The maintenance charges include two years worth of elects city costs and two years worth of maintenance. From two years following the time of installation, these costs are paid by the City, under their schedule 91-B maintenance agreement with PGE. These street light installations were condit(c.,is of the street opening permits issued for the various projects. And, in order to have the bonds released for the various projects, this work must be completed. On the Sharp 1 -ind 2 projects, it is our understanding that these are the final outstanding items. On the Corporate Center project, there are two further outstanding items; one item is construction of a short length of ;rdewalk from the north end of the frontage improvements to the driveway apron for the pine company to the north. It is our understanding that the street light installation and the placement of the sidewalk are the final items to be completed along the frontage for the Corporate Center. i Following completion of the above items, it is our understanding that the bonds will be released by the City of Tigard. DECISION_: Notice is hereby given that the Planning Director for the City of Tigaid ha.; APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director based his decision are noted below. A. FINDING OF' FACT I . Background There are no recent land use actions that have been made which pertain to this application. 2. Vicinity Information The property is totally surrounded by properties that are zoned either I-L (Light Industiral) and I-P (Industrial Park) and is boarded by Upper Boones Ferry Road, 721ld Avenue, and the Southern Pacific Railroad. Properties to the south and soutr.east are developed with a service station/convenience store and light indus--rial buildings. The west side of 721ld Avenue contains a mixtire of light industrial uses and undeveloped parcels. The large parcels immediately east of the tracks are used for unloading vehicles or are vacant . 3. Site Description b Property Description The subject property is a relbtively narrow triangular parcel that is vacant. The applicant is proposing to construct a 23, 125 square foot one story industrial building with a future second floor of 9, 125 square feet. Parking area will he provided between the building and 72nd Avenue and Upper Boones Ferry Road with one driveway access on each of the two streets. Loading area will be located along; the edge of the building. in addition, the northern portion of the property will remain undeveloped and the applicant indicates that it will be developed at a later time. It is proposed that the required half street improve- ments along 72nd +venue coincide with the phasing of construction. 4. Agency b NPO Cr,mments The Engineering Division has the following comments: a. The proposed phasing of half-street improvements to coincide with the development of the site is acceptable. NOTICE OF DECISION - SDR 10-86 -- PAGE, I b. The CC.L of relocating any utilities, such as poles, shall be borne by the developer. The Building Inspection Division has no objection to the request but it is noted that the issue of storm drainage should be addressed. The -Tigard Water District has no obieSlionto the proposal. The State Highway Division states that the full access intenD on Upper Boores Ferry Road could have an impact upon this st as well as i :s intersection with 72nd avenue. Future develo is likely to change the signal ope.arion to an extent that aturn laneadjacent to the development is warranted. Also, thuse drive on Upper Boones Ferry Road will effect eastbound t left turns onto the site No other comments have been received. B. ANALYSIS & CONCLUSION The proposed development meets Community Development Code requirements for setbacks, maximum building height, lot coverage, landscaping, access, parking, loading area, and visual clearance. The comments below are intended to clarify several aspects of the proposal and to identify minor modifications which must be made. I . Parking The probabl( uses for the building have parking requirements in the Code of one space per 500 or 1000 square feet of floor Brea. Ueing the 500 foot standard, 47 spaces are required. The futura second floor of 9, 125 square feet will raise the requirement to 65 spaces. The 98 standard space's and two handicapped spaces easily mret City standards. The handicapped ,pace: shown in the southern end of the parking lot should be moved to have sidewalk access to the building. Also, both handicapped spaces should have sidewalk ramps adjacent to them. The site plan shows parking stalls with a 15 foot pavement length and a three foot overhang in front over the landscaping. Thin is allowed by Code but this three foot area cannot be counted towards meating landscaped area requirements. The amount of landscaped area is not critical presently because of the undeveloped area to fila north, but this should be kept in mind when future construction i;: planned. NOTICE OF DECISION SDR 10-86 — PACE 2 The Code requres the provision of one bicycle parking space for every 15 required parking spaces. Three bike spaces will be necessary for the one story building and one additional space is needed if the second story is constructed. 2. Second Story Section 18. 120.050 allows for the approval of a phased develop- ment not to exceed three years. The second story may be considered as s second phase of this project which must be initiated within three years under the conditions of this approval. After three years has elapsed, a new Site Development Review application will be necessary. 3. Half.-street Improvements on 72nd Avenue The applicants' proposal to only provide half-street improvements up to the northern limit of the present project is acceptable to the City. Any development of the northern section of the property, including parking or loading areas will require the completion of half-street improvements to the northern boundary of the parcel. New building construction will require another Site Development Review approval. C. DECISION The Planning Director approves SDH 10-86 subject to the following conditions: 1 . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO ISS13ANCE OF BUILDING PERMITS. 2. Standard half-street improvements including sidewalks, curb cuts, streetlights, driveway aprons, storm drainage and utilities shall be installed along the SW 72nd Avenue frontage. Said improvements along SW 72nd Avenue shall be built to major collector street standards and confom to the alignment of existing adjacent improvements. 