Your letter stated that PacTrust would accept the responsibility for completing the site grading adjacent to your properties from the back of the curb to the right-of-way/property line. You mentioned during our telephone conversation on August 10 that the purpose was to complete your sidewalk construction. You also requested access to your site in order to complete your interior site improvements. Our phone conversation verified that you were already using your access points along the new Durham extension. As I said in our phone conversation, Washington County has no problem with your accessing your site through the provided approaches. Ve also accept your responsible site grading within the right-of-way in order to place your sidewalks. Under normal circumstances, we would require you to obtain County permits for this right-of-way work. However, since the City of Tigard will be taking over jurisdiction of the roadway shortly, the County agrees that the permits and inspections administered by the City for the right-u1 way work will �.iffice. This should simplify your permitting process. The County does require that during your access use of the Durham extension, you keep and maintain the project barricades in place suff4ciently to allow construction traffic only. In no case can the barricades be moved to indicate that the extension is open to general traffic. Based on the information you have provided and information obtained from the City of Tigar.d' s building department we are, at this time, able to waive the fees fcr buildings 165 and 166 only. Based on the plans submitted to the building department buildings 1.65 and 166 will create 137,200 square feet of impervious surface. The fee that would be -barged for this size development would have been $15, 680.00, which leaves you with a credit of $31, 599.00 . The credit is based upon your construction cost estimate of $47, 279 .00 to install the facility . We cannot, at this time, waive the fees for buildings 167 and .168 until such time as we have approved plans from the building department that show the amount of impervious area. I can say, at this time, as long as the impervious area created by the development of buildings 167 and 168 is less than 275, 520 square feet all storm water charges would be waived. You also requested that the monthly storm sewer fee be waived for both sites since there will be no use - f the public storm sewer system. Installation of dry wells must still meet the approvals of all jurisdictions with authority. 6. Credits for Water Quantity Portion of the SWM SDC New Developments that provide on-site retention, disposal , or detention, or provide off-site conveyance system enlargements are entitled to a credit in SDC fees. To be eligible, new development, or portions of new development, must include design and construction of a facility that meets one of the following standards: a. Retention facility sized to accommodate the full volume of storm water through the year with no overflow or rolease into the SWM System. b. A disposal facility which keeps all storm and surface water separated from the public system, and disposes of it on-site for the full range of storms during the year , including the winter, through on-site disposal (dry wells, injection wells, percolation/evaporation basins) . c;. A detention facility which meets or exceeds the standares defined in Agercy rules for on-site water quantity detention facilities. d. Upsizing of the downstream conveyance system. The term "on-site' means on the parcel , or on another parcel in the near vicinity of the tax lot requesting the credit or reduction. To be eligible for a credit of SDC, the property owner ►nest submit a request prior to, or as a part of, the development process, but in all cases the request must be made prior to the payment of the SDC fees. To be eligible for a cre(lit, the request can be made at any time, in accordance with Agency Ordinance 23. The request shall demonstrate the property meets one of the above conditions . The amount of the SDC credit shall be limited to the actual cost of installation of the facility, or the limits as defined in Section 3, whichever is less. For on-site facilities, the Agency reserves the light to inspect the facilities installed at any time. If it is found that the system no longer functions, then the SDC fees that were waived will become due and payable. B. Water Quality Component of SWM SDC The water quality component of the SWM SDC shall be determined by subsection 6.B. of this Section. The methods for calculating ESU' s as defined in Section A shall be used for the determination of the water quality component of the SWM SDC, e,zcevt all roads, both public and private, and even if serving flat rate uses, shall be included in Rates and Charger--?age 34 determining the ESU' s. 1. C. A treatment facility or techniques which meets or exceeds the standards defir.ed in Agency rules for on-site water quality facilities. The term "on-site" means on the parcel , or on another parcel in the near vicinity of the parcel requesting the credit or reduction. To be eligible for a reduction of SDC, the property owner must submit a request prior to, or as a part of. , the development process, but in all cases the request must be i.iade prior to the payment of the SDC fees. The County had a pipe installed to pass water from the spring on the future PacTrust property across the road area to a lake on County property to enable the road fill to be constructed. This pipe has always been considered temporary. The County intends `,o fill the lake site that was created by excavating the quarry. When i.he lake is filled, it is the opinion of the _geotechnical engineers that the water in the spring area will rise to the water table level and stabilize. Your foundation design engineers need to be aware of the present springs and our plans for filling the lake. It may affect their design. This was discussed with Tony Righellis and Dan Hottf in a meeting held in the offices of Mackenzie Engineering on January 23, 1992. The proposed site for initial development is approximately 3.9 acres. The parcel to the east of Durham N Road is approximately 5.6 acres. m 0 Storm Drainage System: The proposed storm drainage systern will be designed to facilitate the 25 year peak flow run-off from both the east and west