APPLICATION: Request by Marie Loc.jis (owner) and Mandy Schultz (purchaser) to partition a 42, 138.95 square Foot parcel of lana into two parcels containing 11,058.45 square feet and 31,080.50 square feet of property zoned C--G (General Commercial) and located at; 12925 SW Pacific Highw,Ay (WCTM 2S1 28D, TL_ 2600) . DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions, The findings and conclusions on which the Director based I decision are as noted below. A. FINDING OF FACT 1 . Bac.;_;r�•1_�nd In 1981, the owner of this property requested a variance for a side yard setback reduction from 10 feet to 3 feet. 'This request was denied by the Tigard Planning Commission (V 7-81) . Ir. the same year, the owner requested and received approval from the City, through the Site Design Review (SGR 2041) process, to construct a 4,300 square foot commercial structure. 2 . Vicinity Information The surrounding properties are al..l zoned 'C—G (General Commercial) excEpt to the north which is zoned R-12 (Medium Density Residential, 12 units per acre) . 3 . Site Triformation and Proposal Description The existing property is currently developed with three structures. The Voget Building, the newest structure on the property, has sveral office and commercial uses mixed together-, The other two structures include an older house which has been converted to a commercial use (Bonita Glass Shop) and a detached garage used for storage. Much of the unbuilt portion of the property is devoted to parking which is provided both in front nf and behind the Voget Building. The Bonita Glass Shop also has parking in front of it. Both of these buildings have direct access onto Pacific Highway via their own ingress/egress points . 4. Agency and NPO Comments A representative of the State Highway Division commented that the Voget Building and Bonita Glass Shop need to have one shared access onto Pacific Highway. NOTICE:. OF DECISION --• (LOUIS/SCHULTZ) MLP 87-01 - PAGE I The Tualatin Rural Fire Protection District provided the following comments: This is a Fire and L..if � Safety Plan Review and is based on the 1.985 editions of the Fir.- and Life Safety Code (UBC), Mechanical Fire and Life Safety Code (UMC), Uniform Fire Code (UFC), and other local ordinances and regulatiors . By Uniform Building Code Type V N, construction housing Group B•-2 occupancies shall be twenty (20) feet from a property line or be protected with one-hour fire resistive construction. Openings in walls shall be protected if the wall is within 10 feet of a propzrty line, The present situation is not legal. per the UBC (above information) and placing the property line as indicated on the submitted plans would simply make the situation worse. Approval of submitted plans is not an approval of omissions or oversights by this office or of noncompliance with any applicable regulations of local government. Submitted plans are not approved for construction. Plans must be revised and resubmitted for review and must indicate compliance with the above noted items . 'The Buildirig Division reviewed this proposal and provided the following comments: ., The proposed lot line between the Voget Building and the glass shop would violate the setback requirements of the building code (i .e. , any b.iil.c14ng of this kind whose walls are leas than 20 feet from a property line must have walls of one hour protection; openings in wall must be protected if less than 10 feet from property line` , The Engineering Division reviewed this proposal and provided a list of standard co,iditi.ons of approval . No other comments regarding this application were received. B. ANALYSIS AND CONCLUSION The proposed partitioi, is consistent with the applicable requirements of Chapter 18.62 (C-G zone) and Chapter 18. 162 (Land Division) . 'The applicant should be aware that future redevelopment of the property will have to maintain a shared access onto Pacific Highway . The applicant stated that one of the purposes of the partition is to purchase the property where his business is located (Bonita Glass Shop) so he can eventually construct a new building and tear down the older NOTICE OF DECISION - (LOUIS/SCHULTZ) MLP 87-01 - PAGE 2 house and garage. As proposed, the property lines would violate the setback requirements of the Uniform Building Code (sec Building Division comments) . In this instance, approval of the minor land partition can only occur when the existing house is demolished or, as an alternative, a one--hour fire wall is constructed on the south side of the house. The approval of this application can only be granted when this situation is resolved . C. DECISION The Planning Director APPROVES MLP 87-01 subject to the following conditions: ^� 1 . UNLESS OTHERWISE NOTED, ALL. CONDITIONS SHALL. BE ME_T PRIOR TO RECORDING THE PARTITION WITH WASHINGTON COUNTY. 2. standard street improvements to consist of concrete sidewp.lks, curb cuts, and driveway aprons, site storm drainage and necesjary utility relocations shall be installed along the S.W.
