Dear Mr. Hagman; As we discussed Friday, October 5, 1990, the improvements that I am constructing on my above referenced property are private not public. Those facilities are a short section of private road, private sewer line extentions from existing sewer stubs to serve interior lots, and a private storm sewer to serve my lots. As we discussed Friday, and have discussed on two or more prior ocassions, you review plans for construction within public rights-of- way. Unfortunately my private street plan was submitted for review by Mr. Dennis Smith of Burton Engineering, I thing out of habit. Knowing how busy you are,I apologize for taking your time for a needlesG review of a private road. I hereby withdraw that plan from review. I have asked Mr. Smith to prepare A road connection detail showing the work to be donewithin the right-of-way of 132nd. to connect my private street to that City Street. I understand that Mr. Smith used the Tigard Standard approach detail for the connection. I plan to submit it to you with this letter and respectfully request a prompt review and issuance of my Approach Permit. I will submit a cashier ' s check covering my Bond for the completion of the work w.itin the City Street, and will of course pay the fee. I am not ignoring your concerns set out on the marked up plan. Many of those concerns were addressed during the two Minor Partitions of my property, for example: 1 . I was required to show how the lots would be served by all utilities and prepare easements for the routs to be used. After approval by the City they were recorded. 2. I was required to prepare Joint Use and Maintenance Agreements for the steet and for the stormsewer. After approval by the City i recorded the agreements.. 3 , In lieu of street improvements to 132ns. Ave. ; I was required to give up existing accesses to S.W. Walnut] to dedicate a strip along 132nd. ; to dedicate right-of--way to S.W. Walnut at m,, flag lot Access to the Easterly portion of my property, and to prepare a non- remonstrance agreement, directed to any improvement of 132nd, and forever binding on my lots. Any lots abutting my new priate street are to be accessed from that. All of these were prepared on City forms approved by the city and recorded. Most of your remaining concerns have been reviewed by and approved by other public officials. Deputy Fire Marshall Gene Birchell approved the "Hammerhead". A copy of his approval is in your file. Mr. John Miller for the Water District has approved the waterline to serve my property subject to a relatively minor agreed on chancre. The waterline will. be pixblic Mr. Miller also approved the form of. Public nun-exclusive permanent waterline easement over my private street riqht-of-way. The easement runs in favor of the Tigard Water District and has been recorded. The private sewerline extentions and the private storm sewer, detailed on a different format were reviewed by and and approved by Mr. Brad Roast and his Department.. After payment of the appropriate fee, Mr. Roast issued a plumbing permit covering both installations. Mr. Roast ' s inspector has been inspecting the work as it progresses. Mr. Roast has been very helpful on the environmental. But for his early comments, I may not have included a bid item for that function. Because of his prompting, I also insisted that the protective devises be installed during the .initial phase of the work. Some of your Comments relate to the distinction between sub-divided lots and those created by minor partition. As you know the latter pro- cess does not involve a grading plan. However the builders for each lot will ,,ubm.it a site plan prior to obtaining a building permit. I hope I have answered at least most of your questions. If you need further information, please contact. me. So far the weather has been kind to me. The under.gruung work will be completed in two or three days. Fortunately the portion of the street outside the street graded and much of it is rocked. Naturally I want to complete the word at the earliest possible date. DECISION: Notice is hereby given that the Planning Directors designee for the City of Tigard has APPROVED the above described applications SUBJECT TO CERTAIN CONDITIONS. The findings and conclusions on which the decision is based are noted below. A. FINDING OF FACT 1. Background The subject property was annexed to the City in December, 1988 (Boundary Commission Proposal No. 2550) . A minor land partition on an adjacent tax lot and a lot line adjustment on the subject tax lot waq approved in November, 1989 (MLP 89-16/M 89-22) . No other applications for this property have been reviewed by the Planning Division. 