The City & Southern Pacific e, �cuted an agreement dated Jan, 7, 1983 whereby the City could proceed to have a sanitary sewer line installed which crossed the railroad spur track on SW 72nd Avenue (near Pre-Delivery Company) . This work was intended to be done at the time of improvement of 72nd Ave; but wasn't. 2. The original agreement expired on January 7, 1994, Now, with development of adjacent properties, it is necessary to have the sewer crossing work done; and subsequently, "railroad staff and City staff" have determined that the most expedient means of accomplishing th4t is to provide for an extension of the original agreement time limit. 3 . Therefore, City staff recommends that the Council authorize execution DI' the Agreement Amendment to facilitate installation of a necessary sanitary sewerage line crossing the railroad' s right-of-way . 4. 'The line will be installed by a private contractor at the expense of a private developer (Beaver Balt Co. ) in accordance with City reviewed and approved construction plans . ALTERNATIVES CONSIDERED SUGGESTED ACTION Staff recommends Council approve the resolution amending an agreement with the Southern Pacific Transportation Company for the 72nd Avenue mainline sewer crossing, extending the expiration date thereof. The Tualatin Rural Fire Protection District and NPO # 5 have not submitted written comments . f� ANALYSIS AND CONCLUSION The proposed use conforms with the requirements of the I-L zone related to the use to be established, building height, and setbacks. Several modifications will be necessary to bring the development into full conformance with City requirements. 1 . Landscaping The Code requires that at least 15% of the lot area in the I-Lr none be devoted to landscaping. The site plan submitted indicates that 8-10% of the project will be landscaped. Street trees with spacing of 20-40 feet, depending upon tree size, is required along the 72nd Avenue frontage, Trees are shown in the northeast section of the property . but additional trees are necessary along the remaining street frontage. Finally, landscaped buffers between the street and parking area and the provision of trees within the parking lot are also required. The landscaping element. of the plan should be revised to conform with the Code. The relevant sections of the Code are enclosed. 2 . Parking The site plan contains 27 parking places for employees and customers . The Code calls for one parking space per !!mpinyep of the largest shift or one space per 1,000 square feet cf floor space. No information was submitted regarding the number of employees Based upon the square footage formula, two additional spaces are necessary , The site plan should be revised to include the additional parking or the proposed parking arrangement should be justified in terms of the number of employees present during the lamest shift. 3 Street right-of--way Right-of-way dedication totaling 30 feet from the centerline should have been dedicated as part of the 72nd Avenue L.i .O. project. However, the Assessor' s records indicated than only 25 feet of right -of--way exists along the subject property. Verification of full right-of-way should be provided or the additioral street right--of-way should be dedicated as a condition of this approval . Railroad shall furnish all necessary labor, materials , tools and equipment to install and shall install two (2) flashing light grade crossing signals equipped with automatic gate arms , together with necessary actuating and operating circuits and adequate in:.trument housing, hereinafter collectively referred to as "signals , " at said highway crossings . Said signals shall be located approxi- mntely as shown on the print of Railroad's Oregon Division Drawing D-1930 dated July 3 , 1981 , revised November 22 , 1982 , attached and made a part hereof . Installation of arid all materials for said signals shall be in accordance with Railroad's usual standards and in compliance with the Oregon Public Utility Commissioner's Standard Nos . 2 and 4 of Order No. 44783 . 13. Upon receipt by Railroad of a final order from the Oregon Public Utility Commissioner , Railroad shall order necessary materials and , upon receipt of such materials and availability of labor, shall proceed with installation herein contemplated. Grantee agrees to reimburse Railroad for one hundred percent ( 1000) of the cost and expense incurred by Railroad in connection with the furnishing of materials and performing woik of installing said signals . 14 . Railroad , at its expense, shall remove the existing crossings , prepare track, including installation of engineering fabric , and install AC paving through the existing crossing areas . 15. Railroad, at Grantee 's expense , shall install AC paving through the Widened portion of the crossing areas . Grantee agrees to reimburse Railroad for all cost and expense incurred by Railroad in connection therewith. 16 . The parties intend that the promises and obligations of this indenture shall constitute covenants running with the land so as to bind and benefit their respective successors and assigns . As part consideration , Grantee agrees to pay Railroad an amount equal to any and all assessments which may be levied by oraer of any authorized lawful body against the property of Railroad land which may have been paid by Railroa!3) to defray any part of the cost or expense incurred in connection with the construction of said structure upon said property commences' within one ( 1) year from the date first herein written . 10 . Insofar as it lawfully may, Grantee aq:ees to release and in- demnify Railroad , its officers , employees , agents, successors and assigns , from all claims , liability, cost and expense howsoever same may be caused, including reasonable attorney fees , for loss of or damage to property and for injuries to or death of persons arising out of the construction, reconstruction, maintenance, presence, use or removal of said structure, regardless of any negligence or alleged negligence on the part of Railroad employees. The word "Railroad, " as used in this section, shall be construed to include, in addition to Railroad, the successors, assigns and affili- ated companies of Railroad and any other railroad company that may be lawfully operating upon and over the tracks crossing or adjacent to said structure, and the officers and employees thereof. 13.