3. Standard half-street improvements including sidewalks, curb drivP,•,ay aprons, storm drainage and utilities shall be installed along the SW Upper Boones Ferry Road frontage. Said improvements along Upper Boones Ferry Road shall be built to major collector street standards and conform to the alignment of existing adjacent improvements. 4. Five (5) sets of plan profile public improvement construction plans and one ( 1) itemized construction cost estimate, stamped by a Registered "rofPssional Civil Engineer, detailing all provosed public improvements shall bu eubmi.tted to the Engineering Section for approval. Construction of proposed public improvements shall not commence until, after the Engineering Section has issued approved public improvement plans. The Section will require posting of a 100% Performance Bond, the payment of a permit fee and a streetlight fee. Also, the execution of a street opening permit shall occur prior to, or concurrently with the_ issuance of approved public improvement plaas. SEF. DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director based his decision are noted below. A. FINDING OF FACT I . Background There are no recent land use actions that have been made which pertain to this application. 2. Vicinity Information The property is totally surrounded by properties that are zoned either I-L (Light Industiral) and I-P ( Industrial Park) and is boarded by Upper. Boones Ferry Road, 72nd Avenue, and the Southern Pacific Railroad. Properties to the south and southeast are developed with a service station/convenience store and light industrial buildings. The west side of 72nd Avenue contains a mixture of light industrial uses and undeveloped parcels. The large parcels immediately "ast of the tracks are used for unloading, vehicles or are vacant . 3. Site Description 6 Property Description The subject property is a relatively narrow triangular parcel that is vacant. The applicant is proposing to construct a 23, 125 square foot one story in.lustrial building with a tutu:(' ;econd floor kf 9, 1",' square feet . Parking; area will he pravided between the huildinv; :md 72nd Avenue and Upper Boones Ferry Rnad with one driveway acres'.; 011 each of the two streets . Loading; area will be located along tilt, edge of the building. In addition, the northern portion of the property will remain undeveloped and the applicant indicates that it will he developed at a later time. It is proposed that the required half street improve- ments along 72nd Avenue coincide with the phasing of construction. 4 . Agency 6 NYU Comments The Engineering Division has the following; comments: a. The proposed phasing; of half-sheet improvements to coin, ids with the development of the site is acceptable. N01-0-1 OF DK I S ION - SDN 10--86 PA(* I b. The cost of relocating any utilities, such as poles, shall be borne by the developer. 'The Building Inspection Division has no objection to the request but it is noted that the issue of storm drainage should be addressed. The -Tigard Water District has no objection to the proposal. The State Highway Division states that the full access intended on Upper Booties Ferry Road could have an impact upon this street as well as its intersection with 72nd Avenue. Future development is likely to change the signal operation to an extent that a right turn lane adjacent to the development is warranted. Also, the full use drive on Upper Booties Ferry Road will effect eastbound traffic because of left turns onto the site. No other comments have been received. B. ANALYSIS 6 CONCLUSION The proposed development meets Community Development Code requirements for setbacks, maximum building height, lot coverage, landscaping, access, parking, loading area, and visual clearance. The comments below are intended to clarify several aspects of the proposal and to identify minor modifications which must be mrd I . Parking The probable uses for the building have parking requirements in the Code of one space per 500 or 1000 square feet of floor area. I.Ising the 500 foot standard, 47 spaces are requires:. The future second floor of 9, 125 square feet will raise the requirement to 65 spaces. The 98 standard spaces and two handicapped spaces eaziily rivet City standards. The handicapped ;pace shown i.n the southern encs of the parkinE; lot should be moved to have sidewalk access to the building. Also, hath handicapped spaces should have sidewalk ramps adjacent to them. The sire plan slwws parking stalls with a 15 foot pavement len'th and a L ee foot overhang in front over the landscaping. This is allowrel by Code but this three foot area cannot be counted towards mrctinrt Landscaper! area requirements. The amount of landscaped vertu i!, iot critical presently because of the undeveloped area to tilt' north, but this should be kept in mind when future construction is planned. NOTICE- OF MCISiON _ SIM I0--H6 - PACs 2 The Code requres the provision of one bicycle parking space for every 15 required parking spaces. Three bike spaces will be necessary for the one story building and one additional space is needed if the second story is constructed. 2. Second Story Section 18. 120.050 allows for the approval of a phased develop- ment not to exceed three years. The second story may be considered as a second phase of this project which must be initiated within three years under the conditions of this approval. After three years has elapsed, a new Site Development Review application will be necessary. 3. Half-street Improvements on 72nd Avenue The applicants' proposal to only provide half.-street improvements up to the northern limit of the present project is acceptable to the City. A y development of the northern section of the property, including parking or loading areas will require the completion of half-street improvements to the northern boundary of the parcel. New building construction will require another Site Development Review approval. C. DECISION The Planning Director approves SDR 10-86 subject to the following conditions : I . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO ISSUANCE OF BUILDING PERMITS. c. Standard half-street improvements inciuding sidewalks, curb ruts , streetlights, driveway aprons, storm drainage and utilities shall be installed along the SW 72nd Avenue frontage. Said improvements along SW 72nd Avenue shall be built to major collector street standards and confom to the alignment of existing adjacent improvements . 3. The 9, 125 square foot, second story is approved as a second phase which must be implem:.-rated within 3 years of the final approval date noted below. 10.
