Elect a Chairman to whom referral of any matter by the Chief of TRFPD shall be effective as to all Board members, and who shall call and preside over meeting. 2. Consider and make recommendations to the Chief of TRFPD con- cerning an application for an 3djustntent or variance referred to the Board by the Chief within 15 days after such referra' . With relation to the referred matter the Board may hold a hearing and receive testimony. 3. Deputy Fire Marshal Hunt, who conducted the Plans Review, had determined that there could be approximately 39 people in the occupancy at the busiest time. Mr. Hanson gave his presentation and stated that he had received Presentation opinions from several other Building Inspectors, Structural Plans by Mr. Hanson Checkers, etc. and their interpretation agreed with his and that only one exit would be required. He presented plans of two other savings institutions of a similar floor plan and size which had been approved with only one exit. Since this particular type of occupancy is not listed specifically in the UBC, he stressed that a "reasonable" determination should be made. He further stated that since the UBC is a uniform guide, it should be used uniformly throughout the state with a uniform reasonable interpretation. Mr. Hanson felt that Mr. Kenworthy's interpretation is a justifiable interpretation, however, still f el. ghat a reasonable interpreta- tion would require only one exit. THE BOARD FEELS THAT THE USE WOULD CAUSE THE OCCUPANT LOAD TO EXCEED 30 W!11CH WOULD CLOSELY RESEMBLE THAT OF AN ASSEMBLY AREA IN THAT THOSE OCCUPANT WOULD BE STANDING. ASSEMBLY AREAS 00 NOT REQUIRE A SECOND EXIT UNTIL THE OCCUPANT LOAD EXCEEDS 50 PERSONS. BECAUSE OF THE ARRANGEMENT AND USES THE BOARD FEELS THAT THIS DECISION IS REASONABLE. MOTION WAS SECONDED BY MR. SHEPARD. Mr. Brown pointed out that even if con- sidered on the basis of actual use, we are dealing with an assembly area in which the occupancy load would more than likely exceed 50 and therefore would require a second exit. Also attached are copies of Section XI - Appeals, taken from the TRFPD Fire Prevention Code. In response to Mr. Hansen's letter we agree that, for general classification purposes, the occupancy resembles an office and thus should be provided with two (2) exits when the occupant load exceeds thirty (30). It should be noted that UBC Table 33-A does not specifically list savings and loan or bank occu- pancies. Additionally, Section 3301 (d) on page 498 of the U.B.C. states as follows : ''When the square feet per occupant are not given for a particular occupancy, they shall be determined by the building official , based on the area given for the occupancy which it most nearer resembles. In determining the occupant load, all portions of a building shall he presumed to be occupied at the same time. Section 3301 (c) provides a definition of occupant load as the total number of persons that ma occupy a bui.ldin or or ion thereof at an n — We disagree with Mr. Hanson's use of one-hundred (100) meq. f'.. per occupant on the basis that a greater concentration of occupants is shown on the plans. Pacific and Faffel Street Dear Chief Washburn: This letter is in reference to the new project listed above regarding the plan check done by the City of Tigard and, in our understanding, reviewed by the Tualatin Fire Department. In our pian check, we were requested to add an additional exit way from this branch which is approximately 2516 square feet. Due to the area of this building, we believe it meets the requirements in U.B.C. is Chapter 33, Table 33-A listed as an office load, and therefore should be figured on an occupant load of 100 s.f. per person. The occupant load should be 25 people, instead of the number listed on the report. It is our understanding that the U.B.C. and Uniform Life acid Safety Code was set up and accepted by the State of Oregon's Building and Fire Departments, to be interpreted uniformly throughout the state of Oregon. In checking with se•.,eral ether jurisdictions, including the State of Oregon Plan Check Review and the Fire Marshall 's office in Salem, we asked for an interpretation as to how they would construe a 2500 s .f. branch savings and loan or bank facility. In all cases , these and other jurisdictions indicated they would interpret it as office loading which is based on 100 s. f. per person. Since our occupant load does not exceed 30, w,2 would not be required to provide two exit ways from this building. We believe your department's interpretation of the above is not in conformance with that portion of the state's general interpretation. We are asking that you please check with your people that reviewed thi!: plan. The .1979 edition, State of Oregon Structural Specialty Code and Fire and Life Safety Cade of the Uniform Building Code, Section 2.04 (f) -- "Appeal from order to comply with fire prevention statutes", shall be applicable as modified and set forth herein. 1 . If the owner, lessee, agent or occupant deems himself aggrieved by the order of an officer under the provision of ORS 476.030, 479.020 to 479.130, 479.170, 479.210 to 479.22.0, 480.1 .2.2 to 480.170, 430.330, 480.340, 430.42.0 to 480.434 or 430.450 and desires a hr'aring, he may complain or aupeal in writing to the Chief of TRFPD within 10 days from the service of the order. The complaint or appeal shall set forth the specific ground of the complaint and no other ground shall be considered thereafter. The Chief may refer the complaint or appeal to the Board by notifying the Chairman of that Board and sending a copy of the notice to the complainant or appellant. The Board shall fix a time for hearing and notify the complainant or appellant of the time and place thereof which shall be within 15 days after such referral by the Chief. If he does rot refer the rnatter to the Board, the Chief shall fix a time and place, not less than 5 and not more than 10 days thereafter, when and where thq complaint or appeal will be heard by him. Within 10 days after receiving a recommendEtion from the Board, or if no referral was made to the Board, within 10 days after the hearing before him, he may affirm, modify, revoke or vacate the order complained of or appealed from. Unless the order is modified, revoked, or vacated by the Chief of TRFPD, it shall remain in force and be complied with by the lessee, agent or occupant, within the time fixed in the order or fixed by the Chief. If the Chief vacates or revokes the order com- plained of or appealed from, . or modifies it in any particular other than extending time for compliance, the fee paid with the complaint or appeal shall be refunded. Otherwise, it shall be kept by TRFPD. 2. If the complainant or appellant under subsection one of this section is aggrieved by the final order of the Chief, and if such order necessi- tates the expenditure of coney or involves statutory interpretation, he may, within 10 days thereafter, appe-il to the circuit court of the county in which the property is situated, notifying the Chief of the appeal %.,ithin 10 days thereafter . The notice shall be in writing and delivered per- sonally or by registered letter. In the case of an appeal involving an ori-r under ORS 47Q.170. the circuit court shall hear ana determine the appeal viithin 10 days aftor the date of filing the same. 3. The occupant load calculated by floor area only would indicate an occupant load of 21 . Were this general o`fice space only I would agree; but consider the plans show i , ve teller windows, one drive-in teller, four desks with three seats each, one checkstand with space for two people and five seats in the waiting area. If you were to �,•llow two people at each window, which on Friday night at rush hour would not be unlikely, the occupant load would be thirty five. Furthermore, it could be well above this at peak rush hours and the occupant. load should be set at maximum. I feel consequently for fire and life safety reasons there should be two exits from this area. On the other hand, the Building Code gives the authority to fix occupancy loads to the Building Official . Therefore, the decision and the responsibilitt rests with you. In conclusion, I encourage ,you to ztrongly consider requiring a �,ec:ond exit to accommodate the potential peak lo<ding of this 7acility.
