'Zoning R-3.5 (Residential, 3.5 units per acre) . Location: northeast corner of SW Sattler Street and SW 96t,. Avenue (WCTM 2S1 11BD, Tax Lot 900) . DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted below: A. FINDING OF FACT 1. "ackor•ou•:d Information The subject property was annexed to the City of Tigard along with several other properties in 1967. No other land use or development applications regarding this parcel have been reviewed by the City. 2. Vicinity Information Properties to the north and west of the subject parcel are zoned R-3.5 (Residential.; 3.5 anits/acre) and are developed with single family residences. This area is not served by sanitary sewer. Properties to the east of the subject parcel are also developed wir.t single family residences and are zoned R-4.5 (Residential, 4.5 units/acre) . The properties to the south are zoned R-7PD (Residential., 7 units/acre Planned Development overlay zone) . The parcel immediately south of the subject Bite is currently vacant but was recently approved for division into 6 lots as part of the Sattler Place Subdivision. Sanitary sewer service would be extended to these lots 39 part of the subdivision development. Parcels on either side of the lots to ba created are developed with single family residences. SW Sattler Street is functicnally classified by the Comprehensive Plan Transportation Map as a mi.n.3r collector street. SW Sattler Street is presently developed with approximately 21 feet of pavement with ditches and no sidewalk in the area of this Proposed development. Other sections of Sattler Street have been Improved with Crider pavement, curbs, and sidewalks. The approved, but yet undevel3ped, Sattler Park Subdivision to the south will be required to improve its Sattler Street frontage to full minor collector street ntandar_ds. SW 96th Avenue currently has approximately 21 feet of pavement. No curbs or sidewalks are provided. Stormwater drainage is provided by roadei.de ditches. 3. Site Information and Proposal Description The approximately 40,200 square foot subject parcel has approximately 298 feet of frontage along SW 96th Avenue and 135 feet of frontage along LW Sattler Street. A single story house and attached garage are located on the southern portion of the parcel fronting Sattler Street. A hedge is located along the front of the parcel. The area immediately surrounding the house Is well landscaped with a variety of mature landscaping trees and bushes. The northern half of this site is presently a grass- covered open field. The applicants propose to partition the parcel into three parcels: one parcel of 18,600 square feet (conta1ning th(. ext.sti.nq house) , and two parcels ot. approximately 10,800 square feat each. The newly created smaller parcels would each have 80 feet of frontage on SW 96th Avenue, and would be approximately 135 feet deep. 4. Agency and NPO Comments The Engineering Division has reviewed the proposal and haE provided the following comments: A. The applicant has submitted a site map showing the existing house and proposed sanitary sewer. B. Two of the lots access to SW 96th Avenue, a local street with an exiting right-of-way of 50 feet and improved with a 21. foot wide pavement. A 34' foot wide pavement, curb, and sidewalks would be required to complete improvements. The driveway of the existing house accesses to SW Sattler Street, a minor collector street requiring a 60 foot right- of-way and also imprcved with a 21 foot wide pavement but without curbs and sidewalks. Subsection 1.8.164.030 A of the Code permits the Director to accept a future improvement guarantee in lieu of street improvement on property zoned residential if the proposed land partition does not create any new streets. Except for recent subdivieions along SW Sattler Street the area surrounding the site is nearly fully developed with streets without curbs and sidewalks; consequently, a future improvement guarantee in lieu of street improvements in acceptable. C. Sanitary sewer service is available from a proposed line in a proposed subdivision south of SW Sattler Street. The line t\t( TWN ()F DF,CISION -- MLP 90-0006 - Beacon Homes Page 2 will require an easement and should be realigned so that .it is confined to the paved portion of the fully improved street. D. Storm drainage may be provided by an existing ditch and culverts along SW Sattler Street cr by on site disposal. The Building Division has reviewed the proposal and has commented that private storm drainage lines should be provided along the southern boundaries of Parcel A and Parcel B. In addition, utilities serving the existing house must he located prior to submittal of the final partition plat. Appropriate easements must be created through Mie final plat process if the utilities f will cross proposed property lines. The Tigard School District has reviewed the proposal and has commented that the District has concerns about its ability to maintain the current level of educational programs and school facilities as the result of rapid growth throughout the District. The projected enrollment rebulting from this devel.rament is 0.87 students at. Templeton Elementary School and 0.36 students at Twality Junior High. When combined with other projects currently under zaview, the total projected enrollment increase is 68 students at Templeton and 93 students at Twality. This exceeds the District's facility design capacity for these schools. The District cannot guarantee that the newly proposed schools whi,h are anticipated to open in 1992 will have adequate capacity to serve all of these developments if enrollments continue to increase at their current rate. Prospective home buyers/occupants should be advised that students may have to be bused to other schools or placed in portable classrooms. Portland General Elect. ic, General Telephone, Tiqard Water District, the Tualatin Valley Fire and Rescue District and NPO #6 have provided no comments on the proposed partition. No other coraments have been received. B. ANALYSIS AND CONCLUSION Comnunity Development Code Sectton 18.162.030 contains the following approval criteria for approval of a minor land partition request: 1. The proposal conforms with the Ci.ty's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional NOTICE OF DECISION - MLP 90-0006 - Beacon Homes Page 3 requirements of this Code; and 5. All proposed improvements meet City and applicable agency standards. The proposed partition complies with these approval criteria. The proposed parcels would all exceed the 10,000 square foot minimum lot size of the R-3.5 zone as well as other Code dimensional criteria applicable to newly created parcels. Because partitioning would promote in-fill development at a density consistent with the Low Density Residential Plan designation applied to this area, partitioning is supportive of Plan purposes.