2. Vicinity Infozmation Parcels immediately to the east, south, and west of the subject property are zoned R-4.5. To the north the zoning designation is R-25 (Residential, 25 units/acre) . Southwest Walnut Street, a major collector, is just to the north of the subject property and S.W. 132nd Avenue is to the east. 3. Site Information and Proposal Descripticn There is a stand of fir trees on the southern portion and a few deciduous and fir trees in the center of the subject property,The remainder of the property is vacant. The applicants intend to divide the subject property into three parcels to be used as sites for single-family dwellings. Access to 132nd Avenue for the two southern parcels is provided by an access easement created by the previous minor land partition. Agency and NPO Comments The Engineering Division has the following comments: The applicant proposes to divide a 0.7 acre parcel on SW 132 Avenue into three residential parcels. liindinq_s: a. The parent parcel was adjusted by a previous application (MLP 89-16/M 89-22) that also provided the utility easements, accessway, and right-of-way dedication required for this application. b. The Bite abuts SW 132nd Avenue, a local street. The required right-of-way width of 25 feet from centerline was provided by the previous application. C. Fach of the three parcels abut to SW 132nd Avenue. However, the two aouthern parcels also abut to a 30 foot wide accessway created by the prior application. d. Sanitary sewer service is available from an existing line in SW 132nd Avenue. The Tigard Water District noted that they will require a six-inch water line and fire hydrant at SW 132nd Avenue and a four-inch water line must continue east along SW Hampton Court to tax lot 1502. The Building Division commented that if any buildings exist on the parcel the utilities need to be located and provided with easements if they cross property lines. They also point out that a private storm line needs to be provided and have submitted a copy of the plan showing where the storm line should 5e located. Portland General Electric, Fire District fl, School District 23J, and Washington County have -eviewed the proposal and have no objections to it. No other comments have been received. ►3• ANALYSIS AND CONCLUSION The proposal meets the minor land partition criteria of Section 18.162.040 (Partition Approval. Criteria) . It complies with the City's Comprehensive Plan and all statutory and ordinance requirements and regulations. Adequate public facilities are available to serve the proposal as discussed in the Engineering Division and other agency comments. All lots created exceed the 7,500 square foot minimum size and 50 foot minimum width requirement of tha R-4.5 zoning district and the proposal meets city and other agency standards. NOTICE OF DECISION - HAMPTON - MLP 90-0010 PAGE 2 1 Access Parcel r (see Exhibit A) created by the subject partition has direct access to 132nd Avenue. Parcels B and A, as well as the 3 parcels c-3ated by the Previous minor land p'.rtit-ion (tax lots 1500, 1501, 1502) are to be served by an access easement. Creation of the easement was required as a condition of approval of MLP 89-16. Staff is concerned about how the paving of this easement will progress. One p( ssibility is that the applicant will provide a 24 foot wide paved area along the length of the easement prior to construction of any dwellings. This is the option preferred by staff; however, another possibility .is that the access easement will be paved incrementally as the individual dwellings are constructed. There are significant problems inherent to selecting this second option. For instance, each of the first two homebuilders would have to provide a 10 foot wide caved area within the easement to serve their respective dwellings. The third hcmebuilder, however, would have only to provide an additional. 4 feet of paved width to bring the access into compliance with the Code requirement to provide a24 foot wide paved area for an accessway serving 3 to 6 dwelling units. Succeeding homebuilders might be responsible for paving only that portion of their access that extends from the end of the easement to the individual garage or carport. The problem with this option in that the distribution of costs may be uneven and could result in conflicts that might interfere with providing adequate access to all new dwellings. Therefore, although staff encourages the applicant to pruvide the required paved burface prior to development of any of the parcels, we provide the following information from Code Section 18.108.070.A concerning the minimum paving requirements for residential uses that must be met prior to occupancy as the parcels are incrementally developed. Please note that where the access easement serves less than 3 parcels, as is the case where the easement turns north and serves ta). lot 1500 and Parcel B, the paved area may be reduced in width to 20 feet. Tax Lot 1200 has 2.72 feet frontage on the East side of S.W. 132nd, beg-rining 85 feet South of S.W. Walnut Road. Ms . Goodwin reintro- duced the possibility that I would be required to make a street improvement to S.W. 132nd. That possibility contradicts statements made to me (luring the minor partitioning of TL. 1500 (MLP 89-16 ) . At that time Ms. Good,.