Washington County Department of Public Health has referred the
malfunctioning on-Site sewage disposal system which is occurring at your
residence to this Department. Please be aware that sewage surfacing upon
the ground can pose a serious public health hazard.
Washington County Department of Public Health has notified you in writing on
two separate occasions regarding this violation and asked for correction
thereof. The dates of those letters were August 4, 1987 and October 12,
1987.
Please be aware that continued usage of your on-site sewage disposal system
is a violation of Oregon law. You are therefore requested to apply for
connection to the City of Tigard Sanitary Sewer System and connect thereto
prior to January 31, 1988. Please be aware that this type of violation is
subject to civil penalties of up to $500 per day.

On August 4, 1.987, the Washington County Department o Public Health
investigated a sewage violation at the above noted location.
At that time, correspondence was forward-d to you. You were notified of
the violation and requested to make ccrrection within 30 days.
On October 7, 1987, Gerhard Matheis, Sanitarian made a revisiL to ;.his
residence, and it was noted that there had been no correction.
You are hereby granted a 10 days period to complete correction of ' his
public health hazard. If satisfactory correction has not been completed
within this extended time period, we will have no alternative but to refer
this matter to the Department of Environmental Quality for legal
dispensation.
If you have any questions regarding the above, please feel free to contact
this Department.

Dear Mr. and Mrs . Kreick :
The recent f,:ilure of your septic system prompted a question as to the
location of the public right of way and a bike path in front of your property
It has been your belie that the bake path was located on your' property and
may have contributed to the failure to your septic system.
A survey of the area and property records show that this is not true. Please
review the attached copy of the deed for your property. It States that the
actual length of your side property line is 276. 139 feet. In a recent survey
of the property, it was found that the edge of the bike path is 279 feet frum
your rear property line, which places it two to three feet outside yoLr
property. Th? 296. 14 foot length shown on the Washington County Tax Map
2S1-11DC is actually the measurement to the centerline of the public right of
way.
Therefore, it does not appear that the City has encroached on your property
and should not assume responsibility for your septic system failure.
Please correct the problem with your septic system by connecting to the public
system in front your property as soon as possible.
A permit can be obtained from City ilall for the connection to the sewer.

Dear Mr. Krieck:
It has come to the attention of the Washington County Department of Public
Health that sewage and/or waste water is discharging on the surface of the
ground because of a malfunctioning of the sewage disposal system at the
above noted address. This is in violation of Oregon Public Health Laws
and regular-ions governing the dl3posal of domestic sewage and other
household wastes.
Gerhard Matheis, Sanitarian conducted an investigation and substantiated
the viol; tion referreo to above on .July 22, 1987.
You are respectfully requested to correct this public health hazard by
establishing hook-up to the public sewer available to this residence. For
information on sewer hook-up, contact City of Tigard--639-4171 .
Since the above is a safety hazard as well as a Public Health Violation,
we must request correction within 30 days from *he date of this letter.
Please call or write the Department of Public Health as soon as correction
as been accomplished.
If a satisfactory correction has not been c�pmpleted in the time allotted,
we will have no choice but to refer this problem to the Department of
Environmental Quality for enforcement.