site. The system will use underground piping systems to convey water to the "natural" infiltration basin located at west end of the site. A storm sewer crossing will be required across S.W. Durham Road. Based upon our preliminary grading concepts for both sites, it has been determined that a 21 " will be required. It is proposed that the storm sewer cross under all existing or proposed utilities in S.W. Durham Hoad. This basin will provide adequate storage VOILIMe and infiltration capacity for the 25 year event while providing the water quality treatment per the "current" water quality guidelines and our 0 understanding of their interpretation. r a Hydrology: Peak FJ!1-off flow rates have been calculated using the rational method. Time of concentration and rainfall intensities are based upen the Washington County Uniform Road/mprovement Design Standarc%. Required storage volumes are also determined from the rational method. I!ifiltration during the storm avent is neglected for storage N calculations. Tire peak flow from both si es is 19.60 cubic feet per second, and the required storage volume is 11,050 cubic feet. An Elevation vs. Storage Volume graph was produced based upon the existing topography of the proposed infiltration site. The storage volurne only assumes volume capacity "on-site" and does not include excess storage volume provided from the adjacent property to the south, assuming that the property is tilled in the future. From the graph, the required storage VOIUrTI!? of 1 1 ,050 cubic feet will establish a high water elevation of approximately 141 .00 feet. Thr5 elevation is well within the limits of the basin, and does riot effect T any exisiing or proposed structures. Because there is no natural overflow from the up infiltration basin, the 100 year event was also analyzed for storage requirements. The 100 year storage volume requirement is 14,660 cubic, feet. This will create a high K water level elevation of approximately 143.5 feet. Because the basin can store the 100 year event, no overflc►w facility is required. ,1, STORM WATER NARRATIVE PACTRUST BUSINESS CENTER BUILDINGS NO. 165 AND No. 166 TIGARD, OREGON Infiltratie)n Basin: The existing topography, vegetation and soil conditions at the west end creates 3 "natural" infiltration basin. We are proposing minimal work be done within the basin. To determine the capability of the site in infiltrate run-off, we have utilized the soil Classification data from the SCSIs Soil Survey of Washington County, Oregon to qualify what type of soils are present in the area. The particular site of interest is located in a soil classification zone called "Urban Land". This classification consists of "area that have been altered by urban works and structures" which makes identification "riot fea::,ible". To better unde►stand the soils in the area, we examined adjacent lands that have been classified. These soils are classified under hydrologic group B, indicating the existing soils have properties that make the use of infiltration facilities attractive. Infiltration rates for group B range from 0.6 to 2.0 inches/hr. Water Quality: Based of the Surface Water Quality Facilities Technician Guidance Handbook for water quality treatment adopted by the City of Tigard, we have determined that the infiltration basin will provide treatment for removal of the required 65 percent of phosphorous from both sites. The catchment ratio for the entire site is 0.85 percent. Assuming the most conservative case, an fiitiltration rate of 0.5 in/hr, fhe infiltration basin is projected to treat 85 percent cif flow. We have researched well locations in the area and obtained all available well logs within the section. It appears that sortie wells are located within 500 feet of the proposed infiltration basin, but more study must be completed to determine if the wells are still active. Zoning Designation: I-P ( Industrial Park) . Location: south of the southeastern terminus of SW Durham Road, east of SW Upper Boones Ferry Road (a 3 . 86 arse portion of WCTM 2S1 13AC, Tax Lots 100) . DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain condit'_ons. The findings and conclusions on which the decision was based are noted below: A. FINDINGS OF FACT 1 . Background The City of Tigard has recently approved a Lot Line Adjustment aniongst tax lots 100 and 1200 of WCTM 2S1 13AC and tax lot 100 of WCTM 2S1 13 DB such that the resultant size of the subject property will be 3 . 86 acres (MIS 91- 0010) . In addition, the lot line adjustment will create 2 . 17 acres of right-of-way for the future extension of SW Durham Road. No other land use or development applications regarding this parcel have been reviewed by the City of Tigard. 2 . Vicinity Information The 3 . 86 acre site is located approximately 600 feet southeast of the intersection of SW Durham Road and SW Upper Boones Ferry Road and just north of the Durham quarry which is owned by Washington County. The subject parcel is located south of several existing buildings within the Pact.rust Business Center. The Pactrust Business Center is also owned and operated by Pacific Realty Associates . The subject site and adjacent properties are all designated by the Tigard Comprehensive Plan as Light Industrial, except for areas to the west which are within the City of Durham. Adjacent parcels within the City of Tigard are zoned I-P except parcels to the northeast which are zoned I-L. The Tigard Comprehensive Plan Transportation plan Map designates this section of Durham Road as a major collector street. NOTICE OF DECISION - SDR 91-21 - PACIFIC REALTY ASSOC . PAGE 1 MOAV I� AA-.C_' sr-r- Therefore, the only street improvements that the applicant should be required to install is a sidewalk along the frontage of the adjusted lot. b.