Background Information The subject property was annexed to the City along with several other properties in 1987 (ZCA 87-05) . No other land use or development applications regarding this parcel have been reviewed by the City of Tigard. 2. Vicinity Information Properties surrounding the subject property on all sides except the west are within the City of Tigard and are zoned R-4.5 (Residential, 4.5 units per acre - 7,500 square foot minimum lot size) . Properties to the west are within unincorporated Washington County and are zoned R-5 (Residential, 7,000 square foot minimum lot size) by the County. The majority of the parcels .in the area are developed with single family residences and are substantially larger than the minimum lot sizes of their zones. 3. Site Information v`nd Proposal Description The 0.74 acre parcel has 105 feet of frontage on SW 74th Avenue and 17 305 feet dee;.). A single-story house and attached garage are located ois `he parcel within 75 feet of the SW 74th Avenue right- of-way (sea ma;,) . A hedge is located along the front of the parcel. A number of tall fir trees are locates on the western portion of the property. Tho applicant proposes to partition the parcel into three parcels Of 8800 square feet (containing the existing house and garage), 7600 square feet, and 10,500 square feet and a separate joint access parcel. An approximately 8 foot tall hedge is located to the north of the proposed access-way on the adjacent parcel. 4. Agency and NPO Comments The Engineering Division has reviewed the proposal and has provided the followinv comments: 1. The applicant has submitted a site map showing the existing and proposed houses and proposed driveway improvements. 2. Access for two of the lots is provided by a comm•.n driveway connecting to SW 74th Avenue, a. minor collect-or street requiring a 60 foot right-of-way. Existing right-of-way is 25 feat wide from its centerline along the frontage of the site. Consequently, an additional five feet of width is required to be dedicated. 3. The driveway widths and improvements shown meet the requirements of the Community Development Code (CDC) . The depth of the asphaltic concrete for the driveway should be increased to 2 1/2 inches. 4. SW 74th Avenue is not improved with curbs or sidewalks. A 10 Inch culvert is proposed to provide drainage under the driveway. The diameter of the culvert should be sufficient to provide a cross section that approximately conforms to the existing ditch and not less than 12 inches. community Development Code Section 18.164.030.1.c allows the Director to accept a future improvement guarantee in lieu of frontage street improvements for residential land partitions. A non-remonstrance agreement guaranteeing participation in a future local imprcvement district for SW 74t`: Avenue should be required in lieu of street i.mptovements at this time 5. Sanitary sewer service is from an existing line in SW 74th Avenue. Each house must be separately connected to the line. 6. Storm drainag6 may be provided by the ditch along SW 74th Avenue or by on-site disposal. The Building Division has reviewed the proposal and has commented that utilities serving the existing house must be located prior to submittal of the final partition plat. Appropriate easements must be c-3ated through the final plat if the utilities will crofs proposed property linen. The Washington Countv ,apartment. of Land Use and Tiansportation has commented that SW 7 th Avenue is designated as a minor collector NOTIC;' OF DECISION - Rucker./Fernwood - MLP 89-18 - Page 2 street by the Washington County Transportation Plan. As such, the public right-of-way along the site's frontage should be increased to 30 feet from the road's centerline to provide the necessary area for future road improvements. Tualatin Valley Fire and Rescue District has reviewed the proposal and has commented that access roadway must be provided within 150 feet of all portions of the first level of all buildings; and a fire hydrant must be located within 500 feet of all portions of any future buildings. If access or existing hydrants would be insufficient within respect to proposed buildings, adequate access and hydrants must be located within 500 feet of all portions of any future buildings.. If access or existing hydrants would be insufficient with respect to proposed buildings, adequate access and hydrants must be provided at the expense of the applicant prior to issuance of a building permit. Metzger water District, General Telephone, Northwest Natural Gas Co. , and PGE have also reviewed the proposal and offered no comments or objections. B. ANALYSIS AND CONCLUSION Community Development Code Section 18.162.030 contains the following approval criteria for approval of a land partition request: 1. The proposal conforms with tha City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve thet proposal; 4. All proposed lots conform to the size and dimensional requirements of this Code; and 5. All proposed improvements meet City and applicable agency standards. The proposed partition complies with these approval criteria. The proposed parcels would all exceed the minimum lot size of the R-4.5 zone as well as other Code dimensional criteria applicable to newly created parcels. Because partitioning would promote in-fill development at a density consistent with the Low Density Plan designation applied to this area, partitioning is supportive of Plan purposes. The parcels will be adequately served by necessary public facilities: h sanitary sewer is located in SW 7th Avenue; ditches along the road p_ovide stormwater drainage. Other utility providers have not noted problems with providing service to the additional lots. The lots all will have frontage on putlic streets and will receive NOTICE OF DECISION - Pucker/Fernwood - MLP 89- 18 - Page 3 adequate and 6afe access throigF. the proposed private access-way. Reciprocal access and utility eaaements will need to to recorded for the proposed joint access-way. As a condition of approval of the partition proposal, the applicants will be required to dedicate additional right- of-way to the City of Tigard and execute a non-remonstrance agreement for participation in a future local improvement district to improve SW 74th Avenue. Code Section 18.162.050.E requires that visual screening be provided between a flag lot access driveway and an abutting parcel. An approximately 8 to 12 font tall evergreen hedge is located on the adjacent parcel to the .iorth next to the proposed access-way. The applicant would prefer to utilize this hedge to provide the requisite screening. However, because thn owners of the lots to be created will not control the long--term existence of thio hedge, it will be necessary for the requisite screening to be provided on the access-way parcel. Screening may be either a fence or a hedge. The screening may not conflict with driveway/road intarsection vision clearance standards. In addition, it is noted that driveway and home construction will necessitate removal of a number of trees. A tree removal permit must be obtained prior to removal of any trees with a diameter of 6 inches or greater. The applicant should endeavor to design the site improvements so as to minimize Lhe number of trees that muPt be removed. C. DECISION The Planning Director's designee approves proposed Minor Land Partition MLP 39-18 subject to the following corAitions: UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE SATISFIED PRIOR TO RECORDING THE PARTITION PLAT WITH WASHING'T'ON COUNTY: 1.