%in stated and quoted you as saying that the many requirements I had to meet were "inlieu of street improvements" . Early last week I asked Ms. Goodwin to arrange a meeting with her, you, Greg Berry and I . She reported back, that prior to a meeting you wanted to review ba, Kground on my property, including prior land use actions by Washington County. I have that informa- tion and she said it would help .if I supplied it to you. My father bought-. this property in 1937, origonally six acres. fie and my older brothers built a house on it: in 1936 . 1 acquired TL. 1500 from my father in 1966. My sister owned and had a s-ile for TL. 1200. Washington County would not issue a septic tank permit . I bought it from her in 1976. I acquired TL. 1300 from the estate of my brother, Clifford L. Bampton in 1975 . Thereafter the property was dormant, except that another brother lived in the house for several years, rant-free. Because of "depression years materials aril standards" and the lack of a foundation, it was not feasible to remodel the house. Att . -1 - shows the origonal con- fijuration of the three Tax Lots . Then Benchview Estate ' s planned construction of a sewerline in 132nd. made the development of my propri-ty possible. In late Jul; 1988, I asked Washington County to process a minor partition of a portion of my property. Planner Bob Cone refused to do so, stating that the City of Tigard controlled the sewer and was planning to incorporate my land and other properties in':o the city. After protests by me and considerable discussion, Mr. Cone pointed out that a simple lot line adjustment would create a lot that could he sold when the sewer was finished. (Unfortunately it took 18 months to sell the .lot, probably because of the gasline controller on the corner of the lot. ) Att. -2- is a copy of the permit_ that allowed the transfer of all but. the Northerly 85 feet TL. 1300 to `I'I:. 1200. After further discussion with Nlr, Cone, I also transferred a portion of the enlarged TL. 1200 into TL. 1500. This would allow three lots from TL. 1500 to be accessed from S.W. Walnut over m�r deeded access lane. It would also allow three lots from TL 1200 with frontage on 132nd. Atc . --3- is a copy of the permit for the second lot line adjustment. Att. -4- is a map section showing th three tax lots after the adjustments. I recorded the appropriate deeds . Because of the county ' s refusal to partition and the slow pace of the incorporation, 1.988 was lost for further development. Last year TL. i500 was divided into three lots under the MLP 89-16 pro- ceedinr. At the pre-application meeting Mr. Jerry Offer strongly recommend that I abandon my S.W. Walnut access and bring in a street off 132n(J. I finally agreed to do so, a mistake on my part. I have narrower lots on 132nd. and will have a wider higher standard street to build. The more isolated interior lots would have been desirable to a segment of the market. I think Mr. Offer ' s early impression was that I was evading the subdivision law. I war, " up front" with him from the beginning. I simply could not afford to go that route, then or nrw. We sold my wife ' s car to helpay they $4, 000. for the-sewer stubs in 132nd. and in Walnut . I had checked with a Tigard Engineer, who quoted a fee of $14 ,n00 for subdividing my lots. Ev-n if subdividing was desirable it wasn ' t economically feasibIL. It has been a struggle to pay the high taxes and the substantial costs incurred to date. There were no bad motives. In summary, when MLP 89-16 was processed I w.-is required to dedicate Five Deet. along 132nd. when TL. 1 .500 did not abut . I war, also required to dedicate. 13 feet along Walnut, togeather with ali access thereto. I had to sign a non-remonstrance agreement regard- ing future devel -pment to both 132nd. and Walnut . It is inconsis-- tant to require a street improvement and to deny me the right to object to any future developments that assessed additional costs to mc. When I saw the proposed final order I voiced objections to Ms. Coodwin and argued that many items were premature at best. I asked that the matter be submitted to you for review. I then re- ceived the above mentioned assurances that the many requirements were "in lieu of a street improvement.". I urge you to stand by that. committment. I also ask you to consider that: Page -2- 1 . This in fact is a minor partition. Ms. Goodwin told me the policy is that street improvements are not required. 2 . Mine is the only small undeveloped property along 132nd. It is one thing to spred the cost of a street improve- merit over 10 acres or more of lots. It is another to impose a very heavy cost burden on only six lots. In view of the sloping ground, widening 132nd. will be heavy expensive construction. 