SDR 89-04/V 89-09 APPLICATION: A request by Pacific Realty Association f(x: site development review approval to construct a 7,750 square foot office/light industrial building and to request a variance to allow a L0 foot front yard building setback where a 35 foot setback is required. Zone: I-P (Industrial Park). Location: 15600 SW 72nd Avenue (WCTM 2S1 12DD lot 200) . DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision was based are noted below. A. FINDING OF FACT 1. Background In May of 1986, the Planning Director approved a Site Development Review (SDR 10--86) for development of a 32,250 square foot_ mixed Industrial use building on the site. The bailding has since been constructed. A zone change proposal was approved by the Tigard Planning Commission (ZC 88-05) in May, 1988, subject to two conditions. The approval granted a zone change from I-L (Light Industrial) to I-P (Industrial Park) . 2. Vicinity Information Properties to the east and southwest are also zoned and developed T-P. Properties to the west and south are zoned I-L (Light Industrial) . The site is bordered by Upper Boones Ferry Road to the south, SG. 72nd Avenue to the went, and the Southern Pacific Railroad right-of-way to the northeast. 3. Site Information and Proposed. The property is a relatively narrow, 2.52 acre, triangula: shaped parcel. A 32,250 square foot two-story industrial office building has been constructed on the southern portion of the site, along with 103 parking spaces, a loading area on the east side of the building iand landscaping coverage amounting to about 21 percent of the site. The northern portion of the property i9 undeveloped and unimproved and in the subject of this report. The applicant proposes to construct a small office/warehouse building on the site and is requesting a variance to the 35 foot STAFF REPORT -- SDR A9-04/V 89-09 - PACIFIC REALTY -- PAGE 1 front yard setback requirement for parcels in the I-F zoning district. A total of nine parking spaces are propoeed. The northern portion of the property, referred to by the applicant as "phase 2", is proposed to have 28 percent landscaping, for an overall total of 22 percent for the entire 2.52 acre site. A new access apron will be created along SW 72nd Avenue near the new building. 4. Agency and NPO Comments The Northwest Natural Gas, Portland General Electric, and General Telephone companies, the Tigard Water District, the Consolidated Rural Fire District and the City Building Division have all reviewed the proposal and have no objections to it. Neighborhood Planning Organization no. 5 was notified but has not yet had an opportunity to meet and discuss this proposal. The City Engineering Division has reviewed the proposal and has the following comments: a. The submitted plans show the proposed building on a site north of an existing building which fronts SW 72nd Avenue. The building is proposed to be constructed with a 10 foot setback and has two accesses to SW 72nd Avenue. b. The proposed building fronts onto SW 72nd Avenue, a recently improved major collector street. All street improvements are in place except for sidewalks and streetlights. C. The proposed site improvements are shown to connect to the existing storm drainage and sanitary newer services in SW 72nd Avenue. d. The requested 10 foot setback variance does riot appear to restrict the traffic or public utilities. No other comments were received. B. ANALYSIS AND CONCLUSION Section 18.120.180 refers to the specific chapters of the Community Development Code which must be natisfied in order to gain approval. from the Planning Director or his designee for a site developiient review. These chapters contain standards for development in the I-P zoning district, landscaping and screening, riff-street parking and loading, visual clearance areas, access, egress and circulation and signage. The proposed site plan meets development code standards for building height but a discussion on parking, signage, building setbacks, landscaping and vision clearance is warranted. STAFF REPORT - SDR 89-04/V 89-09 - PACIFIC REALTY - PAGE 2 a. Parking The original site plan for phase one of this project inidcated 103 parking spaces where only 65 were required. Phase two will require a minl.mum of 22 on-site parking spaces. Because the southerly access from 3'A Upper Boones Ferry Road connects the two phases, staff has determined that the on-site automobile parking requirements for both phases will be satisfied. However, two spaces for bicycle parking are also required. These should be indicated on a revised site plan. b. Si,lnage No plans or drawings have been submitted by the applicant relating to signage. Therefore, all signage must be reviewed separately in the future and be approved for sign permits by the Planning Division. city sign permits are required bofore the erection of signs. Staff notes that "he entire site (phase 1 and phase 2) will. be permitted no more than one freestanding sign. Wall signage may cover up to 15 percr,nt of the wall face on which a sign is mounted. c. Building Setback In the Industrial Park zoning district, the required front yard setbac% for any structure is a minimum of 35 feet from the front property line. The applicant proposes a setback variance to allow a 10 foot building setback from the front property line. Section 18.134.050 of the Code contains criteria whereby the Director can approve, approve with modifications or deny a variance request. They are: (1) The proposed variance will not be materially detrimental to the purposes of this Code, be in conflit:t with the policies of the Comprehensive Plan, to any other applicable policies of tho Community Development Code, to any other applicable policies and standards, and to other properties in tha same zoning district or vicinity. (2) There are special circumstances that ex _ which are peculiar to the lot size or shape, topography or ocher circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district, (3) The use proposed will be the same as permitted under this Code and City standards will be maintained to thr. greatest extent possible, while permitting some economic use cf the land; (4) Existing physical and natural aysteme, such aP but not limited to traffic, drainage, dramatic land forms 07: parka will not be adversely affected any more than would occur if the development were located as specified in the Code; and STAFF REPORT - SDR 89-04/V 89-09 PACIFIC REALTY - FAGS r MMEM i (5! The hardship is not self-imposed and the variz.nce requested is the minimum variance which would alleviate the hardshiv. The variance as proposed will not be in conflict with other applicable policies and standards of the Community Development Code and the Comprehensive Plan. The configuration of this northern portion of the parcel, a narrow triangle, makes it impossible to build any sizeable structure on the property and still meet the 35 foot setback requirement. The peculiar shape of the lot indeed severely limits not only the location of any building but also the size of a potential building. The use proposed will be the same as permitted under the Code and City standards will be maintained to the greatest extent possible while permitting some economic use of the land. Existing physical and natural systems will not be affected by this proposal. The hardship is not self-imposed but rather is a result of city regilations and the 1 location of the railroad tracks to the oast and SW 721d Avenue ,:o the west. The variance is the minimum requested; the buiiding cannot be plao3d any further back on the property as it is proposed to be located directly abutting the rear property line shared wi :h the Southern Pacific Railroad. Staff therefore recommends approval -)f the building setback variance f,.)r the front yard. d. Landscaping Normally the si.LN landscaping requirement in the I-P zoni,ig district requires that a minimum of 25 percent of the entire site be landscaped. however, a new provision rontainod in section 1.8.68.050.A.6. allows this requirement to be reduced when all of the following standards are mets 1) Street trees must have a minimum caliper of 3 inches instead of the usual two inches at four feet in height; 2) The landscaping between the parking lot and the street property lines shall have a minimum width of 10 feet: and 3) all applicable buffering, screening and setback requirements can be satisfied. The proposed street trees are proposed to have a caliper of two inches. Staff will therefore require a -avisrd landscaping plan to indicate the required three inch caliper at four feet in height. The landscaping between the parking lot and the front property line All indeed have a 10 foot width and all other buffering and builling eet.back requirements will be met. The spacing of street trees varies on the site plan from 45 to 60 feet apart. This needs to be revised on the site landscaping plan so that the intended red maplee are spaced no -greater than 40 feet apart. Also, the Code requires partial ecreening of the parking areas through thr use of landecaped berms or plantings. The amended pltn should illustrate how this will be accomplished and how the landscaped areas will be irrigated. e. Vision clearance is important to pedestrians and motorists, who need to be able to see around intersections of public streets and private driveways in order to enter and exit safely.
