S/'Z i CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW SDR 4-85 VARIANCE V 10-85 APPLICATION: Request by Andre and Linda Nadeau for Site Development Review approval for a 1200 square foot building addition and new 7,200 square foot building. A Variance is also requested to allow a 20 foot wide driveway where 24 feet is required and to allow less than 15% landscaping on the property zoned I-L (Light Industrial) and located at 15785 SW 72nd Avenue (WCTM 2S1 120C, T.L. 400) DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described applications subject to certain conditions. The `rJings and conclusions on which the Director based his decision are as noteJ below. A. FINDING OF FACT 1 . Background The original development of the property was approved in February, 1980. 2. Vicinity Information The surrounding properties are zoned I--L. The properties to the south, west, and east side of 72nd Avenue are undeveloped. rhe street frontage has been improved through the 72nd Avenue LID except for a sidewalk. 3 . Site Information and Proposal Description The property is presently developed with a 2,816 square foot building, a paved parking area in front and a gravel storage area y U for automobiles in the area. The existing building has 20 foot side yard setbacks to the north and south• The applicant proposes to construct a 1200 square foot addition on the north9r-n side of the existing building. A 7,100 shop building is proposed for the western end of the property. This structure will be built up to the property line on three sides . Two variances are also requested with this application. First, the City standard for two-way driveways is 2.4 feet and the applicant is proposing a 20 foot drive. Second, the I-P zone requires that 15% of a project must be utilized for landscaping and the proposed site plan indicates landscaped area on the property will be reduced from 9% to 6%. NOTICE OF DECISION - SDR 4-85 b V 10--85 PAGE t f / 4 . Agency and NPO Comments The Engineering Division indicates that a sidewalk should be provided along the 72nd Avenue frontage according to City requirements . The Building, Inspection Office indicates that due to the size, setbacks, and occupancy of the new building, Building Code Requirements will be rather extensive. Also, some accommodation must be made for storm water drainage from the site. NPO 0f5 indicates that the landscaping variance could set an undesirable precedent of minimal landscaping in industrial area. No objection was expressed for the remainder of the proposal as long as the access arrangement is acceptabie to the Tualatin Rural Fire Protection District. B. ANALYSIS AND CONCLUSION The proposal i.s consistent with the requirements of the Community Development Cede related to the intended use, building height, setbacks, and parking. The two major issues associated with the case are the variance requests. Section 18. 134.050 of the Code contains the following criteria that must be met in order to grant a variance: 1 . The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity; 2. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3 . The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is seasonable possible, while permitting some economic use of the land; 4 . Existing physical and natural systems, such as but not limited traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code; and 5. The hardship is not self-imposed and the variance • iquested is the minimum variance which would alleviate the hardship. The variance request to permit a 20 foot wide, two-way driveway is consistent with the above criteria for the following reasons: 1 . The purpose of the minimum driveway width standard is primarily to provide adequate access for emergency vehicles . The fire district standards call for a 20 foot width. NOTICE OF DECISION - SDR 4-85 6 V 10-85 - PAGE 2 Mi- 2• The 24 foot width applies to parking areas that accommodate up to 100 vehicles. The site plan indicates that only 17 parking spaces will beserved Y drive ar 20foot A enue will acpcom odatepaMostces and of dthe 24 foot wide customer traffic , Also, a portion of the existing building wool have to be removed in order to menet the 24 foot standard. 3 . The use is permitted in ti ^ 7.ine and the request is the minimum necessary to alleviate the hardship. ssu The variance to the landscaping requirement a existing more complex i ny elocation, recognized that the circumstances relating to conf to parking, and the long and narrow lot iguration make it difficult he provide landscaped area that will have a visual benefit ce the existing landscaped area o 6X of the lot applicants' proposal to redu size does not appear to be nimum variance necessary to allow for the economic development of the property . nts in the The Code requires a landscaped area of ldependant uponndustrial thePreference I—L tone. The type of landscaping is primarily t for the installation of street trees and trees of the property owner excep within parking lots at a ratio of one tree per seven spaces. A site obscuring fence will be retained along the north and south property lines for security reasons . The existing building and the new structure in the rear will block any viewing of the internal section of the property. king Because of the present building and parreargiven feasible area the existing Shop to provide additional landscaping is to the As stated earlier, the lar' aping proposeeptgiven d is not accable, however, the following modifications, the variance would 5e consistent with the evaluation criteria noted above: hat a minimum of lOX of the lot area is 1 . Revise the site plan so t landscaped. 2. Provision of two street trees along 72nd Avenue. 3 . Provision of three trees as required for the 22 parking spaces . 4. Provide a minimum of 9 additional trees hat will be aestheticalthe perimeter' of ly project. The trees should be as well as the subject property . beneficial to adjoining parcels Planning staff concludes that the above changes areconsistent ae aesthetically t intent of tFI Ce The ity' s landscaping requirements to provide pleasing environment. Since the proposal will be expected etc. , it is possible the applicable standards for parking, access, construction plans may need to be reduced.
