliminary Plat Approval 7. 1 Summerfield Phase II (Tualatin Development Corp. ) Location; Approximately 1000 feet north of S.W. Durham Road between S.W. 100th and S.W. 109th Avenues. A. Mr. Brooks stated that, "time has not allowed a full enalysis of the preliminary plat. A full report will be forthcoming and recommendation made at the Sept. 49 1973 Planning Commission meeting. " B. Whittaker asked when the plat was submitted and Mr. Brooks replied approximately 10 days ago. C. George Marshal , Tualatin Development Corp. , spoke stating that he did not feel that he had gotten adequate coopera- tion of the staff towards reviewing the plat. D. Whittaker stated that he did riot see how the Planning Commission could proceed without staff recommendaLi.ons. He stated that without recommendations the Planning Commission was put at a disadvantage and he therefore saw it very difficult for the Planning Commission to arrive at a decision at this time. He also stated recognition of the disadvantages created for the applicant and said that his was also a primary consideration. E . Lewis stated that he saw no reason why the Planning Commission could not approve the preliminary plat at this time. F. Barkhurst moved to approve the preliminary plat applying the conditions from the Planned Development Zone. Lewis seconded and the vote was 3 to 1 with Whittaker voting no and Sakata and Mickelson abstaining. B. SITE DEVELOPMENT PLAN IREVIEW 8. 1 Standard Oil. Company of California A. Location: 13235 S.W. Staff recommended approval of the submitted site plan with the conditions that; artifical turf not be used, the bermed areas be deleted, and trees be provided at 70 feet on center in parking areas. Staff recommended that the submitted site plar be disapproved in that it does nog adequately meet the submission requirements of the site development reivew ordinance. 13.