--ACCESS The site plan proposes two new access; points from Durham Road, which would be approximately 130 feet apart. The access points are located with one in the center of the site and the other in the southeastern corner of the site. In addition, this site would have additional access to Durham Road provided by an existing access driveway on another section of the Pactrust Business Park just northof ti►e subject site, approximately 220 feet to the north cf the proposed center access point. While the Community Development Code does not specify any specific minimum distance between access points on a major collector, the Code -.nd Comprehensive Plan discourage multiple accass driveways on driveways. We feel there would be adequate circulation for the site with the proposed central access point and the existing access driveway to the north. Therefore, the additional proposed access driveway located in the southeastern Ccorner of the site should not be allowed. c . SANITARY SEWER: There currently are no public sanitary sewer lines to serve this site, but as mentioned above Washington County has plans for the improvement of Durham Road that include the extension of an existing public sanitary sewer line to s rve this site. Therefore, the proposed building requ,red to be connected to the extended sanitary sewer line. d. STORM SEWER: Effective Dec,-�mber 1, 1991, we are required to comply with a new requirement of the State Environmental Quality Commission (EQC) . The EQC is requiring that all new developments within the boundaries of the Unified Sewerage Agency (USA) service area that add additional impervious service area must include a water quality treatment facility. Previously, developments without a suitable site for water quality treatment were allowed to pay a fee in lieu of on-site water NOTICE OF DECISION - SDR 91-21 - PACIFIC REALTY ASSOC. PAGE 3 quality treatment, with the fees to be used to construct regional facilities . The applicant As -proposing to install a water quality Tac .lity in the northwest corner of the site to handle the storm water. . The Water District will require an 8 inch ductile iron main to be extended between the proposed buildings with a 6 inch ductile iren branch to each building, as well as separate backflow prevention devices for each building. Fire department connect_ions will need to be provided within 70 feet of the nearest fire hydrant. The developer should coordinate utility work 1 Cwith Washington County's road improvement project for _purham Road. The City of Tigard Building and Operations Divisions , PGE, and GTE have reviewed the proposal. and have issued no comments or objections . No other comments have been received. B. ANALYSIS AND CONCLUSION The proposal for development of Pactrust Business Center Buildings 165 and 166 conforms with Community Development Code I-P ( Industrial Park) zoning district requirements for setbacks from property boundaries and maximum building height (45 feet maximum allowed; 24 feet maximum building height proposed) . The development plan proposes site impervious surface coverage of 78 percent and site landscaping of 22 percent. These coverage/landscaping percentages will meet Code Section 18 . 68.050 .A ( 5) and ( 6 ) only if the planting size of the proposed street trees is at least a 3-inch caliper at four feet in height. Those sections of the Code establish coverage/landscaping standards of 80 percent/20 percent if parking areas are set back from the street and if street trees are larger than the usual Code minimum planting size. However, the landscaping plan fails to specify minimum tree size at planting, although it proposes adequate numbers and locations of street trees along the site's SW Durham Road frontage. The landscaping plan will need to be revised accordingly. The buildings are designed to accommodate a variety of uses permitted in the I-P zoning district. The applicants are very familiar with the range of uses permitted in the I-P zoning district. City staff reviews uses locating within a multi-tenant development through applications for tenant modification building permits and the payment of business taxes . The site plan appears to provide an adequate number of parking spaces to satisfy the Code parking requirements for uses likely to locate in the proposed buildings . The Code requires that warehouse uses be provided with at least 1 perking space per .1000 square feet; manufacturing uses be provided with 1 space per employee; and general office uses be provided with 1 space per 350 square feet) . The applicants anticipate a 60/30/10 percent distribution of these use types in the proposed buildings . The site plan proposes 79 spaces or 1. space per 870 square feet of gross building area. The 79 spaces should therefore be adequate to serve the projected uses of these buildings , although the parking area may need to be expanded slightly in the future if the tenant mix ends up including more office use than is currently projected. The site plan, however. , does not provide for an appropriate number of designated handicapped parking spaces for a 79 space parking lot as required by the Oregon Revised Statutes ( 3 spaces required; 2 provided) . The site plan will therefore need to be revised to add one additional designated handicapped parking space. Thr•, site plan notes that bicycle parking will be provided in front of Building 166, although it is not clear how many bicycle parking spaces will be provided. Code Section 18 . 106 . 020(P) requires that one bicycle parking space within an approved bicycle rack be provided for every 15 automobile parking spaces . Therefore, six bicycle parking spaces are required to he provided prior to the issuance of occupancy permits for the buildings . The proposal complies with Community Development Code requirements for parking area trees, street tree., general site landscaping requirements, vision clearance at driveway/road intersections, adequate internal NOTICE OF DECISION •- SDR 91-21 - PACIFIC REALTY ASSOC. Community Developrr&.nt Code Chap►.er 18 . 108 and the Transport tion Chapter of Volume ] of the Comprehensive Plan encourage limiting the number of access driveways on major collector streets in order to reduce traifi.c conflict points between through traffic and traffic related to developments along the collector street. The proposF,d new industrial buildings would appear to be adequately served by the existing driveway just north of the subject parcel and by the proposed driveway in the center of the site's Durham Road frontage, without the proposed driveway in the southeastern corner of the site. Therefore, in order to reduce the potential for traffic conflicts along this stretch of Durham Road, the site plan will need to be revised to eliminate the proposed southeastern dri-i-eway. C. DECISION THE DIRECTOR'S DESIGNEE APPROVES SITE DEVELOPMENT REVIEW SUR 91-0021 SUBJECT TO THE FOLLOWING CONDITIONS .
