They would then forward the installation monies to PGE for the installation work. The installation work would then be coordinated by tike City of Tigard with PGE. The maintenance charges include two years worth of electricity costs and two years worth of maintenance. From two years following the time of installation, these costs are paid by the City, under their schedule 91-B maintenance agreement with PGF. These street light installations were conditions of the street opening permits issued for the various projects. And, in order to have the bonds released for the various projects, this work must be completed. On the Sharp 1 and 2 projects, it is our understanding that these are the final outstanding items. On the Corporate Center project, there are two further outstanding items; one item is construction of a short length of sidewalk from the north end of the frontage improvements to the driveway apron for the pipe company to the north. It was also brought to our attention by Mike Mills, City of Tigard, that a portion of the sidewalk along the 72nd Avenue frontage Gust north of Cardinal Road) appeared damaged, and the City is requiring that this be repaired. It is our understanding that the street light installation and the placement of the sidewalk are the final items to be completed along the frontage for the Corporate Center. Following completion of the above items, it is our understanding that the bonds will be released by the City of Tigard. Every effort has been made to accurately record this conversation. Neighborhood Planning Organ..zation no. 5 was notified but has not yet: had an opportunity to meet and discuss this proposal. The City Engiiieering Division has cc4viewel the proposal and has the following comments: a. The submitted plans show the proposed building on a site north of an existing building which fronts SW 72nd Avenue. The building is proposed to be constructed with a 10 foot setback and has two accesses to Sft 72nd Avenue. b. The proposed building fronts onto SW 72nd Avenue, a recently improved major collector street. All street improvements are in place except for sidewalks and streetlights. C. The proposed site improvements are shown to connect to the existing storm drainage and sanitary Sewer services in SW 72nd Avenue. d. The requested 10 foot setback variance does not appear to restrict the traffic or public utilities. No other comments were received. O. ANALYSIS AND CONCLUSION Section 18.120.180 refers to the specific chapters of the Community Development Code which must be satisfied in order to gain approval from the Planning �)irector or his designee for a site development review. These chapters contain standards for Oevelopment in the I-P zoning district, landscaping and screening, off-street parking and loading, visual clearance areas, access, egress and circulation and signage. The proposed site plan meets development code standards for building height but a discussion on parking, signage, building setbacks, landscal,ing and vision clearance is warranted. STAFF REPORT - SDR 89-OA/V 89-09 - PACIFIC REALTY - PAGE 2 a. Parking The original site plan for phase one of this project inidcated 113 p'_ri.ng spacer where only 65 were required. Phase two will require a minimum of 22 on-site parking spaces. Because the southerly access from SW gppbr Boones Ferry Road connects the two phases, staff has determined that the on,-site automobile parking requirements for both phases will be satisfie+. However, two spaces for bicycle parking are also required. These ehoulu'-)e indicated on a revised site plan. b. Signage No plans or drawings have been submitted by the applicant relating to signage. Therefore, all signage must be reviewed separately in the future and be approved for sign permits by the Planning Division. City sign permits are required before the erection of signs. Staff notes that the entire site (phase 1 and phase 2) will be permitted no more than one freestanding sign. Wall. signage may cover up to 15 percent of the wall face on which a sign is mounted. C. Building Setback In the Industrial Park zoning district, the required front yard setback for any structure is a minimum of 35 feet from the front property line. The applicant proposes a setback variance to allow a 10 foot building setback from the front property line. Section 1.8.134.050 of the Code contains criteria whereby the Director can approve, approve with modifications or deny a variance request. They ares (1) The proposed variance will not be materially detrImental to the purposes cf this Code, be in conflict with the policies of the ComprehenL-+ve Plan, to any other applicaole policies of the Community Development Code, to any other applicable policies and stait:ards, and to other properties in the Hama zoning district or -vicinity. (21 There are special circumutancen that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; (3) The use proposed will be the same as permitted under thio Code and city standards will be maintained to the greatest extent possible, while permitting some economic use of the lr_nd; (4) Existing physical and natural systemst, av,!h as but not limited to traffic, drainage, dramatic land forms of parks will not be adversely affected any more than would occur if the e.evelopment were located as specified In the Code; and STAFF RRPORT - SDn 84-041/V 60-09 - PACIFIC REALTY -- .-AGE 3 st (5' The hardship is not self-imposed and the variance requested is the iainimum variance which would alleviate the hardship. The variance as proposed will not be in conflict with other applicable policies and standards of the Community Development Code and the Comprehensive Plan. The configuration of this northern portion of the parcel, a narrow triangle, makes .it impossible to build any sizeable structure on the property and still meet the 35 foot setback requirement. The peculiar shape of the lot indeed severely limits not only the location of any building but also the size of a potential building. The use proposed will be the same an permitted under the Code and City standards will be maintained to the greatest extent possible while permitting some economic use of the land. Existing physical and natural systems will not be affected by this proposal. They hardship is not self-imposed but rather is a result of city regulations and the location of the railroad tracks to the east and SW 72nd Avenue to the west. The variance is the minimum requested; the building cannot be placed any further back on the property as it is proposed to be located directly abutting -he rear property line shared with the Southern Pacitic Railroad. Staff th9refore recommends approval of the building setback variance for the front yard. d. Landscaping Normally the site land3caping requirement in the I-P zoning district requires that a minimum of 25 percent of the entire site be landscaped. However, a new provision contained in section 18.68.050.A.6. allowe this requirement to be reduced when all of the following standards are Diet: 1) Street trees must have a minimum caliper of 3 inches instead of the usual: two inches at four feet in height; 2) The landscaping between the parking lot and the street property line shall have a minimum width of 10 feet; and 3) all applicable bL.ifering, screening and setback requirements can be satisfied. The proposed street trees are proposed to have a caliper of two inches. Staff will therefore require a revised landscaping plan to indicate the required three inch caliper at four feet in Might. The landscaping between the parking lo . and the front property line will indeed have a 10 foot width and all other buffering and building setback requirements will be met. The spacing of street trees varies on the site plan from 45 -o 60 feet apart. This meds to be revised on the mite landscaping plan so that the '.ntended red a `.ea are spaced no greater than 40 feet apart. Also, the Code requires j,_rtial screening of the parking areas through tho use of landscaped berms or plantings. The amended plan should illustrate how this will be accomplished and how the landscapes, areas will be irrigated. e. Vision Clearance STAFF REPORT - SDR 89-04/V 89-09 - PACIFIC REALTY - PAGE 4 It appears that the large red maples intended as street trees may create a vision clearance problem. Vision clearance is inportant to pedestrians and motorists, who need to be able to see around intersections of public streets and private driveways in order to enter and exit safely. Staff will have this confirmed by the Engineering staff prior to final approval of the landscaping plan. C.
