Background Information No previous land use applications have been reviewed by the City regarding this property. 2 . Vicinity Information The properties tc the north, west, and south are within the City and are zor=d R-25 (Residential, 215 units/acre) . One large parcel within Washington County lies on the east side of 135th Avenue. Nearby parcels are either, undeveloped or• oc-upied by single family residences . 3 . Site Information and Proposal Description The property consists of three tax lots totaling 2 .85 acres . A single family residence apparently straddles the boundary between the two northern tax lots. The applicant proposes to combine two of the tax lots and adjust the two remaining parcels to accommodate the house on a 0.35 acre lot. The remaining acreage will be utilized to construct a 40 unit apartment projoct. This development will include five, two-story buildings which will have a 20 foot setback from the south and west property lines. Approximately 40 percent of the site will be landscaped. 4 . Agency and NPO Comments The Engineering Division has the following comments: a. The northerly portion of the property is within the 1.00 year flood plain of Summer Creek . A non—remonstrance agreement should be required in lieu of constructing half' street improvements in conjunction with this project. C. Tax Lot 301, which is immediately southwest of the subj,2ct property will probably need to have a sewer line routed toward the trunk line that parallels Summer Creek . It is possible that this development will need to accommodate this future line extension. d . In order to properly route utility lines, a topographic service area map should be provided, illustrating area-gide sanitary and storm line locations. The residence must be separately connected to public sewer facilities . f. The disposal of stormwater from the site must be addressed more clearly prior to issuance of building permits , g. 135th Avenue is designated as a major collector and a right--of-way dedication of 35 feet from centerline is necessary. h. Because of the anticipated traffic on 135th Avenue, the driveway serving the residence should be relocated to function as a joint access with the apartment complex. The Building Inspection Division indicates that sanitary sewer facilities should be made available to the apartments and the single family residence. Tigard Water District has no objection to the request. The Beaverton School District indicates that the anticipated students cssn be accommodated . No other comments have been received , 13. ANALYSES AND CONCLUSION The propo^ed lot line adjustment conforms with Community Development Code standards for• allowable density, building design, setbacks, maximum building height, accp parking, landscaping, common and private open space, and vision cleat Ance. Additional. information will be necessary to determine the adequacy of storm and sanitary sewer facilities for the subject property and adjoining parcels. The Comprehensive Plan and Community Development Code call for the dedication of the flood plain area for open space purposes . During a field isit to the property, it was apparent that much of the property had been cleared and several trees over six inchcs in diameter had been cut. Chapter 18. 150 of the Code rp.cuires that a tree cutting permit must be obtained prier to removal of trees over six inches in diameter. Cr' records indicate that a permit was not issued. NOTICE OF DECISION — SDR 17-86 & M 8-86 — PAGE 2 Chapter 10. 150 also requires that trees over six inches in diameter should be preserved whc-never possible. The site plan only illustrates a portion of the trees that remain on the property.