3 . .A widening of 132nd, will pave over a major gas trans- mission line. If the line has to be coved and it is possible to do so without control of the property to the North and South of mine, the extra cost added to the street widening costs and the substantial land develop- ment costs could e.,•ual or exceed the total net sales price of the six lots. During a widening by a LID, the gas company would be required to move the line free. 4 . Except for my parcel , the first 750 feet of 132nd, is developed with single family homes on both sides. It is unlikely that- the sect:ioi of the street will ever be widened. It would be difficult to again rebuild the steep driveways ori the West side. The existing pavement is as wide as Walnut 's. Even if all of the vacant land along 132nd, was developed, the traffic generated would not require such a widening. In conclusion, we have dedicated our share of right-of.-way-•- cur neighbors will by paid. We have agreed riot to remonstrate against any improvement to 132nd, or to Walnut. Agency and NPU Comments The Engineering Division has the following comments: The applicant proposed to divide an 0.80 acre parcel near the corner of S.W. 132nd Avenue cnd S.W. Walnut into three residential lots. Engineering's Findings: 1. The applicant has submitted a site map showing a 30 foot wide driveway from the proposed lots to S.W. 132nd Avenue. Storm and sanitary sewer service is provided from S.W. Walnut Street by a private easement. 2. Access to the site ic; currently provided by a 20 foot wide strip of land that extends north to S.W. Walnut Street, a major collector. Direct access to major collector9 is discouraged. The eastern edge of the strip is adjacent to a parcel that is being considered for the extension of S.W. Murray Blvd. The proposed access is from S.W. 132nd Avenue by a 30 foot wide driveway. 3. S.W. Walnut Street is a major collector street with an existing right-of-way of 40 feet. The Fire District requested an accessway and fire fighting water be provided as required in the Uniform Fire Code. Plans for these must be submitted and approved by the Fire Marshall prior -to construction. The Tigard Water District and Portland General Electric reviewed the proposal and had no objections to it. No other comments were received. B. ANALYSIS AND CONCLUSIriV NPO Y3 raised three concerns in their comments. First, the NPO members want to be sure the accessway meets City standards. The applicants intend to construct a 30 foot wide private road to serve the three: new parcels being created. The City will require that 24 feet of this access be paved along with curbs and a 5 foot sidewalk. Second, the NPO members were concerned about mainten.snce of the private road. Typically the City requires execution of a joint use and maintenance agreement pro%iding a mechanism by which all properties served by the private road are responsible for the maintenance of that road. Finally, the NPO members expressed concern about the provision of a turnaround for emergency veh.i.cle3 on the private road. Prior to submittal of the final partition map the applicants will be required to revise the configuration of the private road to include a hammerhead or circular turnaround. This will be recessaxy in order to compll with Section 18.108.070(0) of the Community Development Code wherein access drives in excess of 150 feet in length are required to provide an area for emergency vehicles to turn around. Section 18.162. 060 (Lot Line Adjustments: Approval Standards) of the Community Development Code ccnt-ains the standards of aLproval for a lot line adjustment, they are as follows: 1. An additional 14t is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the approved zoning :or that district. 2 . By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district. Both of these criteria are me- in the current application. The lot line adjustment approval requested will not create an additional lot. The shed located on tax lot 1200 appears not to be in conflict with the setback requirements of the R-4.5 zoning, however staff will request that this be confirmed prior to the partition being recorded with the County. In addition to meeting the above standards the proposal must also meet the minor lan9 partition criteria of Section 18.162.040 (Partition Approval Criteria) . They are as follows: 1. The proposal conforms with the City's comprehensive plan; 2. The proposed partition complie,i with all statutory and ordinance requir.emfjnts and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and di,nensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards. The proposal mcete all of the ahove criteria. It complies with the City's Comprehensive Plan and ai statutory and ordinance reauirem�nts and regulations. Adequate public facilities are available to serve the proposal as discussed in the Engineering Division and other agency comments. All late created exceed the 7,500 square foot minimum size and 50 foot minimum width requirement of the R-4.5 zoning district. Finally, the proposal meets City and other agency standards with the exception of the configuration of the private road. The applicanto will be required to meet City and agency requirements as conditions of approval, particularly with respect to the configuration of the private road and the required emergency vehicle turnaround.
